Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Preventing SBA As-4
sistance from Going to China Act’’. 5

SEC. 2. PROHIBITION ON SMALL BUSINESS CONCERN AF-1
FILIATION WITH THE PEOPLE’S REPUBLIC OF 2
CHINA. 3
Section 3(a) of the Small Business Act (15 U.S.C. 4
632(a)) is amended by adding at the end the following: 5
‘‘(10) P
ROHIBITION ON AFFILIATION WITH THE 6
PEOPLE’S REPUBLIC OF CHINA .—For purposes of 7
this Act, a concern may not be considered a small 8
business concern if such concern is— 9
‘‘(A) located and incorporated in the Peo-10
ple’s Republic of China; or 11
‘‘(B) has more than 25 percent of the vot-12
ing stock of the concern owned by affiliates that 13
are citizens of or organized under the laws of 14
the People’s Republic of China.’’. 15
