1818 SECTION 1. SHORT TITLE. 3
1919 This Act may be cited as the ‘‘Protection of Lawful 4
2020 Commerce in Arms Act Federal Jurisdiction Act’’ or the 5
2121 ‘‘PLCAA Federal Jurisdiction Act’’. 6

2727 Section 3 of the Protection of Lawful Commerce in 3
2828 Arms Act (15 U.S.C. 7902) is amended by adding at the 4
2929 end the following: 5

3131 EMOVAL ANDDISMISSAL.— 6
3232 ‘‘(1) R
3333 EMOVAL.—In any civil action in a State 7
3434 court in which a defendant that is a manufacturer, 8
3535 seller, or trade association asserts that the civil ac-9
3636 tion is a qualified civil liability action, that defend-10
3737 ant may remove the civil action to the district court 11
3838 of the United States for the district and division em-12
3939 bracing the place where the civil action is pending. 13
4040 ‘‘(2) D
4141 ISMISSAL.—The district court of the 14
4242 United States to which a civil action is removed 15
4343 under paragraph (1) may— 16
4444 ‘‘(A) determine whether the civil action is 17
4545 a qualified civil liability action; and 18
4646 ‘‘(B) dismiss the civil action accordingly.’’. 19
