5050 terms used in this Act have the meanings given such terms 2

5353 SEC. 2. INFORMATION SHARING FOR FEDERAL AGENCIES. 5

5858 N GENERAL.—The Administrator of the 8
5959 Federal Emergency Management Agency shall estab-9
6060 lish and maintain a web-based interagency electronic 10
6161 information sharing system, to be known as the 11
6262 ‘‘unified disaster application system’’, to— 12
6363 (A) facilitate the administration of the uni-13
6464 versal application for direct Federal disaster as-14
6565 sistance established under section 3; 15
6666 (B) carry out the purposes of disaster as-16
6767 sistance programs swiftly, efficiently, and in ac-17
6868 cordance with applicable laws, regulations, and 18

7979 UTHORITIES OF ADMINISTRATOR .—In es-7
8080 tablishing and maintaining the unified disaster ap-8
8181 plication system under this subsection, the Adminis-9
8282 trator may collect and maintain disaster assistance 10
8383 information received from a disaster assistance 11
8484 agency, a block grant recipient, or an applicant for 12
8585 a disaster assistance program and share such infor-13
8686 mation with any other disaster assistance agency or 14
8787 block grant recipient using such system. 15

8989 EQUIREMENTS.—The Administrator shall 16
9090 ensure that the unified disaster application system 17
9191 established and maintained under this subsection— 18
9292 (A) allows an applicant to receive status 19
9393 updates on an application for disaster assist-20
9494 ance programs submitted though such system; 21
9595 (B) allows for applicants to update disaster 22
9696 assistance information throughout the recovery 23
9797 journeys of such applicants in accordance with 24
9898 established application timeframes; 25

109109 such applicant; and 8
110110 (E) contains any other capabilities deter-9
111111 mined necessary by the head of a disaster as-10
112112 sistance agency. 11

114114 ATASECURITY.—The Administrator may facili-12
115115 tate the collection of disaster assistance information into 13
116116 the unified disaster application system established under 14
117117 subsection (a) only after the following requirements have 15
118118 been met: 16
119119 (1) The Administrator certifies that the unified 17
120120 disaster application system substantially complies 18
121121 with the data security standards and best practices 19
122122 established pursuant to subchapter II of chapter 35 20
123123 of title 44, United States Code, and any other appli-21
124124 cable Federal information security policy. 22
125125 (2) The Secretary of Homeland Security pub-23
126126 lishes a privacy impact assessment for the unified 24
127127 disaster application system, in accordance with sec-25

145145 thorize the additional collection, maintenance, shar-12
146146 ing, and use of disaster assistance information by 13
147147 publishing a notice on the unified disaster applica-14
148148 tion system established under subsection (a) that in-15
149149 cludes a detailed description of— 16
150150 (A) the specific amendments to the collec-17
151151 tion, maintenance, and sharing of disaster as-18
152152 sistance information authorized; 19
153153 (B) why each such amendment to how dis-20
154154 aster assistance information is collected, main-21
155155 tained, or shared is necessary to carry out the 22
156156 purposes of a disaster assistance program and 23
157157 consistent with the fair information practice 24
158158 principles; and 25

168168 OTICE AND PUBLICATION REQUIRE -6
169169 MENTS.—The publication of a notice under para-7
170170 graph (1) of a revision to the unified disaster appli-8
171171 cation system of records prior to any new collection, 9
172172 or uses, of Privacy Act categories of records, to 10
173173 carry out the purposes of a disaster assistance pro-11
174174 gram with regard to a disaster declared by the 12
175175 President under section 401 or 501 of the Robert T. 13
176176 Stafford Disaster Relief and Emergency Assistance 14
177177 Act (42 U.S.C. 5170; 5191), shall be deemed to sat-15
178178 isfy the notice and publication requirements of sec-16
179179 tion 552a(e)(4) of title 5, United States Code, for 17
180180 the entire period of performance for any assistance 18
181181 provided under a disaster assistance program. 19

183183 AIVER OF INFORMATION COLLECTION RE -20
184184 QUIREMENTS.— 21

186186 N GENERAL.—Upon the declaration of 22
187187 a major disaster or emergency pursuant to sec-23
188188 tions 401 or 501 of the Robert T. Stafford Dis-24
189189 aster Relief and Emergency Assistance Act (42 25

199199 aster assistance program. 7

201201 RANSPARENCY.—Upon exercising the 8
202202 waiver authority under subparagraph (A), the 9
203203 Administrator shall— 10
204204 (i) promptly post on a website of the 11
205205 Federal Emergency Management Agency a 12
206206 brief justification for such waiver, the an-13
207207 ticipated period of time such waiver will be 14
208208 in effect, and the disaster assistance offices 15
209209 within the Federal Emergency Manage-16
210210 ment Agency to which such waiver shall 17
211211 apply; and 18
212212 (ii) update the information relating to 19
213213 such waiver, as applicable. 20

215215 REVIEW OF WAIVER OF INFORMATION 21
216216 COLLECTION REQUIREMENTS .— 22
217217 (A) I
218218 N GENERAL.—Not later than 1 year 23
219219 after the date of enactment of this Act, the 24
220220 Comptroller General of the United States shall 25

225225 tial risks associated with authorizing the waiver 2
226226 of the information collection requirements de-3
227227 scribed in paragraph (3). 4

229229 ONTENTS.—The report required 5
230230 under subparagraph (A) shall include an assess-6
231231 ment of the extent to which a waiver described 7
232232 in paragraph (3) would— 8
233233 (i) affect the paperwork burden for in-9
234234 dividuals, small businesses, State, local and 10
235235 tribal governments, and other persons; 11
236236 (ii) affect the consistent application of 12
237237 Federal laws relating to— 13
238238 (I) privacy and confidentiality; 14
239239 (II) security of information; and 15
240240 (III) access to information; and 16
241241 (iii) encourage or deter a State or 17
242242 other entity from participating in the vol-18
243243 untary collection of information for the du-19
244244 ration of a major disaster or emergency. 20

246246 SE BYOTHERFEDERALAGENCIES.— 21

248248 N GENERAL.—The Administrator may per-22
249249 mit a Federal agency other than a disaster assist-23
250250 ance agency listed in subparagraphs (A) through 24
251251 (D) of subsection (f)(3) to use the unified disaster 25

256256 for the purpose of facilitating disaster-related assist-2
257257 ance if such agency enters into an agreement con-3
258258 taining the terms described in paragraph (2). 4
259259 (2) A
260260 GENCY AGREEMENT .—An agreement en-5
261261 tered into under paragraph (1) shall contain the fol-6
262262 lowing terms: 7
263263 (A) The Federal agency shall— 8
264264 (i) collect, share, maintain, and use 9
265265 disaster assistance information in compli-10
266266 ance with this section and any policies of 11
267267 the Federal Emergency Management 12
268268 Agency and any information protection and 13
269269 use policies of such Federal agency; and 14
270270 (ii) train any personnel granted access 15
271271 to disaster assistance information on the 16
272272 rules of behavior established by the Admin-17
273273 istrator under subsection (b)(3). 18
274274 (B) In the event of any unauthorized dis-19
275275 closure of disaster assistance information, the 20
276276 Federal agency shall— 21
277277 (i) notify the Administrator within 24 22
278278 hours of discovering any such unauthorized 23
279279 disclosure; 24

284284 trator in the investigation and remediation 2
285285 of any such disclosure; 3
286286 (iii) cooperate fully in the prosecution 4
287287 of a person responsible for such disclosure; 5
288288 and 6
289289 (iv) assume the responsibility for any 7
290290 compensation, civil liability, or other reme-8
291291 diation measures, whether awarded by a 9
292292 judgment of a court or agreed as a com-10
293293 promise of any potential claims by or on 11
294294 behalf of an applicant, including by obtain-12
295295 ing credit monitoring and remediation 13
296296 services, for an improper disclosure that 14
297297 is— 15
298298 (I) caused, directly or indirectly, 16
299299 by the acts or omissions of officers, 17
300300 employees, and contractors of the 18
301301 agency; or 19
302302 (II) from any electronic system 20
303303 of records that is created or main-21
304304 tained by the agency pursuant to sec-22
305305 tion 552a(e) of title 5, United States 23
306306 Code. 24

311311 The Administrator shall publish an agency agree-2
312312 ment entered into under this subsection on the same 3
313313 website as the unified disaster application system es-4
314314 tablished under subsection (a). 5

316316 ULE OFCONSTRUCTION.—The sharing and use 6
317317 of disaster assistance information that is subject to the 7
318318 requirements of section 552a of title 5, United States 8
319319 Code, by disaster assistance agencies and block grant re-9
320320 cipients— 10
321321 (1) shall not be— 11
322322 (A) construed as a matching program for 12
323323 purposes of section 552a(a)(8) of such title; or 13
324324 (B) subject to the remaining computer 14
325325 matching provisions of section 552a of such 15
326326 title; and 16
327327 (2) shall be in addition to any other law pro-17
328328 viding for the sharing or use of such information. 18

330330 EFINITIONS.—In this section: 19
331331 (1) A
332332 PPLICANT.—The term ‘‘applicant’’ 20
333333 means— 21
334334 (A) a person who applies for disaster as-22
335335 sistance from a disaster assistance program; 23

345345 ‘‘block grant recipient’’ means a State, local govern-5
346346 ment, or Indian Tribe that receives assistance 6
347347 through the disaster assistance program described in 7
348348 paragraph (5)(B)(i). 8

350350 ISASTER ASSISTANCE AGENCY .—The term 9
351351 ‘‘disaster assistance agency’’ means— 10
352352 (A) the Federal Emergency Management 11
353353 Agency; 12
354354 (B) the Department of Housing and 13
355355 Urban Development; 14
356356 (C) the Small Business Administration; 15
357357 (D) the Department of Agriculture; and 16
358358 (E) any other Federal agency that the Ad-17
359359 ministrator permits to use the unified disaster 18
360360 application system under subsection (d). 19

362362 ISASTER ASSISTANCE INFORMATION .—The 20
363363 term ‘‘disaster assistance information’’ includes any 21
364364 personal, demographic, biographical, geographical, 22
365365 financial information, or other information that a 23
366366 disaster assistance agency or block grant recipient is 24
367367 authorized to collect, maintain, share, or use to proc-25

374374 ISASTER ASSISTANCE PROGRAM .—The 3
375375 term ‘‘disaster assistance program’’ means— 4
376376 (A) any program that provides assistance 5
377377 to individuals and households under title IV or 6
378378 title V of the Robert T. Stafford Disaster Relief 7
379379 and Emergency Assistance Act (42 U.S.C. 5170 8
380380 et seq.); or 9
381381 (B) any other assistance program carried 10
382382 out by a disaster assistance agency that pro-11
383383 vides assistance to an individual, household, or 12
384384 organization related to a major disaster or 13
385385 emergency declared under sections 401 or 501 14
386386 of such Act, including— 15
387387 (i) assistance for activities related to 16
388388 disaster relief, long-term recovery, restora-17
389389 tion of infrastructure and housing, eco-18
390390 nomic revitalization, and mitigation that 19
391391 are authorized under title I of the Housing 20
392392 and Community Development Act of 1974 21
393393 (42 U.S.C. 5301 et seq.); 22
394394 (ii) any loan that is authorized under 23
395395 section 7(b) of the Small Business Act (15 24
396396 U.S.C. 636(b)); and 25

406406 SEC. 3. UNIVERSAL APPLICATION FOR INDIVIDUAL ASSIST-7

409409 NIVERSALAPPLICATION.—The Administrator 9
410410 of the Federal Emergency Management Agency shall de-10
411411 velop and establish a universal application for direct Fed-11
412412 eral disaster assistance for individuals in areas impacted 12
413413 by emergencies or disasters. 13

415415 ONSULTATION AND SUPPORT.— 14

417417 ONSULTATION.—In carrying out this sec-15
418418 tion, the Administrator shall consult with the fol-16
419419 lowing: 17
420420 (A) The Director of the Office of Manage-18
421421 ment and Budget. 19
422422 (B) The Administrator of the Small Busi-20
423423 ness Administration. 21
424424 (C) The Secretary of Housing and Urban 22
425425 Development. 23
426426 (D) The Secretary of Agriculture. 24

431431 graph (1) shall provide prompt support to the Ad-2

434434 URVEY.—The application established under sub-4
435435 section (a) shall include a voluntary survey to collect the 5
436436 demographic data of an applicant. 6

441441 GRAMS.—Not later than 1 year after the date of enact-9
442442 ment of this Act, the Comptroller General of the United 10
443443 States shall— 11
444444 (1) conduct an assessment of improper and po-12
445445 tentially fraudulent Federal disaster assistance for 13
446446 individuals made to survivors of major disasters de-14
447447 clared in 2020 and 2021, including through identity 15
448448 theft; and 16
449449 (2) submit to the Committee on Transportation 17
450450 and Infrastructure of the House of Representatives 18
451451 and the Committee on Homeland Security and Gov-19
452452 ernmental Affairs of the Senate a report that de-20
453453 scribes— 21
454454 (A) the prevalence of improper and poten-22
455455 tially fraudulent Federal disaster assistance for 23
456456 individuals made to registrants who used invalid 24

466466 sonal identifying information; 7
467467 (C) the adequacy of existing fraud preven-8
468468 tion protocols in place on the Federal Emer-9
469469 gency Management Agency’s online application 10
470470 for Federal disaster assistance for individuals; 11
471471 and 12
472472 (D) recommendations for improving the 13
473473 identity verification protocols in place for Fed-14
474474 eral disaster assistance for individuals. 15
475475 SEC. 4. REPAIR AND REBUILDING. 16
476476 (a) I
477477 NGENERAL.—Section 408(b)(1) of the Robert 17
478478 T. Stafford Disaster Relief and Emergency Assistance Act 18
479479 (42 U.S.C. 5174(b)(1)) is amended— 19
480480 (1) by striking ‘‘rendered uninhabitable’’ and 20
481481 inserting ‘‘damaged by a major disaster’’; and 21
