---|
48 | 48 | | NGENERAL.—Section 287 of the Immigration 6 |
---|
49 | 49 | | and Nationality Act (8 U.S.C. 1357) is amended by add-7 |
---|
50 | 50 | | ing at the end the following: 8 |

51 | 51 | | ‘‘(i)(1) In order to ensure individuals’ access to sen-9 |
---|
52 | 52 | | sitive locations, this subsection shall apply to any enforce-10 |
---|
53 | 53 | | ment action by— 11 |
---|
54 | 54 | | ‘‘(A) officers or agents of the Department of 12 |
---|
55 | 55 | | Homeland Security, including officers and agents of 13 |
---|
56 | 56 | | U.S. Immigration and Customs Enforcement and 14 |
---|
57 | 57 | | U.S. Customs and Border Protection; and 15 |
---|
58 | 58 | | ‘‘(B) any individual designated to perform im-16 |
---|
59 | 59 | | migration enforcement functions pursuant to sub-17 |
---|
60 | 60 | | section (g). 18 |
---|
61 | 61 | | ‘‘(2)(A) An enforcement action may not take place 19 |
---|
62 | 62 | | at, be focused on, or occur within, 1,000 feet of a sensitive 20 |
---|
63 | 63 | | location, except under exigent circumstances. 21 |
---|
64 | 64 | | ‘‘(B) If an immigration enforcement action is 22 |
---|
65 | 65 | | taking place under exigent circumstances, and the 23 |
---|
66 | 66 | | exigent circumstances permitting the enforcement 24 |
---|
67 | 67 | | action cease, the enforcement action shall be discon-25 |
---|
68 | 68 | | tinued until such exigent circumstances reemerge. 26 |

79 | 79 | | vidual’s supervisor affirmatively confirms the exist-8 |

81 | 81 | | ‘‘(3)(A) When proceeding with an enforcement action 10 |
---|
82 | 82 | | at or near a sensitive location, individuals referred to in 11 |
---|
83 | 83 | | subparagraphs (A) and (B) of paragraph (1) shall make 12 |
---|
84 | 84 | | every effort— 13 |
---|
85 | 85 | | ‘‘(i) to conduct themselves as discreetly as 14 |
---|
86 | 86 | | possible, consistent with officer and public safe-15 |
---|
87 | 87 | | ty; 16 |
---|
88 | 88 | | ‘‘(ii) to limit the time spent at the sensitive 17 |
---|
89 | 89 | | location; and 18 |
---|
90 | 90 | | ‘‘(iii) to limit the enforcement action to the 19 |
---|
91 | 91 | | person or persons for whom prior approval was 20 |
---|
92 | 92 | | obtained. 21 |
---|
93 | 93 | | ‘‘(B) If, in the course of an enforcement action 22 |
---|
94 | 94 | | that is not initiated at or focused on a sensitive loca-23 |
---|
95 | 95 | | tion, individuals referred to in subparagraphs (A) 24 |
---|
96 | 96 | | and (B) of paragraph (1) are led to or near a sen-25 |
---|

105 | 105 | | ‘‘(ii) conduct themselves in a discreet man-6 |

106 | 106 | | ner; 7 |
---|
107 | 107 | | ‘‘(iii) maintain surveillance; and 8 |
---|
108 | 108 | | ‘‘(iv) in the event that uncertainty exists 9 |
---|
109 | 109 | | about the existence of exigent circumstances, 10 |
---|
110 | 110 | | immediately consult their supervisor in order to 11 |
---|
111 | 111 | | determine whether such enforcement action 12 |
---|
112 | 112 | | should be discontinued pursuant to paragraph 13 |
---|
113 | 113 | | (2)(C). 14 |
---|
114 | 114 | | ‘‘(C) This subsection shall not apply to the 15 |
---|
115 | 115 | | transportation of an individual apprehended at or 16 |
---|
116 | 116 | | near a land or sea border to a hospital or health 17 |
---|
117 | 117 | | care provider for the purpose of providing such indi-18 |
---|
118 | 118 | | vidual medical care. 19 |
---|
119 | 119 | | ‘‘(D) This subsection shall not apply to a rare 20 |
---|
120 | 120 | | premeditated arrest operation, undertaken with the 21 |
---|
121 | 121 | | prior written approval of an appropriate authorizing 22 |
---|
122 | 122 | | official, involving the targeted arrest of a terrorist 23 |
---|
123 | 123 | | suspect, an individual who poses a clear threat to 24 |
---|

133 | 133 | | ceived into evidence in a removal proceeding result-7 |

134 | 134 | | ing from the enforcement action; and 8 |
---|
135 | 135 | | ‘‘(B) the alien who is the subject of such re-9 |
---|
136 | 136 | | moval proceeding may file a motion for the imme-10 |
---|
137 | 137 | | diate termination of the removal proceeding. 11 |
---|
138 | 138 | | ‘‘(5)(A) Each official specified in subparagraph (B) 12 |
---|
139 | 139 | | shall ensure that the employees under the supervision of 13 |
---|
140 | 140 | | such official receive annual training in compliance with the 14 |
---|
141 | 141 | | requirements of this subsection, section 239, and section 15 |
---|
142 | 142 | | 384 of the Illegal Immigration Reform and Immigrant Re-16 |
---|
143 | 143 | | sponsibility Act of 1996 (8 U.S.C. 1367). 17 |

144 | 144 | | ‘‘(B) The officials specified in this subpara-18 |

175 | 175 | | subdivision (such as city, town, or county) in 21 |

176 | 176 | | which each enforcement action occurred. 22 |

177 | 177 | | ‘‘(ii) The specific sensitive location site 23 |

178 | 178 | | where the enforcement action occurred. 24 |
