A BILL 
To amend the Immigration and Nationality Act to provide 
that an alien who has been convicted of a crime is 
ineligible for asylum, and for other purposes. 
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘No Asylum for Crimi-4
nals Act of 2025’’. 5

SEC. 2. ALIENS CONVICTED OF CRIMES INELIGIBLE FOR 1
ASYLUM. 2
Clause (ii) of section 208(b)(2) of the Immigration 3
and Nationality Act (8 U.S.C. 1158) is amended— 4
(1) by amending clause (ii) of subparagraph (A) 5
to read as follows: 6
‘‘(ii) except as provided in subpara-7
graph (B), the alien has been finally con-8
victed of a felony or misdemeanor;’’; 9
(2) by amending subparagraph (B) to read as 10
follows: 11
‘‘(B) E
XCEPTION.—The Secretary of 12
Homeland Security may designate by regulation 13
political offenses committed outside the United 14
States that will be not considered to be a crime 15
described in clause (ii). The authority under 16
this subparagraph is limited to political offenses 17
committed outside the United States.’’; and 18
(3) by adding at the end the following: 19
‘‘(E) D
EFINITIONS.—In this paragraph: 20
‘‘(i) The term ‘felony’ means— 21
‘‘(I) any crime defined as a fel-22
ony by the relevant jurisdiction (Fed-23
eral, State, tribal, or local) of convic-24
tion; or 25

‘‘(II) any crime punishable by 1
more than one year of imprisonment. 2
‘‘(ii) The term ‘misdemeanor’ 3
means— 4
‘‘(I) any crime defined as a mis-5
demeanor by the relevant jurisdiction 6
(Federal, State, tribal, or local) of 7
conviction; or 8
‘‘(II) any crime not punishable 9
by more than one year of imprison-10
ment.’’. 11
