To amend the Omnibus Crime Control and Safe Streets 
Act of 1968 to include certain retired law enforcement 
officers in the public safety officers’ death benefits pro-
gram. 
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Chief Herbert D. 4
Proffitt Act of 2025’’. 5

SEC. 2. INCLUSION OF CERTAIN RETIRED PUBLIC SAFETY 1
OFFICERS IN THE PUBLIC SAFETY OFFICERS’ 2
DEATH BENEFITS PROGRAM. 3
(a) I
NGENERAL.—Section 1201 of the Omnibus 4
Crime Control and Safe Streets Act of 1968 (34 U.S.C. 5
10281) is amended by adding at the end the following: 6
‘‘(p) P
ERSONALINJURY TORETIREDLAWENFORCE-7
MENTOFFICER.— 8
‘‘(1) I
N GENERAL.—A retired law enforcement 9
officer shall be eligible for a benefit under this part 10
if the officer died or become permanently and totally 11
disabled as the direct and proximate result of a per-12
sonal injury resulting from a targeted attack be-13
cause of the retired law enforcement officer’s service 14
as a law enforcement officer. 15
‘‘(2) R
ETIRED LAW ENFORCEMENT OFFICER 16
DEFINED.—In this subsection, the term ‘retired law 17
enforcement officer’ means an individual who sepa-18
rated from service, in good standing, as a law en-19
forcement officer, in an official capacity at a public 20
agency, with or without compensation.’’. 21
(b) R
ETROACTIVEAPPLICABILITY.— 22
(1) I
N GENERAL.—Except as provided in para-23
graph (2), the amendments made by this section 24
shall— 25

(A) take effect on the date of enactment of 1
this Act; and 2
(B) apply to any matter pending, before 3
the Bureau of Justice Assistance or otherwise, 4
on the date of enactment of this Act, or filed 5
(consistent with pre-existing effective dates) or 6
accruing after that date. 7
(2) E
XCEPTIONS.—The amendments made by 8
this section shall apply to any action taken against 9
a retired law enforcement officer described in section 10
1201(p) of the Omnibus Crime Control and Safe 11
Streets Act of 1968 (as added by this Act) that oc-12
curred on or after August 28, 2012. 13
