19	19	To amend title XVIII of the Social Security Act to include
20	20	physical therapists and occupational therapists as health
21	21	professionals for purposes of the annual wellness visit
22	22	under the Medicare program, and for other purposes.
23	23	Be it enacted by the Senate and House of Representa-1
24	24	tives of the United States of America in Congress assembled, 2
25	25	SECTION 1. SHORT TITLE. 3
26	26	This Act may be cited as the ‘‘Stopping Addiction 4
27	27	and Falls for the Elderly Act’’ or the ‘‘SAFE Act’’. 5

36	36	NNUALWELLNESSVISIT.— 5

38	38	N GENERAL.—Section 1861(hhh) of the 6
39	39	Social Security Act (42 U.S.C. 1395x(hhh)) is 7
40	40	amended— 8
41	41	(A) in paragraph (1)— 9
42	42	(i) in subparagraph (A), by striking ‘‘; 10
43	43	and’’ and inserting a semicolon; 11
44	44	(ii) in subparagraph (B)(ii), by strik-12
45	45	ing the period at the end and inserting ‘‘; 13
46	46	and’’; and 14
47	47	(iii) by adding at the end the fol-15
48	48	lowing new subparagraph: 16
49	49	‘‘(C) that, in the case of an individual who has 17
50	50	been determined by a physician to have fallen in the 18
51	51	previous calendar year, includes a falls risk assess-19
52	52	ment and fall prevention services.’’; and 20
53	53	(B) in paragraph (3)— 21
54	54	(i) in subparagraph (B), by striking 22
55	55	‘‘or’’ at the end; 23
56	56	(ii) in subparagraph (C), by striking 24
57	57	the period at the end and inserting ‘‘; or’’; 25

64	64	‘‘(D) in the case of an individual described in 3
65	65	paragraph (1)(C), a physical therapist or an occupa-4
66	66	tional therapist furnishing a separate falls risk as-5
67	67	sessment and fall prevention services.’’. 6

69	69	FFECTIVE DATE.—The amendment made 7
70	70	by paragraph (1) shall apply to annual wellness vis-8
71	71	its furnished on or after January 1, 2026. 9

76	76	N GENERAL.—Section 1861(ww)(2) of the 12
77	77	Social Security Act (42 U.S.C. 1395x(ww)(2)) is 13

79	79	(A) in subparagraph (N), by moving the 15
80	80	margins of such subparagraph 2 ems to the 16
81	81	left; 17
82	82	(B) by redesignating subparagraph (O) as 18
83	83	subparagraph (P); and 19
84	84	(C) by inserting after subparagraph (N) 20
85	85	the following new subparagraph: 21
86	86	‘‘(O) In the case of an individual that has been 22
87	87	determined by a physician to have experienced a fall 23
88	88	in the previous calendar year, outpatient occupa-24
89	89	tional therapy services (as defined in subsection (g)) 25

94	94	in subsection (p)).’’. 2

96	96	FFECTIVE DATE.—The amendment made 3
97	97	by paragraph (1) shall apply to initial preventive 4
98	98	physical examinations furnished on or after January 5
99	99	1, 2026. 6
100	100	SEC. 3. REPORTS TO CONGRESS. 7
101	101	Beginning January 1, 2027, and annually thereafter, 8
102	102	the Secretary of Health and Human Services shall submit 9
103	103	to Congress a report on the number of falls (as reported 10
104	104	by the Centers for Disease Control and Prevention) experi-11
105	105	enced by individuals aged 65 and older that received treat-12
106	106	ment for pain or injury related to a fall or falls experi-13
107	107	enced in the previous calendar year. With respect to each 14
108	108	subsequent report, such Secretary shall include the data 15
109	109	reported in previous years and describe any changes from 16
110	110	year to year. 17
