3131 NGENERAL.—Section 701 of division I of the 3
3232 Omnibus Parks and Public Lands Management Act of 4
3333 1996 (16 U.S.C. 497c) is amended by adding at the end 5

3838 EFINITIONS.—In this subsection: 8
3939 ‘‘(A) A
4040 CCOUNT.—The term ‘Account’ 9
4141 means the Ski Area Fee Retention Account es-10
4242 tablished under paragraph (2). 11

4444 OVERED UNIT.—The term ‘covered 12
4545 unit’ means the unit of the National Forest 13
4646 System that collects the ski area permit rental 14
4747 charge under this section. 15
4848 ‘‘(C) S
4949 ECRETARY.—The term ‘Secretary’ 16
5050 means the Secretary of Agriculture. 17
5151 ‘‘(2) E
5252 STABLISHMENT.—The Secretary of the 18
5353 Treasury shall establish a special account in the 19
5454 Treasury, to be known as the ‘Ski Area Fee Reten-20
5555 tion Account’. 21

5757 EPOSITS.—Subject to paragraphs (4) 22
5858 and (5), a ski area permit rental charge collected by 23
5959 the Secretary under this section shall— 24

9696 ‘‘(B) AGENCY-WIDE DISTRIBUTION OF 1
9797 FUNDS.—The Secretary shall expend 20 percent 2
9898 of the ski area permit rental charges deposited 3
9999 in the Account from a covered unit at any unit 4
100100 of the National Forest System for an activity 5
101101 described in subparagraph (A) or (B) of para-6
102102 graph (5). 7

104104 EDUCTION OF PERCENTAGE .— 8
105105 ‘‘(i) R
106106 EDUCTION.—The Secretary 9
107107 shall reduce the percentage otherwise ap-10
108108 plicable under subparagraph (A)(i) to not 11
109109 less than 60 percent if the Secretary deter-12
110110 mines that the amount otherwise made 13
111111 available under that subparagraph exceeds 14
112112 the reasonable needs of the covered unit 15
113113 for which expenditures may be made in the 16
114114 applicable fiscal year. 17
115115 ‘‘(ii) D
116116 ISTRIBUTION OF FUNDS .—The 18
117117 balance of the ski area permit rental 19
118118 charges that are collected at a covered 20
119119 unit, deposited into the Account, and not 21
120120 distributed in accordance with subpara-22
121121 graph (A) or (B) shall be available to the 23
122122 Secretary for expenditure at any other unit 24

140140 ‘‘(I) the processing of an application 14
141141 for a new ski area or a ski area improve-15
142142 ment project, including staffing and con-16
143143 tracting for the processing; and 17
144144 ‘‘(II) administering a ski area permit 18
145145 described in subsection (a); 19
146146 ‘‘(ii) staff training for— 20
147147 ‘‘(I) the processing of an application 21
148148 for— 22
149149 ‘‘(aa) a new ski area; 23
150150 ‘‘(bb) a ski area improvement 24
151151 project; or 25

160160 ‘‘(iii) an interpretation activity, National 6
161161 Forest System visitor information, a visitor 7
162162 service, or signage; 8
163163 ‘‘(iv) direct costs associated with collecting 9
164164 a ski area permit rental charge or other fee col-10
165165 lected by the Secretary related to recreation; 11
166166 ‘‘(v) planning for, or coordinating to re-12
167167 spond to, a wildfire in or adjacent to a recre-13
168168 ation site, particularly a ski area; or 14
169169 ‘‘(vi) reducing the likelihood of a wildfire 15
170170 starting, or the risks posed by a wildfire, in or 16
171171 adjacent to a recreation site, particularly a ski 17
172172 area, except through hazardous fuels reduction 18
173173 activities; or 19
174174 ‘‘(B)(i) the repair, maintenance, or enhance-20
175175 ment of a Forest Service-owned facility, road, or 21
176176 trail directly related to visitor enjoyment, visitor ac-22
177177 cess, or visitor health or safety; 23
178178 ‘‘(ii) habitat restoration directly related to 24
179179 recreation; 25

189189 ‘‘(vi) avalanche information and education ac-7
190190 tivities carried out by the Secretary or nonprofit 8
191191 partners; 9
192192 ‘‘(vii) search and rescue activities carried out by 10
193193 the Secretary, a local government, or a nonprofit 11
194194 partner; or 12
195195 ‘‘(viii) the administration of leases under— 13
196196 ‘‘(I) the Forest Service Facility Realign-14
197197 ment and Enhancement Act of 2005 (16 U.S.C. 15
198198 580d note; Public Law 109–54); and 16
199199 ‘‘(II) section 8623 of the Agriculture Im-17
200200 provement Act of 2018 (16 U.S.C. 580d note; 18
201201 Public Law 115–334). 19
202202 ‘‘(6) L
203203 IMITATION.—Amounts in the Account 20
204204 may not be used for— 21
205205 ‘‘(A) the conduct of wildfire suppression; 22
206206 or 23
207207 ‘‘(B) the acquisition of land for inclusion 24
208208 in the National Forest System. 25

214214 N GENERAL.—Nothing in this sub-2
215215 section affects the applicability of section 7 of 3
216216 the Act of April 24, 1950 (commonly known as 4
217217 the ‘Granger-Thye Act’) (16 U.S.C. 580d), to 5
218218 ski areas on National Forest System land. 6
219219 ‘‘(B) S
220220 UPPLEMENTAL FUNDING .—Rental 7
221221 charges retained and expended under this sub-8
222222 section shall supplement (and not supplant) ap-9
223223 propriated funding for the operation and main-10
224224 tenance of each covered unit. 11
225225 ‘‘(C) C
226226 OST RECOVERY.—Nothing in this 12
227227 subsection affects any cost recovery under any 13
228228 provision of law (including regulations) for 14
229229 processing an application for or monitoring 15
230230 compliance with a ski area permit or other 16
231231 recreation special use permit.’’. 17

233233 FFECTIVEDATE.—This section (including the 18
234234 amendments made by this section) shall take effect on the 19
235235 date that is 60 days after the date of enactment of this 20
236236 Act. 21
