19	19	To remove the discretionary inflater from the baseline and
20	20	to provide that the salaries of Members of a House
21	21	of Congress will be held in escrow if that House has
22	22	not agreed to a concurrent resolution on the budget
23	23	for fiscal year 2026, and for other purposes.
24	24	Be it enacted by the Senate and House of Representa-1
25	25	tives of the United States of America in Congress assembled, 2
26	26	SECTION 1. SHORT TITLE. 3
27	27	This Act may be cited as the ‘‘Budget Process En-4
28	28	hancement Act’’. 5

35	35	Section 257(c) of the Balanced Budget and Emer-4
36	36	gency Deficit Control Act of 1985 is amended— 5
37	37	(1) in the second sentence of paragraph (1), by 6
38	38	striking everything that follows ‘‘current year,’’ and 7
39	39	inserting ‘‘excluding resources designated as an 8
40	40	emergency requirement and any resources provided 9
41	41	in supplemental appropriation laws.’’; 10
42	42	(2) by striking paragraphs (2), (3), (4), and 11
43	43	(5); 12
44	44	(3) by redesignating paragraph (6) as para-13
45	45	graph (2); and 14
46	46	(4) by inserting after paragraph (2) the fol-15
47	47	lowing new paragraph: 16
48	48	‘‘(3) N
49	49	O ADJUSTMENT FOR INFLATION .—No 17
50	50	adjustment shall be made for inflation or for any 18

62	62	OLDINGSALARIES INESCROW.— 7
63	63	(1) I
64	64	N GENERAL.—If by April 15, 2025, a 8
65	65	House of Congress has not agreed to a concurrent 9
66	66	resolution on the budget for fiscal year 2026 pursu-10
67	67	ant to section 301 of the Congressional Budget Act 11
68	68	of 1974, during the period described in paragraph 12
69	69	(2) the payroll administrator of that House of Con-13
70	70	gress shall deposit in an escrow account all pay-14
71	71	ments otherwise required to be made during such 15
72	72	period for the compensation of Members of Congress 16
73	73	who serve in that House of Congress, and shall re-17
74	74	lease such payments to such Members only upon the 18
75	75	expiration of such period. 19

77	77	ERIOD DESCRIBED.—With respect to a 20
78	78	House of Congress, the period described in this 21
79	79	paragraph is the period which begins on April 16, 22
80	80	2025, and ends on the earlier of— 23
81	81	(A) the day on which the House of Con-24
82	82	gress agrees to a concurrent resolution on the 25

87	87	301 of the Congressional Budget Act of 1974; 2

89	89	(B) the last day of the One Hundred 4
90	90	Eighteenth Congress. 5

92	92	ITHHOLDING AND REMITTANCE OF 6
93	93	AMOUNTS FROM PAYMENTS HELD IN ESCROW .—The 7
94	94	payroll administrator shall provide for the same 8
95	95	withholding and remittance with respect to a pay-9
96	96	ment deposited in an escrow account under para-10
97	97	graph (1) that would apply to the payment if the 11
98	98	payment were not subject to paragraph (1). 12

100	100	ELEASE OF AMOUNTS AT END OF THE 13
101	101	CONGRESS.—In order to ensure that this section is 14
102	102	carried out in a manner that shall not vary the com-15
103	103	pensation of Senators or Representatives in violation 16
104	104	of the twenty-seventh article of amendment to the 17
105	105	Constitution of the United States, the payroll ad-18
106	106	ministrator of a House of Congress shall release for 19
107	107	payments to Members of that House of Congress 20
108	108	any amounts remaining in any escrow account under 21
109	109	this section on the last day of the One Hundred 22
110	110	Eighteenth Congress. 23

112	112	OLE OF SECRETARY OF THE TREASURY .— 24
113	113	The Secretary of the Treasury shall provide the pay-25

118	118	such assistance as may be necessary to enable the 2
119	119	payroll administrators to carry out this section. 3

121	121	REATMENT OF DELEGATES ASMEMBERS.—In 4
122	122	this section, the term ‘‘Member of Congress’’ includes a 5
123	123	Delegate or Resident Commissioner to the Congress. 6

125	125	AYROLLADMINISTRATOR DEFINED.—In this 7
126	126	section, the term ‘‘payroll administrator’’ of a House of 8
127	127	Congress means— 9
128	128	(1) in the case of the House of Representatives, 10
129	129	the Chief Administrative Officer of the House of 11
130	130	Representatives, or an employee of the Office of the 12
131	131	Chief Administrative Officer who is designated by 13
132	132	the Chief Administrative Officer to carry out this 14
133	133	section; and 15
134	134	(2) in the case of the Senate, the Secretary of 16
135	135	the Senate, or an employee of the Office of the Sec-17
136	136	retary of the Senate who is designated by the Sec-18
137	137	retary to carry out this section. 19
138	138	SEC. 202. DETERMINATION OF COMPLIANCE WITH STATU-20
139	139	TORY REQUIREMENT TO SUBMIT THE PRESI-21
140	140	DENT’S BUDGET. 22
141	141	Not later than 3 days after the President’s budget 23
142	142	is due, the Inspector General of the Office of Personnel 24
143	143	Management shall— 25

153	153	Budget and the Committee on Appropriations of the 7
154	154	Senate and the Chairs of the Committee on the 8
155	155	Budget and the Committee on Appropriations of the 9
156	156	House of Representatives. 10
157	157	SEC. 203. NO PAY UPON FAILURE TO TIMELY SUBMIT THE 11
158	158	PRESIDENT’S BUDGET TO CONGRESS. 12
159	159	(a) I
160	160	NGENERAL.—Notwithstanding any other provi-13
161	161	sion of law, no funds may be appropriated or otherwise 14
162	162	be made available from the United States Treasury for 15
163	163	the pay of the Director of the Office of Management and 16
164	164	Budget, the Deputy Director of the Office, or the Deputy 17
165	165	Director for Management of the Office during any period 18
166	166	of noncompliance determined by the Inspector General of 19
167	167	the Office of Personnel Management under section 202. 20

169	169	ORETROACTIVEPAY.—The Director of the Of-21
170	170	fice of Management and Budget, the Deputy Director of 22
171	171	the Office, and the Deputy Director for Management of 23
172	172	the Office may not receive pay for any period of non-24
173	173	compliance determined by the Inspector General of the Of-25
