2020 SECTION 1. SHORT TITLE. 3
2121 This Act may be cited as the ‘‘Stopping Overdoses 4
2222 of Fentanyl Analogues Act’’. 5

2828 Section 202(c) of the Controlled Substances Act (21 3
2929 U.S.C. 812(c)) is amended by adding at the end of sched-4
3030 ule I the following: 5
3131 ‘‘(e)(1) Unless specifically exempted or unless listed 6
3232 in another schedule, any material, compound, mixture, or 7
3333 preparation which contains any quantity of fentanyl-re-8
3434 lated substances, or which contains their salts, isomers, 9
3535 and salts of isomers whenever the existence of such salts, 10
3636 isomers, and salts of isomers is possible within the specific 11
3737 chemical designation. 12
3838 ‘‘(2) In paragraph (1), the term ‘fentanyl-related sub-13
3939 stances’ includes any substance that is structurally related 14
4040 to fentanyl by one or more of the following modifications: 15
4141 ‘‘(A) By replacement of the phenyl portion of 16
4242 the phenethyl group by any monocycle, whether or 17
4343 not further substituted in or on the monocycle. 18
4444 ‘‘(B) By substitution in or on the phenethyl 19
4545 group with alkyl, alkenyl, alkoxy, hydroxy, halo, 20
4646 haloalkyl, amino or nitro groups. 21
4747 ‘‘(C) By substitution in or on the piperidine 22
4848 ring with alkyl, alkenyl, alkoxy, ester, ether, hy-23
4949 droxy, halo, haloalkyl, amino or nitro groups. 24

5353 ‘‘(D) By replacement of the aniline ring with 1
5454 any aromatic monocycle whether or not further sub-2
5555 stituted in or on the aromatic monocycle. 3
5656 ‘‘(E) By replacement of the N-propionyl group 4
5757 by another acyl group.’’. 5
5858 SEC. 3. PENALTIES. 6
5959 A fentanyl-related substance shall be treated as an 7
6060 analogue of N-phenyl-N-[1-(2-phenylethyl)-4-piperidinyl] 8
6161 propanamide under section 401(b)(1) of the Controlled 9
6262 Substances Act (21 U.S.C. 841(b)(1)) and section 10
6363 1010(b) of the Controlled Substances Import and Export 11
6464 Act (21 U.S.C. 960(b)) without requiring proof that a 12
6565 fentanyl-related substance meets the definition of a con-13
6666 trolled substance analogue under section 102 of the Con-14
6767 trolled Substances Act (21 U.S.C. 802). 15
6868 SEC. 4. EFFECTIVE DATE. 16
6969 This Act shall take effect one day after the date of 17
7070 enactment of this Act. 18
