5252 NGENERAL.—Chapter 55 of title 38, United 9
5353 States Code, is amended by inserting after section 5501A 10
5454 the following new section: 11
5555 ‘‘§ 5501B. Prohibition on transmittal of certain infor-12
5656 mation to the Department of Justice for 13
5757 use by the national instant criminal back-14
5858 ground check system 15
5959 ‘‘The Secretary may not transmit to any entity in the 16
6060 Department of Justice, for use by the national instant 17
6161 criminal background check system established under sec-18
6262 tion 103 of the Brady Handgun Violence Prevention Act, 19
6363 personally identifiable information of a beneficiary, solely 20
6464 on the basis of a determination by the Secretary to pay 21
6565 benefits to a fiduciary for the use and benefit of the bene-22
6666 ficiary under section 5502 of this title, without the order 23
6767 or finding of a judge, magistrate, or other judicial author-24
6868 ity of competent jurisdiction that such beneficiary is a 25
6969 danger to themselves or others.’’. 26
