45-ROHIBITION.—Notwithstanding any other provi-8
46-sion of law, no funds may be made available under an ap-9
47-plicable program to any elementary school or secondary 10
48-school that— 11
49-(1) has a partnership in effect with a cultural or 12
50-language institute directly or indirectly funded by the 13
51-Government of the People’s Republic of China, includ-14
52-ing a Confucius Institute; 15
53-(2) operates a learning center directly or indi-16
54-rectly supported by the Government of the People’s 17
55-Republic of China (commonly referred to as a ‘‘Con-18
56-fucius Classroom’’); or 19
57-(3) otherwise receives support from an indi-20
58-vidual or entity acting directly or indirectly on behalf 21
59-of the Government of the People’s Republic of China, 22
60-including support in the form of teaching materials, 23
61-personnel, funds, or other resources. 24

65-(b) EFFECTIVEDATE.—The prohibition under sub-1
66-section (a) shall take effect on the date that is one year after 2
67-the date of the enactment of this Act. 3

78-the Secretary a request for a waiver of the prohi-11
79-bition under subsection (a) that includes— 12
80-(i) the complete and unredacted text of 13
81-the contract, and if the contract is not in 14
82-English, a translated copy of the text into 15
83-English; and 16
84-(ii) a statement demonstrating that the 17
85-contract is for the benefit of the school’s 18
86-mission and students and will promote the 19
87-security, stability, and economic vitality of 20
88-the United States. 21

114-guidance for achieving compliance with such requirements. 16
