24	24	Be it enacted by the Senate and House of Representa-1
25	25	tives of the United States of America in Congress assembled, 2
26	26	SECTION 1. SHORT TITLE. 3
27	27	This Act may be cited as the ‘‘No DeepSeek on Gov-4
28	28	ernment Devices Act’’. 5
29	29	SEC. 2. PROHIBITION ON THE USE OF DEEPSEEK. 6

31	31	EFINITIONS.—In this section: 7

35	35	(1) COVERED APPLICATION .—The term ‘‘cov-1
36	36	ered application’’ means the DeepSeek application or 2
37	37	any successor application or service developed or 3
38	38	provided by High Flyer or an entity owned by High 4
39	39	Flyer. 5

41	41	XECUTIVE AGENCY.—The term ‘‘executive 6
42	42	agency’’ has the meaning given that term in section 7
43	43	133 of title 41, United States Code. 8

45	45	NFORMATION TECHNOLOGY .—The term 9
46	46	‘‘information technology’’ has the meaning given 10
47	47	that term in section 11101 of title 40, United States 11
48	48	Code. 12

50	50	ROHIBITION ON THEUSE OFDEEPSEEK.— 13
51	51	(1) I
52	52	N GENERAL.—Not later than 60 days after 14
53	53	the date of the enactment of this Act, the Director 15
54	54	of the Office of Management and Budget, in con-16
55	55	sultation with the Administrator of General Services, 17
56	56	the Director of the Cybersecurity and Infrastructure 18
57	57	Security Agency, the Director of National Intel-19
58	58	ligence, and the Secretary of Defense, and consistent 20
59	59	with the information security requirements under 21
60	60	subchapter II of chapter 35 of title 44, United 22
61	61	States Code, shall develop standards and guidelines 23
62	62	for executive agencies that require the removal of 24
63	63	any covered application from information technology. 25

67	67	(2) NATIONAL SECURITY AND RESEARCH EX -1
68	68	CEPTIONS.—The standards and guidelines developed 2
69	69	under paragraph (1) shall include— 3
70	70	(A) exceptions for law enforcement activi-4
71	71	ties, national security interests and activities, 5
72	72	and security researchers; and 6
73	73	(B) for any authorized use of a covered ap-7
74	74	plication under an exception, requirements for 8
75	75	agencies to develop and document risk mitiga-9
76	76	tion actions for such use. 10
