3131 Title I of the Omnibus Crime Control and Safe 3
3232 Streets Act of 1968 (34 U.S.C. 10101 et seq.) is amended 4
3333 by adding at the end the following: 5
3434 ‘‘PART MM—MATCHING GRANT PROGRAM FOR 6
3535 LAW ENFORCEMENT BODY-WORN CAMERAS 7
3636 AND RECORDED DATA 8
3737 ‘‘SEC. 3031. GRANT PROGRAM AUTHORIZED. 9
3838 ‘‘(a) I
3939 NGENERAL.—The Director of the Bureau of 10
4040 Justice Assistance (in this section referred to as the ‘Di-11
4141 rector’) may make grants to States, units of local govern-12
4242 ment, and Indian Tribes to purchase or lease body-worn 13
4343 cameras for use by State, local, and Tribal law enforce-14
4444 ment officers (as defined in section 2503) and expenses 15
4545 related to the implementation of a body-worn camera pro-16
4646 gram in order to deter excessive force, improve account-17
4747 ability and transparency of use of force by law enforce-18
4848 ment officers, assist in responding to complaints against 19
4949 law enforcement officers, and improve evidence collection. 20

5151 URATION OFGRANTS.— 21
5252 ‘‘(1) I
5353 N GENERAL.—Grants awarded under this 22
5454 part shall be 2 years in duration. 23

5656 ISBURSEMENT OF GRANT AMOUNT .—In 24
5757 disbursing a grant awarded to an entity under this 25

6363 ty, the Director shall disburse 50 percent of the 2
6464 total grant amount to the entity; and 3
6565 ‘‘(B) upon demonstration by the entity of 4
6666 completion of the requirements in subsection 5
6767 (d)(1), the Director shall disburse the remain-6
6868 ing 50 percent of the total grant amount to the 7
6969 entity. 8
7070 ‘‘(c) U
7171 SE OFFUNDS.—Grants awarded under this 9
7272 section shall be— 10
7373 ‘‘(1) distributed directly to the State, unit of 11
7474 local government, or Indian Tribe; and 12
7575 ‘‘(2) used for— 13
7676 ‘‘(A) the purchase or lease of body-worn 14
7777 cameras for law enforcement officers on patrol 15
7878 in the jurisdiction of the grantee; 16
7979 ‘‘(B) any costs relating to the implementa-17
8080 tion of a body-worn camera program, including 18
8181 law enforcement officer training or the storage, 19
8282 maintenance, or security of recorded data col-20
8383 lected under a body-worn camera program; or 21
8484 ‘‘(C) implementing policies or procedures 22
8585 to comply with the requirements described in 23
8686 subsection (d). 24

9292 ‘‘(1) IN GENERAL.—The Director shall award a 1
9393 grant under this section to a State, unit of local gov-2
9494 ernment, or Indian Tribe requesting the grant that 3
9595 commits to— 4
9696 ‘‘(A) establishing policies and procedures 5
9797 in accordance with the requirements described 6
9898 in paragraph (2) before law enforcement offi-7
9999 cers use of body-worn cameras; 8
100100 ‘‘(B) adopting recorded data collection and 9
101101 retention protocols as described in paragraph 10
102102 (3) before law enforcement officers use of body- 11
103103 worn cameras; 12
104104 ‘‘(C) making the policies and protocols de-13
105105 scribed in subparagraphs (A) and (B) available 14
106106 to the public; and 15
107107 ‘‘(D) complying with the requirements for 16
108108 use of recorded data under paragraph (5). 17

110110 EQUIRED POLICIES AND PROCEDURES .— 18
111111 An entity receiving a grant under this section 19
112112 shall— 20
113113 ‘‘(A) develop with community input and 21
114114 publish for public view policies and protocols 22
115115 for— 23
116116 ‘‘(i) the safe and effective use of body- 24
117117 worn cameras; 25

127127 ‘‘(iv) protecting the constitutional 7
128128 rights of any individual on whom facial 8
129129 recognition technology is used; 9
130130 ‘‘(v) limitations on the use of body- 10
131131 worn cameras in conjunction with facial 11
132132 recognition technology for instances, in-12
133133 cluding— 13
134134 ‘‘(I) the use of facial recognition 14
135135 technology only with judicial author-15
136136 ization; 16
137137 ‘‘(II) the use of facial recognition 17
138138 technology only for imminent threats 18
139139 or serious crimes; and 19
140140 ‘‘(III) the use of facial recogni-20
141141 tion technology with double 21
142142 verification of identified faces; 22
143143 ‘‘(vi) the release of any recorded data 23
144144 collected by a body-worn camera in accord-24

150150 ‘‘(vii) making recorded data available 3
151151 to prosecutors, defense attorneys, and 4
152152 other officers of the court in accordance 5
153153 with paragraph (5); and 6
154154 ‘‘(B) conduct periodic evaluations of the 7
155155 security of the storage and handling of the 8
156156 body-worn camera data. 9

158158 ECORDED DATA COLLECTION AND RE -10
159159 TENTION PROTOCOL .—The recorded data collection 11
160160 and retention protocol described in this paragraph is 12
161161 a protocol that— 13
162162 ‘‘(A) requires— 14
163163 ‘‘(i) a law enforcement officer who is 15
164164 wearing a body-mounted camera to provide 16
165165 an explanation if an activity that is re-17
166166 quired to be recorded by the body-mounted 18
167167 camera is not recorded; 19
168168 ‘‘(ii) a law enforcement officer who is 20
169169 wearing a body-mounted camera to obtain 21
170170 consent to be recorded from a crime victim 22
171171 or witness before interviewing the victim or 23
172172 witness; 24

177177 unrelated to a legitimate law enforcement 2
178178 purpose be minimized to the greatest ex-3
179179 tent practicable; 4
180180 ‘‘(iv) the system used to store re-5
181181 corded data collected by body-worn cam-6
182182 eras shall log all viewing, modification, or 7
183183 deletion of stored recorded data and shall 8
184184 prevent, to the greatest extent practicable, 9
185185 the unauthorized access or disclosure of 10
186186 stored recorded data; 11
187187 ‘‘(v) any law enforcement officer be 12
188188 prohibited from accessing the stored data 13
189189 without an authorized purpose; and 14
190190 ‘‘(vi) the law enforcement agency to 15
191191 collect and report statistical data on— 16
192192 ‘‘(I) incidences of use of force, 17
193193 disaggregated by race, ethnicity, gen-18
194194 der, and age of the victim; 19
195195 ‘‘(II) the number of complaints 20
196196 filed against law enforcement officers; 21
197197 ‘‘(III) the disposition of com-22
198198 plaints filed against law enforcement 23
199199 officers; 24

204204 era footage is used for evidence collec-2
205205 tion in investigations of crimes; and 3
206206 ‘‘(V) any other additional statis-4
207207 tical data that the Director deter-5
208208 mines should be collected and re-6
209209 ported; 7
210210 ‘‘(B) allows an individual to file a com-8
211211 plaint with a law enforcement agency relating 9
212212 to the improper use of body-worn cameras; and 10
213213 ‘‘(C) complies with any other requirements 11
214214 established by the Director. 12
215215 ‘‘(4) R
216216 EPORTING.—Statistical data required to 13
217217 be collected under paragraph (3)(A)(vi) shall be re-14
218218 ported to the Director, who shall— 15
219219 ‘‘(A) establish a standardized reporting 16
220220 system for statistical data collected under this 17
221221 program; and 18
222222 ‘‘(B) establish a national database of sta-19
223223 tistical data recorded under this program. 20

225225 SE OR TRANSFER OF RECORDED DATA .— 21
226226 ‘‘(A) I
227227 N GENERAL.—Recorded data col-22
228228 lected by an entity receiving a grant under this 23
229229 section from a body-mounted camera shall be 24
230230 used only in internal and external investigations 25

235235 officer, if there is reasonable suspicion that a 2
236236 recording contains evidence of a crime, or for 3
237237 limited training purposes. The Director shall es-4
238238 tablish rules to ensure that the recorded data is 5
239239 used only for the purposes described in this 6
240240 subparagraph. 7
241241 ‘‘(B) P
242242 ROHIBITION ON TRANSFER .—Ex-8
243243 cept as provided in subparagraph (C), an entity 9
244244 receiving a grant under this section may not 10
245245 transfer any recorded data collected by the enti-11
246246 ty from a body-mounted camera to another law 12
247247 enforcement or intelligence agency. 13
248248 ‘‘(C) E
249249 XCEPTIONS.— 14
250250 ‘‘(i) C
251251 RIMINAL INVESTIGATION .—An 15
252252 entity receiving a grant under this section 16
253253 may transfer recorded data collected by the 17
254254 entity from a body-mounted camera to an-18
255255 other law enforcement agency or intel-19
256256 ligence agency for use in a criminal inves-20
257257 tigation if the requesting law enforcement 21
258258 or intelligence agency has reasonable sus-22
259259 picion that the requested data contains evi-23
260260 dence relating to the crime being inves-24
261261 tigated. 25

266266 ty receiving a grant under this section may 2
267267 transfer recorded data collected by the law 3
268268 enforcement agency from a body-mounted 4
269269 camera to another law enforcement agency 5
270270 for use in an investigation of any right, 6
271271 privilege, or immunity secured or protected 7
272272 by the Constitution or laws of the United 8
273273 States. 9
274274 ‘‘(e) M
275275 ATCHINGFUNDS.— 10
276276 ‘‘(1) I
277277 N GENERAL.—Except as provided in para-11
278278 graph (3), the Federal share of the cost of a pro-12
279279 gram carried out using a grant under this part may 13
280280 not exceed 75 percent of the total cost of the pro-14
281281 gram. 15
282282 ‘‘(2) I
283283 NDIAN ASSISTANCE.—Any funds appro-16
284284 priated by Congress for the activities of any agency 17
285285 of an Indian Tribal government or the Bureau of In-18
286286 dian Affairs performing law enforcement functions 19
287287 on any Indian lands may be used to provide the non- 20
288288 Federal share of the matching requirement described 21
289289 in paragraph (1). 22
290290 ‘‘(3) W
291291 AIVER.—The Director may waive, in 23
292292 whole or in part, the matching requirement de-24

301301 of Justice Assistance, $30,000,000 shall be used to carry 5
302302 out this part. 6

304304 UDIT ANDASSESSMENT.— 7
305305 ‘‘(1) I
306306 N GENERAL.—Not later than 2 years 8
307307 after the date of enactment of this part, the Director 9
308308 of the Office of Audit, Assessment, and Management 10
309309 shall perform an assessment of the grant program 11
310310 and the policies and protocols of the grantees. 12
311311 ‘‘(2) R
312312 EPORTS.—Not later than September 1 of 13
313313 each year, beginning 2 years after the date of enact-14
314314 ment of this part, each recipient of a grant under 15
315315 this part shall submit to the Director of the Office 16
316316 of Audit, Assessment, and Management a report 17
317317 that— 18
318318 ‘‘(A) describes the progress of the body- 19
319319 worn camera program; and 20
320320 ‘‘(B) contains recommendations on ways in 21
321321 which the Federal Government, States, and 22
322322 units of local government can further support 23
323323 the implementation of the program. 24

327327 ‘‘(3) REVIEW.—The Director of the Office of 1
328328 Audit, Assessment, and Management shall evaluate 2
329329 the policies and protocols of the grantees and take 3
330330 such steps as the Director of the Office of Audit, As-4
331331 sessment, and Management determines necessary to 5
332332 ensure compliance with the program. 6
333333 ‘‘SEC. 3032. BODY-WORN CAMERA TRAINING TOOLKIT. 7
334334 ‘‘(a) I
335335 NGENERAL.—The Director shall establish and 8
336336 maintain a toolkit for law enforcement agencies, academia, 9
337337 and other relevant entities to provide training and tech-10
338338 nical assistance, including best practices for implementa-11
339339 tion, model policies and procedures, and research mate-12
340340 rials. 13
341341 ‘‘(b) M
342342 ECHANISM.—In establishing the toolkit re-14
343343 quired to under subsection (a), the Director may consoli-15
344344 date research, practices, templates, and tools that been de-16
345345 veloped by expert and law enforcement agencies across the 17
346346 country. 18
347347 ‘‘SEC. 3033. APPLICATIONS. 19
348348 ‘‘(a) I
349349 NGENERAL.—To request a grant under this 20
350350 part, the chief executive of a State, unit of local govern-21
351351 ment, or Indian Tribe shall submit an application to the 22
352352 Director in a form and containing information as the Di-23
353353 rector may reasonably require. 24

358358 the date of the enactment of this part, the Director shall 2
359359 promulgate regulations to implement this part, including 3
360360 the information that shall be included and the require-4
361361 ments that the States, units of local government, and In-5
362362 dian Tribes must meet in submitting the applications re-6
363363 quired under this section. 7
364364 ‘‘SEC. 3034. STUDY. 8
365365 ‘‘(a) I
366366 NGENERAL.—Not later than 2 years after the 9
367367 date on which all grants are awarded under this part, the 10
368368 Director shall conduct a study on— 11
369369 ‘‘(1) the efficacy of body-worn cameras in deter-12
370370 ring excessive force by law enforcement officers; 13
371371 ‘‘(2) the impact of body-worn cameras on the 14
372372 accountability and transparency of the use of force 15
373373 by law enforcement officers; 16
374374 ‘‘(3) the impact of body-worn cameras on re-17
375375 sponses to and adjudications of complaints of exces-18
376376 sive force; 19
377377 ‘‘(4) the effect of the use of body-worn cameras 20
378378 on the safety of law enforcement officers on patrol; 21
379379 ‘‘(5) the effect of the use of body-worn cameras 22
380380 on public safety; 23
381381 ‘‘(6) the impact of body-worn cameras on evi-24
382382 dence collection for criminal investigations; 25

389389 ‘‘(8) issues relating to the privacy of citizens 4
390390 and officers recorded on body-worn cameras; 5
391391 ‘‘(9) issues relating to the constitutional rights 6
392392 of individuals on whom facial recognition technology 7
393393 is used; 8
394394 ‘‘(10) issues relating to limitations on the use 9
395395 of facial recognition technology; 10
396396 ‘‘(11) issues relating to the public’s access to 11
397397 body-worn camera footage; 12
398398 ‘‘(12) the need for proper training of law en-13
399399 forcement officers that use body-worn cameras; 14
400400 ‘‘(13) best practices in the development of pro-15
401401 tocols for the safe and effective use of body-worn 16
402402 cameras; 17
403403 ‘‘(14) a review of law enforcement agencies that 18
404404 found body-worn cameras to be unhelpful in the op-19
405405 erations of the agencies; and 20
406406 ‘‘(15) any other factors that the Director deter-21
407407 mines are relevant in evaluating the efficacy of body- 22
408408 worn cameras. 23
409409 ‘‘(b) R
410410 EPORT.—Not later than 180 days after the 24
411411 date on which the study required under subsection (a) is 25
