3939 ARCINOGEN.—The term ‘carcinogen’ 7
4040 means an agent that is— 8
4141 ‘‘(i) classified by the International 9
4242 Agency for Research on Cancer under 10
4343 Group 1 or Group 2A; and 11
4444 ‘‘(ii) reasonably linked to an exposure- 12
4545 related cancer. 13
4646 ‘‘(B) D
4747 IRECTOR.—The term ‘Director’ 14
4848 means the Director of the Bureau. 15

5050 XPOSURE-RELATED CANCER .—As 16

9191 ‘‘(A) IN GENERAL.—Subject to subpara-1
9292 graph (B), as determined by the Bureau, the 2
9393 exposure of a public safety officer to a car-3
9494 cinogen shall be presumed to constitute a per-4
9595 sonal injury within the meaning of subsection 5
9696 (a) or (b) sustained in the line of duty by the 6
9797 officer and directly and proximately resulting in 7
9898 death or permanent and total disability, if— 8
9999 ‘‘(i) the exposure occurred while the 9
100100 public safety officer was engaged in line of 10
101101 duty action or activity; 11
102102 ‘‘(ii) the public safety officer began 12
103103 serving as a public safety officer not fewer 13
104104 than 5 years before the date of the diag-14
105105 nosis of the public safety officer with an 15
106106 exposure-related cancer; 16
107107 ‘‘(iii) the public safety officer was di-17
108108 agnosed with the exposure-related cancer 18
109109 not more than 15 years after the public 19
110110 safety officer’s last date of active service as 20
111111 a public safety officer; and 21
112112 ‘‘(iv) the exposure-related cancer di-22
113113 rectly and proximately results in the death 23
114114 or permanent and total disability of the 24
115115 public safety officer. 25

120120 under subparagraph (A) shall not apply if com-2
121121 petent medical evidence establishes that the ex-3
122122 posure of the public safety officer to the car-4
123123 cinogen was not a substantial contributing fac-5
124124 tor in the death or disability of the public safety 6
125125 officer. 7

127127 DDITIONAL EXPOSURE -RELATED CAN-8
128128 CERS.— 9
129129 ‘‘(A) I
130130 N GENERAL.—From time to time 10
131131 but not less frequently than once every 3 years, 11
132132 the Director shall— 12
133133 ‘‘(i) review the definition of ‘exposure- 13
134134 related cancer’ under paragraph (1); and 14
135135 ‘‘(ii) if appropriate, update the defini-15
136136 tion, in accordance with this paragraph— 16
137137 ‘‘(I) by rule; or 17
138138 ‘‘(II) by publication in the Fed-18
139139 eral Register or on the public website 19
140140 of the Bureau. 20

145145 make an update under subparagraph 23
146146 (A)(ii) in any case in which the Director 24

159159 medical evidence described in clause (i) 8
160160 may include recommendations, risk assess-9
161161 ments, and scientific studies by— 10
162162 ‘‘(I) the National Institute for 11
163163 Occupational Safety and Health; 12
164164 ‘‘(II) the National Toxicology 13
165165 Program; 14
166166 ‘‘(III) the National Academies of 15
167167 Sciences, Engineering, and Medicine; 16
168168 or 17
169169 ‘‘(IV) the International Agency 18
170170 for Research on Cancer. 19

172172 ETITIONS TO ADD TO THE LIST OF 20
173173 EXPOSURE-RELATED CANCERS.— 21

175175 N GENERAL.—Any person may 22
176176 petition the Director to add a form of can-23
177177 cer to the definition of ‘exposure-related 24
178178 cancer’ under paragraph (1). 25

183183 tion under clause (i) shall provide informa-2
184184 tion to show that there is sufficient com-3
185185 petent medical evidence of significant risk 4
186186 to public safety officers of developing the 5
187187 cancer from engagement in their public 6
188188 safety activities. 7
189189 ‘‘(iii) T
190190 IMELY AND SUBSTANTIVE DE -8
191191 CISIONS.— 9
192192 ‘‘(I) R
193193 EFERRAL.—Not later than 10
194194 180 days after receipt of a petition 11
195195 satisfying clause (ii), the Director 12
196196 shall refer the petition to appropriate 13
197197 medical experts for review, analysis 14
198198 (including risk assessment and sci-15
199199 entific study), and recommendation. 16
200200 ‘‘(II) C
201201 ONSIDERATION.—The Di-17
202202 rector shall consider each rec-18
203203 ommendation under subclause (I) and 19
204204 promptly take appropriate action in 20
205205 connection with the recommendation 21
206206 pursuant to subparagraph (B). 22

208208 OTIFICATION TO CONGRESS .— 23
209209 Not later than 30 days after taking any 24
210210 substantive action in connection with a rec-25

220220 PPLICABILITY.—The amendment made by 6
221221 paragraph (1) shall apply to any claim under— 7
222222 (A) section 1201(a) of title I of the Omni-8
223223 bus Crime Control and Safe Streets Act of 9
224224 1968 (34 U.S.C. 10281(a)) that is predicated 10
225225 upon the death of a public safety officer on or 11
226226 after January 1, 2020, that is the direct and 12
227227 proximate result of an exposure-related cancer; 13
228228 or 14
229229 (B) section 1201(b) of title I of the Omni-15
230230 bus Crime Control and Safe Streets Act of 16
231231 1968 (34 U.S.C. 10281(b)) that is filed on or 17
232232 after January 1, 2020, and predicated upon a 18
233233 disability that is the direct and proximate result 19
234234 of an exposure-related cancer. 20

236236 IME FOR FILING CLAIM.—Notwithstanding 21
237237 any other provision of law, an individual who desires 22
238238 to file a claim that is predicated upon the amend-23
239239 ment made by paragraph (1) shall not be precluded 24

246246 ONFIDENTIALITY OFINFORMATION.— 3

248248 N GENERAL.—Section 812(a) of title I of 4
249249 the Omnibus Crime Control and Safe Streets Act of 5
250250 1968 (34 U.S.C. 10231(a)) is amended— 6
251251 (A) in the first sentence, by striking ‘‘fur-7
252252 nished under this title by any person and iden-8
253253 tifiable to any specific private person’’ and in-9
254254 serting ‘‘furnished under any law to any compo-10
255255 nent of the Office of Justice Programs, or fur-11
256256 nished otherwise under this title, by any entity 12
257257 or person, including any information identifi-13
258258 able to any specific private person,’’; and 14
259259 (B) in the second sentence, by striking 15
260260 ‘‘person furnishing such information’’ and in-16
261261 serting ‘‘entity or person furnishing such infor-17
262262 mation or to whom such information pertains’’. 18

264264 FFECTIVE DATE; APPLICABILITY.—The 19
265265 amendments made by paragraph (1) shall— 20
266266 (A) shall take effect for all purposes as if 21
267267 enacted on December 27, 1979; and 22
268268 (B) apply to any matter pending, before 23
269269 the Department of Justice or otherwise, as of 24
270270 the date of enactment of this Act. 25

283283 (C) in subparagraph (C), by inserting ‘‘or 9

292292 NGENERAL.—Section 3 of the Safeguarding 16
293293 America’s First Responders Act of 2020 (34 U.S.C. 17
294294 10281 note) is amended by adding at the end the fol-18

297297 EFINITION.—In this section, the term ‘line of 20
298298 duty action’ includes any action— 21
299299 ‘‘(1) in which a public safety officer engaged at 22
300300 the direction of the agency served by the public safe-23

312312 3 of the Safeguarding America’s First Responders 6
313313 Act of 2020 (34 U.S.C. 10281 note)— 7
314314 (A) that is predicated upon the death of a 8
315315 public safety officer on or after January 1, 9
316316 2020; or 10
317317 (B) that is— 11
318318 (i) predicated upon the disability of a 12
319319 public safety officer; and 13
320320 (ii) filed on or after January 1, 2020. 14
