3232 SECTION 1. SHORT TITLE. 3
3333 This Act may be cited as the ‘‘One Flag for All Act’’. 4

3838 THE UNITED STATES. 2
3939 (a) P
4040 ROHIBITIONS.—No flag that is not the flag of 3
4141 the United States may be flown, draped, or otherwise dis-4
4242 played— 5
4343 (1) on the exterior of a covered public building; 6
4444 or 7
4545 (2) in an area of a covered public building that 8
4646 is fully accessible to the public, including an 9
4747 entryway or hallway. 10
4848 (b) E
4949 XCEPTIONS.—The prohibitions under subsection 11
5050 (a) shall not apply to— 12
5151 (1) a National League of Families POW/MIA 13
5252 flag (as designated by section 902 of title 36, United 14
5353 States Code); 15
5454 (2) a Hostage and Wrongful Detainee flag (as 16
5555 designated by section 904 of title 36, United States 17
5656 Code); 18
5757 (3) any flag that represents the nation of a vis-19
5858 iting diplomat or a representative of the government 20
5959 of such nation visiting the public building at which 21
6060 the flag is displayed; 22
6161 (4) in the case of a Member of Congress, the 23
6262 State flag of the State represented by such Member 24
6363 that is located outside or within the office of the 25
6464 Member; 26

6969 the Armed Forces or a flag supporting the Armed 2

7171 (6) any flag of historical significance to the 4
7272 United States, including the Betsy Ross flag, the 5
7373 Gadsden flag, and the Bennington flag; 6
7474 (7) a flag representing public safety; 7
7575 (8) a flag commemorating a specific national 8
7676 observance, including the 9/11 Memorial flag and 9
7777 the Remembrance Day flag; 10
7878 (9) in the case of a religious liturgy or cere-11
7979 mony at a military installation or facility, any flag 12
8080 that represents a religious organization or church 13
8181 that is covered by section 501(c)(3) of the Internal 14
8282 Revenue Code of 1986 and exempt from tax under 15
8383 section 501(a) of such Code; 16
8484 (10) in the case of a Federal agency, a flag rep-17
8585 resenting such agency; 18
8686 (11) any flag that represents an Indian Tribe 19
8787 (as defined in section 4 of the Indian Self-Deter-20
8888 mination and Education Assistance Act (25 U.S.C. 21
8989 5304)); or 22
9090 (12) any flag that represents the State, terri-23
9191 tory, county, city, or local jurisdiction in which the 24
9292 public building is located. 25

105105 N GENERAL.—The term ‘‘covered 7
106106 public building’’ has the meaning given the 8
107107 term in section 3301(a) of title 40, United 9
108108 States Code. 10

110110 NCLUSION.—The term ‘‘public build-11
111111 ing’’ includes— 12
112112 (i) a building in use by the Senate or 13
113113 the House of Representatives, or otherwise 14
114114 under the jurisdiction of the Architect of 15
115115 the Capitol; 16
116116 (ii) a military installation (as defined 17
117117 in section 2801(c) of title 10, United 18
118118 States Code); and 19
119119 (iii) any embassy or consulate of the 20
120120 United States. 21
