4242 SECTION 1. SHORT TITLE. 1
4343 This Act may be cited as the ‘‘Protecting Sensitive 2
4444 Locations Act’’. 3
4545 SEC. 2. POWERS OF IMMIGRATION OFFICERS AND EMPLOY-4
4646 EES AT SENSITIVE LOCATIONS. 5
4747 (a) I
4848 NGENERAL.—Section 287 of the Immigration 6
4949 and Nationality Act (8 U.S.C. 1357) is amended by add-7
5050 ing at the end the following: 8
5151 ‘‘(i)(1) In order to ensure individuals’ access to sen-9
5252 sitive locations, this subsection shall apply to any enforce-10
5353 ment action by— 11
5454 ‘‘(A) officers or agents of the Department of 12
5555 Homeland Security, including officers and agents of 13
5656 U.S. Immigration and Customs Enforcement and 14
5757 U.S. Customs and Border Protection; and 15
5858 ‘‘(B) any individual designated to perform im-16
5959 migration enforcement functions pursuant to sub-17
6060 section (g). 18
6161 ‘‘(2)(A) An enforcement action may not take place 19
6262 at, be focused on, or occur within, 1,000 feet of a sensitive 20
6363 location, except under exigent circumstances. 21
6464 ‘‘(B) If an immigration enforcement action is 22
6565 taking place under exigent circumstances, and the 23
6666 exigent circumstances permitting the enforcement 24
6767 action cease, the enforcement action shall be discon-25
6868 tinued until such exigent circumstances reemerge. 26

7272 ‘‘(C) If an individual referred to in subpara-1
7373 graph (A) or (B) of paragraph (1) is not certain as 2
7474 to whether exigent circumstances exist, the indi-3
7575 vidual shall cease the enforcement action imme-4
7676 diately, consult with their supervisor in real time as 5
7777 to the existence of exigent circumstances, and shall 6
7878 not continue the enforcement action until the indi-7
7979 vidual’s supervisor affirmatively confirms the exist-8
8080 ence of exigent circumstances. 9
8181 ‘‘(3)(A) When proceeding with an enforcement action 10
8282 at or near a sensitive location, individuals referred to in 11
8383 subparagraphs (A) and (B) of paragraph (1) shall make 12
8484 every effort— 13
8585 ‘‘(i) to conduct themselves as discreetly as 14
8686 possible, consistent with officer and public safe-15
8787 ty; 16
8888 ‘‘(ii) to limit the time spent at the sensitive 17
8989 location; and 18
9090 ‘‘(iii) to limit the enforcement action to the 19
9191 person or persons for whom prior approval was 20
9292 obtained. 21
9393 ‘‘(B) If, in the course of an enforcement action 22
9494 that is not initiated at or focused on a sensitive loca-23
9595 tion, individuals referred to in subparagraphs (A) 24
9696 and (B) of paragraph (1) are led to or near a sen-25

100100 sitive location, and no clear exigent circumstance 1
101101 with respect to the sensitive location exists, such in-2
102102 dividuals shall— 3
103103 ‘‘(i) cease before taking any further en-4
104104 forcement action; 5
105105 ‘‘(ii) conduct themselves in a discreet man-6
106106 ner; 7
107107 ‘‘(iii) maintain surveillance; and 8
108108 ‘‘(iv) in the event that uncertainty exists 9
109109 about the existence of exigent circumstances, 10
110110 immediately consult their supervisor in order to 11
111111 determine whether such enforcement action 12
112112 should be discontinued pursuant to paragraph 13
113113 (2)(C). 14
114114 ‘‘(C) This subsection shall not apply to the 15
115115 transportation of an individual apprehended at or 16
116116 near a land or sea border to a hospital or health 17
117117 care provider for the purpose of providing such indi-18
118118 vidual medical care. 19
119119 ‘‘(D) This subsection shall not apply to a rare 20
120120 premeditated arrest operation, undertaken with the 21
121121 prior written approval of an appropriate authorizing 22
122122 official, involving the targeted arrest of a terrorist 23
123123 suspect, an individual who poses a clear threat to 24

127127 national security, or an individual who poses an ex-1
128128 traordinary danger to public safety. 2
129129 ‘‘(4) If an enforcement action is carried out in viola-3
130130 tion of this subsection— 4
131131 ‘‘(A) no information resulting from the enforce-5
132132 ment action may be entered into the record or re-6
133133 ceived into evidence in a removal proceeding result-7
134134 ing from the enforcement action; and 8
135135 ‘‘(B) the alien who is the subject of such re-9
136136 moval proceeding may file a motion for the imme-10
137137 diate termination of the removal proceeding. 11
138138 ‘‘(5)(A) Each official specified in subparagraph (B) 12
139139 shall ensure that the employees under the supervision of 13
140140 such official receive annual training in compliance with the 14
141141 requirements of this subsection, section 239, and section 15
142142 384 of the Illegal Immigration Reform and Immigrant Re-16
143143 sponsibility Act of 1996 (8 U.S.C. 1367). 17
144144 ‘‘(B) The officials specified in this subpara-18
145145 graph are the following: 19
146146 ‘‘(i) The Chief Counsel of U.S. Immigra-20
147147 tion and Customs Enforcement. 21
148148 ‘‘(ii) The Field Office Directors of U.S. 22
149149 Immigration and Customs Enforcement. 23
150150 ‘‘(iii) Each Special Agent in Charge of 24
151151 U.S. Immigration and Customs Enforcement. 25

165165 ‘‘(6)(A) Not later than 30 days after any enforcement 11
166166 action is taken at a sensitive location by any individual 12
167167 referred to in subparagraph (A) or (B) of paragraph (1), 13
168168 the Secretary of Homeland Security shall provide a report 14
169169 to both the Office of the Inspector General of the Depart-15
170170 ment of Homeland Security and the Office for Civil Rights 16
171171 and Civil Liberties of the Department of Homeland Secu-17
172172 rity for each of these individual enforcement actions, 18
173173 which shall contain the following information: 19
174174 ‘‘(i) The date, State, and local political 20
175175 subdivision (such as city, town, or county) in 21
176176 which each enforcement action occurred. 22
177177 ‘‘(ii) The specific sensitive location site 23
178178 where the enforcement action occurred. 24

182182 ‘‘(iii) The type of enforcement action that 1
183183 occurred. 2
184184 ‘‘(iv) The specific department, agency, and 3
185185 officers responsible for the enforcement action. 4
186186 ‘‘(v) A thorough description of the cir-5
187187 cumstances which purportedly justified the en-6
188188 forcement action, including either— 7
189189 ‘‘(I) a clear description of the exigent 8
190190 circumstances involved; or 9
191191 ‘‘(II) a certified copy of the written 10
192192 approval for the immigration arrest that 11
193193 was signed by an appropriate authorizing 12
194194 officer, along with a clear description of 13
195195 the specific and rare threat which justified 14
196196 the premediated arrest at this sensitive lo-15
197197 cation. 16
198198 ‘‘(vi) A description of the intended target 17
199199 of the enforcement action. 18
200200 ‘‘(vii) The number of individuals, if any, 19
201201 arrested or taken into custody through the en-20
202202 forcement action. 21
203203 ‘‘(viii) The number of collateral arrests, if 22
204204 any, from the enforcement action and the rea-23
205205 sons for each such arrest. 24

210210 visor was contacted prior to, during, or after 2
211211 each such enforcement action. 3
212212 ‘‘(B) An appropriate committee of Congress 4
213213 shall, at any time, be able to request and success-5
214214 fully receive a confidential or redacted copy of one 6
215215 of the individual reports described in subparagraph 7
216216 (A). 8
217217 ‘‘(7)(A) The Director of U.S. Immigration and Cus-9
218218 toms Enforcement and the Commissioner of U.S. Customs 10
219219 and Border Protection shall each submit to the appro-11
220220 priate committees of Congress each year a report on the 12
221221 enforcement actions undertaken by U.S. Immigration and 13
222222 Customs Enforcement and U.S. Customs and Border Pro-14
223223 tection, respectively, during the preceding year that were 15
224224 covered by this subsection. 16
225225 ‘‘(B) Each report on an agency for a year 17
226226 under this paragraph shall set forth the following: 18
227227 ‘‘(i) The number of enforcement actions at 19
228228 or focused on a sensitive location. 20
229229 ‘‘(ii) The number of enforcement actions 21
230230 where officers or agents were subsequently led 22
231231 to or near a sensitive location. 23
232232 ‘‘(iii) The date, site, State, and local polit-24
233233 ical subdivision (such as city, town, or county) 25

239239 ‘‘(iv) The component of the agency respon-3
240240 sible for each such enforcement action. 4
241241 ‘‘(v) A description of the intended target of 5
242242 each such enforcement action. 6
243243 ‘‘(vi) The number of individuals, if any, ar-7
244244 rested or taken into custody through each such 8
245245 enforcement action. 9
246246 ‘‘(vii) The number of collateral arrests, if 10
247247 any, from each such enforcement action and the 11
248248 reasons for each such arrest. 12
249249 ‘‘(viii) A certification of whether the loca-13
250250 tion administrator was contacted prior to, dur-14
251251 ing, or after each such enforcement action. 15
252252 ‘‘(8)(A) The Office of the Inspector General of the 16
253253 Department of Homeland Security shall submit to the ap-17
254254 propriate committees of Congress each year a report on 18
255255 the complaints of enforcement actions taken in sensitive 19
256256 locations by U.S. Immigration and Customs Enforcement 20
257257 and U.S. Customs and Border Protection during the pre-21
258258 ceding year that were covered by this subsection. 22
259259 ‘‘(B) Each report for a year under this para-23
260260 graph shall set forth the following: 24

266266 sitive location. 3
267267 ‘‘(iii) The reported date, site, State, and 4
268268 local political subdivision (such as city, town, or 5
269269 county) in which each enforcement action cov-6
270270 ered was by clause (i) occurred. 7
271271 ‘‘(iv) The reported agency responsible for 8
272272 each such enforcement action. 9
273273 ‘‘(v) A description of the intended target of 10
274274 each such enforcement action. 11
275275 ‘‘(vi) The reported number of individuals, 12
276276 if any, arrested or taken into custody through 13
277277 each such enforcement action. 14
278278 ‘‘(vii) The reported number of collateral 15
279279 arrests, if any, from each such enforcement ac-16
280280 tion and the reasons for each such arrest. 17
281281 ‘‘(viii) If available, a certification of wheth-18
282282 er the location administrator was contacted 19
283283 prior to, during, or after each such enforcement 20
284284 action. 21
285285 ‘‘(9) In this subsection: 22
286286 ‘‘(A) The term ‘appropriate authorizing official’ 23
287287 means the following: 24

304304 ‘‘(V) Any other individual who is de-14
305305 termined to be an appropriate authorizing 15
306306 official by the Secretary of Homeland Se-16
307307 curity. 17

330330 the enactment of this subsection. 12
331331 ‘‘(B) The term ‘appropriate committees of Con-13
332332 gress’ means— 14
333333 ‘‘(i) the Committee on Homeland Security 15
334334 and Governmental Affairs of the Senate; 16
335335 ‘‘(ii) the Committee on the Judiciary of the 17
336336 Senate; 18
337337 ‘‘(iii) the Committee on Appropriations of 19
338338 the Senate; 20
339339 ‘‘(iv) the Committee on Homeland Security 21
340340 of the House of Representatives; 22
341341 ‘‘(v) the Committee on the Judiciary of the 23
342342 House of Representatives; and 24

347347 the House of Representatives. 2
348348 ‘‘(C) The term ‘early childhood education pro-3
349349 gram’ has the meaning given the term in section 103 4
350350 of the Higher Education Act of 1965 (20 U.S.C. 5
351351 1003). 6
352352 ‘‘(D) The term ‘enforcement action’ means an 7
353353 apprehension, arrest, interview, request for identi-8
354354 fication, search, or surveillance for the purposes of 9
355355 immigration enforcement, and includes an enforce-10
356356 ment action at, or focused on, a sensitive location 11
357357 that is part of a joint case led by another law en-12
358358 forcement agency. 13
359359 ‘‘(E) The term ‘exigent circumstances’ means a 14
360360 situation involving any of the following: 15
361361 ‘‘(i) The imminent risk of death, violence, 16
362362 or physical harm to any person, including a sit-17
363363 uation implicating terrorism or the national se-18
364364 curity of the United States in some other man-19
365365 ner. 20
366366 ‘‘(ii) The immediate arrest or hot pursuit 21
367367 of an individual presenting an imminent danger 22
368368 to public safety, including the imminent risk of 23
369369 death, violence, or physical harm to a person. 24

373373 ‘‘(iii) A rare, premeditated arrest operation 1
374374 described in paragraph (3)(D), undertaken with 2
375375 the prior written approval of an appropriate au-3
376376 thorizing official, involving the targeted arrest 4
377377 of a terrorist suspect, an individual who poses 5
378378 a clear threat to national security, or an indi-6
379379 vidual who poses an extraordinary danger to 7
380380 public safety. 8
381381 ‘‘(iv) A direct threat to national security. 9
382382 ‘‘(v) The imminent risk of destruction of 10
383383 evidence that is material to an ongoing criminal 11
384384 case. 12
385385 ‘‘(F) The term ‘sensitive location’ includes all of 13
386386 the physical space located within 1,000 feet of the 14
387387 following: 15
388388 ‘‘(i) Any medical or mental healthcare fa-16
389389 cility, including any hospital, health care practi-17
390390 tioner’s office, accredited health clinic, vaccina-18
391391 tion or testing site, or emergent or urgent care 19
392392 facility, or community health center. 20
393393 ‘‘(ii) Public and private schools (including 21
394394 preschools, primary schools, secondary schools, 22
395395 and postsecondary schools (including colleges 23
396396 and universities)), sites of early childhood edu-24
397397 cation programs, other institutions of learning, 25

402402 sites where individuals who are unemployed or 2
403403 underemployed may apply for or receive work-3
404404 force training. 4
405405 ‘‘(iii) Any scholastic or education-related 5
406406 activity or event, including field trips and inter-6
407407 scholastic events. 7
408408 ‘‘(iv) Any school bus or school bus stop 8
409409 during periods when school children are present 9
410410 on the bus or at the stop. 10
411411 ‘‘(v) Any recreational facility for children 11
412412 such as playgrounds and formal recreational fa-12
413413 cilities. 13
414414 ‘‘(vi) Any child care focused facilities in-14
415415 cluding child care centers, before or after school 15
416416 care centers, foster care facilities, and group 16
417417 homes for children. 17
418418 ‘‘(v) Locations where disaster or emer-18
419419 gency response and relief is being provided by 19
420420 Federal, State, or local entities, such as the dis-20
421421 tribution of emergency supplies, food, and 21
422422 water; places of temporary shelter; along evacu-22
423423 ation routes; and sites where registration for 23
424424 disaster-related assistance or family reunifica-24
425425 tion is underway. 25

429429 ‘‘(vi) Locations of any organization that— 1
430430 ‘‘(I) assists children, pregnant women, 2
431431 victims of crime or abuse, or individuals 3
432432 with significant mental or physical disabil-4
433433 ities, including domestic violence shelters, 5
434434 child advocacy centers, facilities that serve 6
435435 disabled persons, drug or alcohol coun-7
436436 seling and treatment facilities, rape crisis 8
437437 centers, supervised visitation centers, fam-9
438438 ily justice centers, victims’ services pro-10
439439 viders, and community-based organizations 11
440440 providing social services; or 12
441441 ‘‘(II) provides disaster or emergency 13
