DISCLOSURE REQUIRED FOR ROBOCALLS USING AI. 1 Section 227 of the Communications Act of 1934 (47 2 U.S.C. 227) is amended by adding at the end the fol-3 lowing: 4 ‘‘(k) D ISCLOSUREREQUIRED FOR ROBOCALLS 5 U SINGAI.— 6 ‘‘(1) I N GENERAL.—If a person making a 7 robocall uses artificial intelligence to emulate a 8 human being, such person shall disclose at the be-9 ginning of the call or text message the fact that arti-10 ficial intelligence is being used. 11 ‘‘(2) D EFINITIONS.—In this subsection: 12 ‘‘(A) R OBOCALL.— 13 ‘‘(i) I N GENERAL .—The term 14 ‘robocall’ means a call made or text mes-15 sage sent— 16 ‘‘(I) using equipment, whether 17 hardware, software, or a combination 18 thereof and including an automatic 19 telephone dialing system, that makes 20 a call or sends a text message to— 21 ‘‘(aa) stored telephone num-22 bers; or 23 ‘‘(bb) telephone numbers 24 produced using a random or se-25 quential number generator; or 26 VerDate Sep 11 2014 21:53 Mar 04, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H1027.IH H1027 kjohnson on DSK7ZCZBW3PROD with $$_JOB 3 •HR 1027 IH ‘‘(II) using an artificial or 1 prerecorded voice or an artificially 2 generated message. 3 ‘‘(ii) L IMITATION.—For purposes of 4 clause (i)(I), the term ‘robocall’ does not 5 include a call made or text message sent 6 using equipment that requires substantial 7 human intervention to make or send the 8 call or text message. 9 ‘‘(B) T EXT MESSAGE.— 10 ‘‘(i) I N GENERAL.—The term ‘text 11 message’ means a message consisting of 12 text, images, sounds, or other information 13 that is transmitted to or from a device that 14 is identified as the receiving or transmit-15 ting device by means of a 10-digit tele-16 phone number, N11 service code, short 17 code telephone number, or email address, 18 or that is transmitted through application- 19 to-person messaging, and includes— 20 ‘‘(I) a short message service 21 (commonly referred to as ‘SMS’) mes-22 sage; 23 VerDate Sep 11 2014 21:53 Mar 04, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H1027.IH H1027 kjohnson on DSK7ZCZBW3PROD with $$_JOB 4 •HR 1027 IH ‘‘(II) a multimedia message serv-1 ice (commonly referred to as ‘MMS’) 2 message; and 3 ‘‘(III) a rich communication serv-4 ice (commonly referred to as ‘RCS’) 5 message. 6 ‘‘(ii) L IMITATION.—The term ‘text 7 message’ does not include a real-time, two- 8 way voice or video communication.’’. 9 SEC. 3. ENHANCED PENALTIES FOR VIOLATIONS INVOLV-10 ING AI VOICE OR TEXT MESSAGE IMPERSON-11 ATION. 12 (a) I NGENERAL.—Section 227 of the Communica-13 tions Act of 1934 (47 U.S.C. 227), as amended by the 14 preceding provisions of this Act, is further amended by 15 adding at the end the following: 16 ‘‘(l) E NHANCEDPENALTIES FOR VIOLATIONSIN-17 VOLVINGAI VOICE ORTEXTMESSAGEIMPERSON-18 ATION.—In the case of a violation of this section with re-19 spect to which the party making the call or sending the 20 text message uses artificial intelligence to impersonate an 21 individual or entity with the intent to defraud, cause 22 harm, or wrongfully obtain anything of value— 23 ‘‘(1) the maximum amount of the forfeiture 24 penalty that may be imposed under subsection (b)(4) 25 VerDate Sep 11 2014 21:53 Mar 04, 2025 Jkt 059200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H1027.IH H1027 kjohnson on DSK7ZCZBW3PROD with $$_JOB 5 •HR 1027 IH or (e)(5)(A) of this section or subsection (b) of sec-1 tion 503 (as the case may be) shall be twice the 2 maximum amount that may be imposed for such vio-3 lation under such subsection without regard to this 4 subsection; and 5 ‘‘(2) the maximum amount of the criminal fine 6 that may be imposed under subsection (e)(5)(B) of 7 this section or section 501 (as the case may be) shall 8 be twice the maximum amount that may be imposed 9 for such violation under such subsection or section 10 without regard to this subsection.’’. 11 (b) A PPLICABILITY.—The amendment made by sub-12 section (a) shall apply with respect to violations occurring 13 after the date of the enactment of this Act. 14 Æ VerDate Sep 11 2014 21:53 Mar 04, 2025 Jkt 059200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6301 E:\BILLS\H1027.IH H1027 kjohnson on DSK7ZCZBW3PROD with $$_JOB
