19	19	To exempt certain entities from liability under the Com-
20	20	prehensive Environmental Response, Compensation, and
21	21	Liability Act of 1980 with respect to releases of
22	22	perfluoroalkyl and polyfluoroalkyl substances, and for
23	23	other purposes.
24	24	Be it enacted by the Senate and House of Representa-1
25	25	tives of the United States of America in Congress assembled, 2
26	26	SECTION 1. SHORT TITLE. 3
27	27	This Act may be cited as the ‘‘Water Systems PFAS 4
28	28	Liability Protection Act’’. 5

36	36	EFINITIONS.—In this section: 4
37	37	(1) C
38	38	OVERED PERFLUOROALKYL OR 5
39	39	POLYFLUOROALKYL SUBSTANCE .—The term ‘‘cov-6
40	40	ered perfluoroalkyl or polyfluoroalkyl substance’’ 7
41	41	means a non-polymeric perfluoroalkyl or 8
42	42	polyfluoroalkyl substance that contains at least 2 se-9
43	43	quential fully fluorinated carbon atoms, excluding 10
44	44	gases and volatile liquids, that is a hazardous sub-11
45	45	stance (as defined in section 101 of the Comprehen-12
46	46	sive Environmental Response, Compensation, and 13
47	47	Liability Act of 1980 (42 U.S.C. 9601)). 14

49	49	NDIAN TRIBE.—The term ‘‘Indian Tribe’’ 15
50	50	has the meaning given the term in section 4 of the 16
51	51	Indian Self-Determination and Education Assistance 17
52	52	Act (25 U.S.C. 5304). 18

54	54	ROTECTED ENTITY.—The term ‘‘protected 19
55	55	entity’’ means— 20
56	56	(A) a public water system (as defined in 21
57	57	section 1401 of the Safe Drinking Water Act 22
58	58	(42 U.S.C. 300f)); 23
59	59	(B) a publicly or privately owned or oper-24
60	60	ated treatment works (as defined in section 212 25

64	64	of the Federal Water Pollution Control Act (33 1
65	65	U.S.C. 1292)); 2
66	66	(C) a municipality to which a permit under 3
67	67	section 402 of the Federal Water Pollution 4
68	68	Control Act (33 U.S.C. 1342) is issued for 5
69	69	stormwater discharges; 6
70	70	(D) a political subdivision of a State or a 7
71	71	special district of a State acting as a wholesale 8
72	72	water agency; and 9
73	73	(E) a contractor performing the manage-10
74	74	ment or disposal activities described in sub-11
75	75	section (c) for an entity described in any of sub-12
76	76	paragraphs (A) through (D). 13

78	78	XEMPTION.—Subject to subsection (c), no per-14
79	79	son (including the United States, any State, or an Indian 15
80	80	Tribe) may recover costs or damages from a protected en-16
81	81	tity under the Comprehensive Environmental Response, 17
82	82	Compensation, and Liability Act of 1980 (42 U.S.C. 9601 18
83	83	et seq.) for costs arising from a release to the environment 19
84	84	of a covered perfluoroalkyl or polyfluoroalkyl substance. 20
85	85	(c) R
86	86	EQUIREMENTS.—Subsection (b) shall only apply 21
87	87	if a protected entity transports, treats, disposes of, or ar-22
88	88	ranges for the transport, treatment, or disposal of a cov-23
89	89	ered perfluoroalkyl or polyfluoroalkyl substance— 24

93	93	(1) in a manner consistent with all applicable 1
94	94	laws at the time the activity is carried out; and 2
95	95	(2) during and following the conveyance or 3
96	96	treatment of water under Federal or State law, in-4
97	97	cluding through— 5
98	98	(A) the management or disposal of bio-6
99	99	solids consistent with section 405 of the Fed-7
100	100	eral Water Pollution Control Act (33 U.S.C. 8
101	101	1345); 9
102	102	(B) the discharge of effluent in accordance 10
103	103	with a permit issued under section 402 of the 11
104	104	Federal Water Pollution Control Act (33 U.S.C. 12
105	105	1342); 13
106	106	(C) the release or disposal of water treat-14
107	107	ment residuals or any other byproduct of drink-15
108	108	ing water or wastewater treatment activities, 16
109	109	such as granulated activated carbon, filter 17
110	110	media, and processed waste streams; or 18
111	111	(D) the conveyance or storage of water for 19
112	112	the purpose of conserving or reclaiming the 20
113	113	water for water supply. 21

115	115	AVINGSPROVISION.—Nothing in this section 22
116	116	precludes liability for damages or costs associated with the 23
117	117	release of a covered perfluoroalkyl or polyfluoroalkyl sub-24
118	118	stance by a protected entity if that protected entity acted 25
