15	15	Be it enacted by the Senate and House of Representa-1
16	16	tives of the United States of America in Congress assembled, 2
17	17	SECTION 1. SHORT TITLE. 3
18	18	This Act may be cited as the ‘‘Keep China Out of 4
19	19	Solar Energy Act of 2025’’. 5
20	20	SEC. 2. PROHIBITION ON PROCUREMENT OF SOLAR PAN-6
21	21	ELS FROM COVERED FOREIGN ENTITIES. 7
22	22	(a) I
23	23	NGENERAL.—Not later than 180 days after the 8
24	24	date of the enactment of this Act, the Director of the Of-9
25	25	fice of Management and Budget, in consultation with the 10

29	29	Administrator of General Services, shall develop standards 1
30	30	and guidelines for executive agencies to— 2
31	31	(1) prohibit Federal funds from being awarded 3
32	32	by contract, subcontract, grant, or subgrant for the 4
33	33	procurement of solar panels that are manufactured 5
34	34	or assembled by a covered entity; and 6
35	35	(2) prohibit the use of Government-issued pur-7
36	36	chase cards to purchase solar panels that are manu-8
37	37	factured or assembled by a covered entity. 9
38	38	(b) A
39	39	MENDMENT OF FEDERALACQUISITIONREGU-10
40	40	LATION.—Not later than 180 days after the date of the 11
41	41	enactment of this Act, the Federal Acquisition Regulatory 12
42	42	Council shall amend the Federal Acquisition Regulation 13
43	43	to implement the prohibition established pursuant to sub-14
44	44	section (a)(1) with respect to Federal contracts and sub-15
45	45	contracts. 16
46	46	SEC. 3. EXEMPTION WAIVER. 17
47	47	(a) I
48	48	NGENERAL.—The head of an executive agency 18
49	49	may obtain a waiver from the prohibition implemented 19
50	50	pursuant to section 2 if the agency head certifies to the 20
51	51	Secretary of State and the Secretary of Homeland Secu-21
52	52	rity that the covered entity is the only viable source for 22
53	53	the solar panels and the Secretary of State and the Sec-23
54	54	retary of Homeland Security jointly approve the waiver 24
55	55	request. 25

59	59	(b) NOTIFICATIONREQUIREMENTS.— 1

61	61	N GENERAL.—The head of an agency re-2
62	62	questing a waiver under this section shall notify the 3
63	63	Director of the Office of Management and Budget of 4
64	64	the request. The Director of the Office of Manage-5
65	65	ment and Budget shall submit to the appropriate 6
66	66	congressional committees a quarterly report listing 7
67	67	requests listing under subsection (a), including 8
68	68	whether each such request was approved or rejected. 9

70	70	PPROPRIATE CONGRESSIONAL COMMIT -10
71	71	TEES.—In this subsection, the term ‘‘appropriate 11
72	72	congressional committees’’ means— 12
73	73	(A) the Committee on Foreign Relations 13
74	74	and the Committee on Homeland Security and 14
75	75	Governmental Affairs of the Senate; and 15
76	76	(B) the Committee on Foreign Affairs, the 16
77	77	Committee on Homeland Security, and the 17
78	78	Committee on Oversight and Government Re-18
79	79	form of the House of Representatives. 19
80	80	SEC. 4. COMPTROLLER GENERAL REPORT. 20
81	81	Not later than 275 days after the date of the enact-21
82	82	ment of this Act, the Comptroller General of the United 22
83	83	States shall submit to Congress a report on the amount 23
84	84	of solar panels procured by Federal departments and 24
85	85	agencies from covered entities. 25

91	91	NDEPENDENT STUDY.—Not later than one year 2
92	92	after the date of the enactment of this Act, the Director 3
93	93	of the Office of Management and Budget shall seek to 4
94	94	enter into a contract with a federally funded research and 5
95	95	development center under which the center will conduct 6
96	96	a study of— 7
97	97	(1) the current and future domestic market of 8
98	98	solar panel production; 9
99	99	(2) the ability of the solar panel domestic mar-10
100	100	ket to keep pace with technological advancements 11
101	101	across the industry; and 12
102	102	(3) the current global supply chain and work-13
103	103	force involved with solar panel production. 14

105	105	UBMISSION TOCONGRESS.—Not later than 30 15
106	106	days after the date on which the Director of the Office 16
107	107	of Management and Budget receives the study under sub-17
108	108	section (b), the Director shall submit the study to— 18
109	109	(1) the Committee on Homeland Security and 19
110	110	Governmental Affairs and the Committee on Energy 20
111	111	and Natural Resources of the Senate; and 21
112	112	(2) the Committee on Homeland Security, the 22
113	113	Committee on Oversight and Government Reform, 23
114	114	and the Committee on Energy and Commerce of the 24
115	115	House of Representatives. 25

123	123	tity’’ means any entity domiciled in the People’s Re-4
124	124	public of China or subject to influence or control by 5
125	125	the Government of the People Republic of China or 6
126	126	the Communist Party of the People’s Republic of 7
127	127	China, as determined by the Secretary of Homeland 8

130	130	XECUTIVE AGENCY.—The term ‘‘executive 10
