16	16	To require the Secretary of Veterans Affairs to formally
17	17	recognize caregivers of veterans, notify veterans and
18	18	caregivers of clinical determinations relating to eligibility
19	19	for caregiver programs, and temporarily extend benefits
20	20	for veterans who are determined ineligible for the family
21	21	caregiver program, and for other purposes.
22	22	Be it enacted by the Senate and House of Representa-1
23	23	tives of the United States of America in Congress assembled, 2
24	24	SECTION 1. SHORT TITLE. 3
25	25	This Act may be cited as the ‘‘Transparency and Ef-4
26	26	fective Accountability Measures for Veteran Caregivers 5
27	27	Act’’ or the ‘‘TEAM Veteran Caregivers Act’’. 6

32	32	GIVER PROGRAM OF DEPARTMENT OF VET-2

35	35	FFICIALDESIGNATION OFCAREGIVERS.— 4

37	37	N GENERAL.—The Secretary of Veterans 5
38	38	Affairs shall formally recognize all caregivers of vet-6
39	39	erans by identifying any caregiver of a veteran in 7
40	40	the health record of the veteran. 8
41	41	(2) I
42	42	NCLUSION.—Caregivers recognized under 9
43	43	paragraph (1) shall include— 10
44	44	(A) family caregivers participating in the 11
45	45	program of comprehensive assistance for family 12
46	46	caregivers under subsection (a) of section 13
47	47	1720G of title 38, United States Code; and 14
48	48	(B) caregivers participating in the program 15
49	49	of support services for caregivers under sub-16
50	50	section (b) of such section. 17

54	54	ETERMINATIONS.— 19
55	55	(1) I
56	56	N GENERAL.—The Secretary, using a 20
57	57	standardized letter, shall notify veterans and care-21
58	58	givers of veterans regarding any clinical determina-22
59	59	tions made relating to claims, tier reduction, or ter-23
60	60	mination of assistance under, or eligibility for, a 24
61	61	caregiver program under subsection (a) or (b) of sec-25
62	62	tion 1720G of title 38, United States Code. 26

66	66	(2) ELEMENTS.—Notifications under paragraph 1
67	67	(1) shall include the elements required for notices of 2
68	68	decisions under section 5104(b) of title 38, United 3
69	69	States Code, to the extent that those elements apply 4
70	70	to determinations under paragraph (1). 5

72	72	EMPORARYEXTENSION OFBENEFITS FORFAM-6
73	73	ILYCAREGIVERPROGRAM.— 7
74	74	(1) I
75	75	N GENERAL.—Upon determining that a 8
76	76	veteran who was receiving services under the pro-9
77	77	gram of comprehensive assistance for family care-10
78	78	givers under subsection (a) of section 1720G of title 11
79	79	38, United States Code, is no longer clinically eligi-12
80	80	ble for purposes of such program, the Secretary 13
81	81	shall extend benefits under such program, including 14
82	82	stipends under paragraph (3)(A)(ii)(V) of such sub-15
83	83	section, for not less than 90 days after the date of 16
84	84	notification under subsection (b) that the veteran is 17
85	85	no longer clinically eligible. 18

87	87	XCLUSION.—Paragraph (1) shall not apply 19
88	88	to the termination of caregiver benefits— 20
89	89	(A) if the Secretary determines that the 21
90	90	family caregiver committed fraud or abused or 22
91	91	neglected the veteran; 23
92	92	(B) if the family caregiver was designated 24
93	93	under section 1720G(a)(7) of title 38, United 25

97	97	States Code, as the primary provider of per-1
98	98	sonal care services for the veteran and another 2
99	99	primary provider is designated within 90 days 3
100	100	after the date of termination, in which case 4
101	101	benefits for the terminated primary provider 5
102	102	will terminate the day before the date on which 6
103	103	the new primary provider is designated; 7
104	104	(C) if another individual is designated to 8
105	105	be a family caregiver within 90 days after the 9
106	106	date of termination, such that there are three 10
107	107	family caregivers assigned to the veteran, in 11
108	108	which case benefits for the terminated family 12
109	109	caregiver will terminate the day before the date 13
110	110	on which the new family caregiver is des-14
111	111	ignated; 15
112	112	(D) the terminated individual had been liv-16
113	113	ing with the veteran and moves out, or the ter-17
114	114	minated individual abandons or terminates his 18
115	115	or her relationship with the veteran; or 19
116	116	(E) upon request of the family caregiver or 20
117	117	the veteran. 21
