207	207	Rio Salado Basin, or for the Pueblo of Laguna 14

295	295	retary shall execute the Agreement, including all at-6
296	296	tachments to, or parts of, the Agreement requiring 7
297	297	the signature of the Secretary. 8

299	299	ODIFICATIONS.—Nothing in this title pro-9
300	300	hibits the Secretary, after execution of the Agree-10
301	301	ment, from approving any modification to the Agree-11
302	302	ment, including an attachment to the Agreement, 12
303	303	that is consistent with this title, to the extent that 13
304	304	the modification does not otherwise require congres-14
305	305	sional approval under section 2116 of the Revised 15
306	306	Statutes (25 U.S.C. 177) or any other applicable 16
307	307	provision of Federal law. 17

309	309	NVIRONMENTAL COMPLIANCE.— 18

311	311	N GENERAL.—In implementing the Agree-19
312	312	ment and this title, the Secretary shall comply 20

314	314	(A) the Endangered Species Act of 1973 22
315	315	(16 U.S.C. 1531 et seq.); 23

327	327	N GENERAL.—In implementing the 7
328	328	Agreement and this title, the Pueblos shall pre-8
329	329	pare any necessary environmental documents, 9
330	330	consistent with— 10
331	331	(i) the Endangered Species Act of 11
332	332	1973 (16 U.S.C. 1531 et seq.); 12
333	333	(ii) the National Environmental Policy 13
334	334	Act of 1969 (42 U.S.C. 4321 et seq.), in-14
335	335	cluding the implementing regulations of 15
336	336	that Act; and 16
337	337	(iii) all other applicable Federal envi-17
338	338	ronmental laws and regulations. 18
339	339	(B) A
340	340	UTHORIZATIONS.—The Secretary 19
341	341	shall— 20
342	342	(i) independently evaluate the docu-21
343	343	mentation required under subparagraph 22
344	344	(A); and 23
345	345	(ii) be responsible for the accuracy, 24
346	346	scope, and contents of that documentation. 25

350	350	(3) EFFECT OF EXECUTION .—The execution of 1
351	351	the Agreement by the Secretary under this section 2
352	352	shall not constitute a major Federal action under 3
353	353	the National Environmental Policy Act of 1969 (42 4
354	354	U.S.C. 4321 et seq.). 5

356	356	OSTS.—Any costs associated with the per-6
357	357	formance of the compliance activities under this sub-7
358	358	section shall be paid from funds deposited in the 8
359	359	Pueblo Trust Funds, subject to the condition that 9
360	360	any costs associated with the performance of Federal 10
361	361	approval or other review of such compliance work or 11
362	362	costs associated with inherently Federal functions 12
363	363	shall remain the responsibility of the Secretary. 13
364	364	SEC. 104. PUEBLO WATER RIGHTS. 14

366	366	RUSTSTATUS OF THE PUEBLOWATER 15

368	368	IGHTS.—The Pueblo Water Rights shall be held in trust 16
369	369	by the United States on behalf of the Pueblos in accord-17
370	370	ance with the Agreement and this title. 18

372	372	ORFEITURE ANDABANDONMENT.— 19

374	374	N GENERAL.—The Pueblo Water Rights 20
375	375	shall not be subject to loss through non-use, for-21
376	376	feiture, abandonment, or other operation of law. 22

378	378	TATE-LAW BASED WATER RIGHTS .—Pur-23
379	379	suant to the Agreement, State-law based water 24
380	380	rights acquired by a Pueblo, or by the United States 25

385	385	the Partial Final Judgment and Decree, shall not be 2
386	386	subject to forfeiture, abandonment, or permanent 3
387	387	alienation from the time they are acquired. 4

389	389	SE.—Any use of the Pueblo Water Rights shall 5
390	390	be subject to the terms and conditions of the Agreement 6
391	391	and this title. 7

393	393	LLOTMENT RIGHTSNOTINCLUDED.—The 8
394	394	Pueblo Water Rights shall not include any water uses or 9
395	395	water rights claims on an Allotment. 10
396	396	(e) A
397	397	UTHORITY OF THEPUEBLOS.— 11

399	399	N GENERAL.—The Pueblos shall have the 12
400	400	authority to allocate, distribute, and lease the Pueblo 13
401	401	Water Rights for use on Pueblo Land in accordance 14
402	402	with the Agreement, this title, and applicable Fed-15
403	403	eral law. 16

405	405	SE OFF PUEBLO LAND .—The Pueblos may 17
406	406	allocate, distribute, and lease the Pueblo Water 18
407	407	Rights for use off Pueblo Land in accordance with 19
408	408	the Agreement, this title, and applicable Federal 20
409	409	law, subject to the approval of the Secretary. 21
410	410	(3) A
411	411	LLOTTEE WATER RIGHTS .—The Pueblos 22
412	412	shall not object in any general stream adjudication, 23
413	413	including the Adjudication, or any other appropriate 24
414	414	forum, to the quantification of reasonable domestic, 25

420	420	with applicable Federal law, including recognition 3

422	422	(A) any water use existing on an Allotment 5
423	423	as of the date of enactment of this Act; 6
424	424	(B) reasonable domestic, stock, and irriga-7
425	425	tion water uses on an Allotment; and 8
426	426	(C) any Allotment water right decreed in a 9
427	427	general stream adjudication, including the Ad-10
428	428	judication, or other appropriate forum, for an 11
429	429	Allotment. 12
430	430	(f) A
431	431	DMINISTRATION.— 13

433	433	O ALIENATION.—The Pueblos shall not 14
434	434	permanently alienate any portion of the Pueblo 15
435	435	Water Rights. 16

437	437	URCHASES OR GRANTS OF LAND FROM IN -17
438	438	DIANS.—An authorization provided by this title for 18
439	439	the allocation, distribution, leasing, or other ar-19
440	440	rangement entered into pursuant to this title shall 20
441	441	be considered to satisfy any requirement for author-21
442	442	ization of the action required by Federal law. 22

444	444	ROHIBITION ON FORFEITURE .—The non- 23

907	907	pursuant to the Agreement, for Signatory Acequias 19
908	908	Projects and Offset Projects Fund for the Associa-20

910	910	(3) $500,000, as adjusted for inflation pursu-22
911	911	ant to the Agreement, to mitigate impairment to 23

1023	1023	tion, operation, and management of irrigation 22
1024	1024	projects on Pueblo Land (including damages, losses, 23
1025	1025	or injuries to fish habitat, wildlife, and wildlife habi-24
1026	1026	tat) within the Rio San Jose´Stream System; 25

1040	1040	FFECTIVEDATE.—The waivers and releases de-10
1041	1041	scribed in subsections (a) and (b) shall take effect on the 11

1055	1055	(2) activities affecting the quality of water and 23

1077	1077	(5) all claims for water rights, and claims for 18
1078	1078	injury to water rights, in basins other than the Rio 19
1079	1079	San Jose´Stream System, subject to Article 8.5 of 20
1080	1080	the Agreement with respect to the claims of the 21
1081	1081	Pueblo of Laguna for water rights in the Rio Puerco 22
1082	1082	Basin and the claims of the Pueblo of Acoma for 23
1083	1083	water rights in the Rio Salado Basin; 24

1094	1094	FFECT OFAGREEMENT AND TITLE.—Nothing 7
1095	1095	in the Agreement or this title— 8
1096	1096	(1) reduces or extends the sovereignty (includ-9
1097	1097	ing civil and criminal jurisdiction) of any govern-10
1098	1098	ment entity, except as provided in section 110; 11
1099	1099	(2) affects the ability of the United States, as 12
1100	1100	a sovereign, to carry out any activity authorized by 13
1101	1101	law, including— 14
1102	1102	(A) the Comprehensive Environmental Re-15
1103	1103	sponse, Compensation, and Liability Act of 16
1104	1104	1980 (42 U.S.C. 9601 et seq.); 17
1105	1105	(B) the Safe Drinking Water Act (42 18
1106	1106	U.S.C. 300f et seq.); 19

1122	1122	(A) to interpret Federal law relating to 8
1123	1123	health, safety, or the environment; 9
1124	1124	(B) to determine the duties of the United 10
1125	1125	States or any other party under Federal law re-11
1126	1126	garding health, safety, or the environment; or 12
1127	1127	(C) to conduct judicial review of any Fed-13
1128	1128	eral agency action; or 14
1129	1129	(5) waives any claim of a member of a Pueblo 15
1130	1130	in an individual capacity that does not derive from 16
1131	1131	a right of the Pueblos. 17

1133	1133	OLLING OFCLAIMS.— 18

1135	1135	N GENERAL.—Each applicable period of 19
1136	1136	limitation and time-based equitable defense relating 20
1137	1137	to a claim described in this section shall be tolled for 21
1138	1138	the period beginning on the date of enactment of 22
1139	1139	this Act and ending on the Enforceability Date. 23

1162	1162	to by the Pueblos and the Secretary, after pro-14
1163	1163	viding reasonable notice to the State. 15

1165	1165	ONSEQUENCES.—If this title expires under 16
1166	1166	paragraph (1)— 17
1167	1167	(A) the waivers and releases under sub-18
1168	1168	sections (a) and (b) shall— 19
1169	1169	(i) expire; and 20
1170	1170	(ii) have no further force or effect; 21
1171	1171	(B) the authorization, ratification, con-22
1172	1172	firmation, and execution of the Agreement 23
1173	1173	under section 103 shall no longer be effective; 24

1187	1187	to carry out the activities authorized by this 11
1188	1188	title, shall be returned to the Federal Govern-12
1189	1189	ment, unless otherwise agreed to by the Pueblos 13
1190	1190	and the United States and approved by Con-14
1191	1191	gress; and 15
1192	1192	(E) except for Federal funds used to ac-16
1193	1193	quire or construct property that is returned to 17
1194	1194	the Federal Government under subparagraph 18
1195	1195	(D), the United States shall be entitled to offset 19
1196	1196	any Federal funds made available to carry out 20
1197	1197	this title that were expended or withdrawn, or 21
1198	1198	any funds made available to carry out this title 22
1199	1199	from other Federal authorized sources, together 23
1200	1200	with any interest accrued on those funds, 24
1201	1201	against any claims against the United States— 25

1218	1218	satisfaction of any claim of the Pueblos against the United 14
1219	1219	States that are waived and released by the Pueblos pursu-15

1221	1221	SEC. 110. CONSENT OF UNITED STATES TO JURISDICTION 17
1222	1222	FOR JUDICIAL REVIEW OF A PUEBLO WATER 18
1223	1223	RIGHT PERMIT DECISION. 19

1225	1225	ONSENT.—On the Enforceability Date, the con-20
1226	1226	sent of the United States is hereby given, with the consent 21
1227	1227	of each Pueblo under Article 11.5 of the Agreement, to 22
1228	1228	jurisdiction in the District Court for the Thirteenth Judi-23
1229	1229	cial District of the State of New Mexico, and in the New 24
1230	1230	Mexico Court of Appeals and the New Mexico Supreme 25

1247	1247	for Pueblo Water Right Permit— 13
1248	1248	(1) is supported by substantial evidence; 14
1249	1249	(2) is not arbitrary, capricious, or contrary to 15
1250	1250	law; 16
1251	1251	(3) is not in accordance with the Agreement or 17
1252	1252	the Partial Final Judgment and Decree; or 18
1253	1253	(4) shows that the Pueblo acted fraudulently or 19
1254	1254	outside the scope of its authority. 20

2158	2158	(A) the waivers and releases under sub-16

2161	2161	(ii) have no further force or effect; 19
2162	2162	(B) the authorization, ratification, con-20
2163	2163	firmation, and execution of the Agreement 21
2164	2164	under section 203 shall no longer be effective; 22

2166	2166	retary, and any contract or agreement entered 24

2188	2188	this title that were expended or withdrawn, or 18

2191	2191	with any interest accrued on those funds, 21
2192	2192	against any claims against the United States— 22
