30 | 30 | | NGENERAL.—With respect to newly constructed 4 |
---|
31 | 31 | | foreign cranes procured for use at a United States port 5 |
---|
32 | 32 | | determined by the Secretary to be of high risk to port se-6 |
---|
33 | 33 | | curity or maritime transportation security and that con-7 |
---|
34 | 34 | | nect to the internet, the Secretary of Homeland Security 8 |
---|
35 | 35 | | shall, acting through the Cybersecurity and Infrastructure 9 |
---|
36 | 36 | | Security Agency, before such crane is placed into service 10 |
---|
37 | 37 | | at such port, inspect such crane for potential security risks 11 |
---|
38 | 38 | | or threats. 12 |

40 | 40 | | ECURITYRISKS ORTHREATSASSESSMENTS.— 13 |
---|
41 | 41 | | Not later than 180 days after the date of enactment of 14 |
---|
42 | 42 | | this Act, the Secretary shall— 15 |
---|
43 | 43 | | (1) assess the threat posed by security risks or 16 |
---|
44 | 44 | | threats of any existing or newly constructed foreign 17 |
---|
45 | 45 | | cranes in use at a United States port; and 18 |
---|
46 | 46 | | (2) take any crane that poses a security risk or 19 |
---|
47 | 47 | | threat offline until such crane can be certified as no 20 |
---|
48 | 48 | | longer being a risk or threat. 21 |

50 | 50 | | EPORT TOCONGRESS.—Not later than 1 year 22 |

51 | 51 | | after the date of enactment of this Act, the Secretary shall 23 |

52 | 52 | | brief the Committee on Homeland Security of the House 24 |

53 | 53 | | of Representatives and the Committee on Homeland Secu-25 |
---|
54 | 54 | | rity and Governmental Affairs of the Senate regarding for-26 |

67 | 67 | | fied as a foreign adversary in its most recent 8 |
---|
68 | 68 | | Annual Threat Assessment; or 9 |
---|
69 | 69 | | (B) the Secretary of Homeland Security, 10 |
---|
70 | 70 | | in coordination with the Director of National 11 |
---|
71 | 71 | | Intelligence, has identified as a foreign adver-12 |
---|
72 | 72 | | sary that is not included in such Annual Threat 13 |

79 | 79 | | ture at a port located in the United States was, in 19 |

80 | 80 | | whole or in part, manufactured by an entity that is 20 |
---|
81 | 81 | | operating under ownership, control, or influence of a 21 |
---|
82 | 82 | | covered foreign country. 22 |
