1717 SECTION 1. SHORT TITLE. 3
1818 This Act may be cited as the ‘‘Keep China Out of 4
1919 Solar Energy Act of 2025’’. 5
2020 SEC. 2. PROHIBITION ON PROCUREMENT OF SOLAR PAN-6

2323 NGENERAL.—Not later than 180 days after the 8
2424 date of the enactment of this Act, the Director of the Of-9

2929 Administrator of General Services, shall develop standards 1
3030 and guidelines for executive agencies to— 2
3131 (1) prohibit Federal funds from being awarded 3
3232 by contract, subcontract, grant, or subgrant for the 4
3333 procurement of solar panels that are manufactured 5
3434 or assembled by a covered entity; and 6
3535 (2) prohibit the use of Government-issued pur-7
3636 chase cards to purchase solar panels that are manu-8
3737 factured or assembled by a covered entity. 9

3939 MENDMENT OF FEDERALACQUISITIONREGU-10
4040 LATION.—Not later than 180 days after the date of the 11
4141 enactment of this Act, the Federal Acquisition Regulatory 12
4242 Council shall amend the Federal Acquisition Regulation 13
4343 to implement the prohibition established pursuant to sub-14
4444 section (a)(1) with respect to Federal contracts and sub-15
4545 contracts. 16
4646 SEC. 3. EXEMPTION WAIVER. 17
4747 (a) I
4848 NGENERAL.—The head of an executive agency 18
4949 may obtain a waiver from the prohibition implemented 19
5050 pursuant to section 2 if the agency head certifies to the 20
5151 Secretary of State and the Secretary of Homeland Secu-21
5252 rity that the covered entity is the only viable source for 22
5353 the solar panels and the Secretary of State and the Sec-23
5454 retary of Homeland Security jointly approve the waiver 24
5555 request. 25

6161 N GENERAL.—The head of an agency re-2
6262 questing a waiver under this section shall notify the 3
6363 Director of the Office of Management and Budget of 4
6464 the request. The Director of the Office of Manage-5
6565 ment and Budget shall submit to the appropriate 6
6666 congressional committees a quarterly report listing 7
6767 requests listing under subsection (a), including 8
6868 whether each such request was approved or rejected. 9

7171 TEES.—In this subsection, the term ‘‘appropriate 11
7272 congressional committees’’ means— 12
7373 (A) the Committee on Foreign Relations 13
7474 and the Committee on Homeland Security and 14
7575 Governmental Affairs of the Senate; and 15
7676 (B) the Committee on Foreign Affairs, the 16
7777 Committee on Homeland Security, and the 17
7878 Committee on Oversight and Government Re-18

8080 SEC. 4. COMPTROLLER GENERAL REPORT. 20
8181 Not later than 275 days after the date of the enact-21
8282 ment of this Act, the Comptroller General of the United 22
8383 States shall submit to Congress a report on the amount 23
8484 of solar panels procured by Federal departments and 24
8585 agencies from covered entities. 25

9191 NDEPENDENT STUDY.—Not later than one year 2
9292 after the date of the enactment of this Act, the Director 3
9393 of the Office of Management and Budget shall seek to 4
9494 enter into a contract with a federally funded research and 5
9595 development center under which the center will conduct 6
9696 a study of— 7
9797 (1) the current and future domestic market of 8
9898 solar panel production; 9
9999 (2) the ability of the solar panel domestic mar-10
100100 ket to keep pace with technological advancements 11
101101 across the industry; and 12
102102 (3) the current global supply chain and work-13
103103 force involved with solar panel production. 14

105105 UBMISSION TOCONGRESS.—Not later than 30 15
106106 days after the date on which the Director of the Office 16
107107 of Management and Budget receives the study under sub-17
108108 section (b), the Director shall submit the study to— 18
109109 (1) the Committee on Homeland Security and 19
110110 Governmental Affairs and the Committee on Energy 20
111111 and Natural Resources of the Senate; and 21
112112 (2) the Committee on Homeland Security, the 22
113113 Committee on Oversight and Government Reform, 23
114114 and the Committee on Energy and Commerce of the 24
115115 House of Representatives. 25

123123 tity’’ means any entity domiciled in the People’s Re-4
124124 public of China or subject to influence or control by 5
125125 the Government of the People Republic of China or 6

127127 China, as determined by the Secretary of Homeland 8

130130 XECUTIVE AGENCY.—The term ‘‘executive 10
131131 agency’’ has the meaning given the term in section 11

135135 means crystalline silicon photovoltaic (PV) cells and 14
