4545 The purposes of this Act are— 2
4646 (1) to achieve a fair, equitable, and final settle-3
4747 ment of all claims to water rights in the Rio Chama 4
4848 Stream System in the State for— 5
4949 (A) Ohkay Owingeh; and 6
5050 (B) the United States, acting as trustee 7
5151 for Ohkay Owingeh; 8
5252 (2) to authorize, ratify, and confirm the Agree-9
5353 ment entered into by Ohkay Owingeh, the State, and 10
5454 various other parties to the extent that the Agree-11
5555 ment is consistent with this Act; 12
5656 (3) to authorize and direct the Secretary— 13
5757 (A) to execute the Agreement; and 14
5858 (B) to take any other actions necessary to 15
5959 carry out the Agreement in accordance with 16
6060 this Act; and 17
6161 (4) to authorize funds necessary for the imple-18

7878 GREEMENT.—The term ‘‘Agreement’’ 11
7979 means— 12
8080 (A) the document entitled ‘‘Ohkay 13
8181 Owingeh Rio Chama Water Rights Settlement’’ 14
8282 and dated July 5, 2023, and the exhibits at-15
8383 tached thereto; and 16
8484 (B) any amendment to the document re-17
8585 ferred to in subparagraph (A) (including an 18
8686 amendment to an exhibit thereto) that is exe-19
8787 cuted to ensure that the Agreement is con-20
8888 sistent with this Act. 21

9090 OSQUE.—The term ‘‘bosque’’ means a gal-22
9191 lery forest located along the riparian floodplain of a 23
9292 stream, riverbank, or lake. 24

121121 UEBLO GRANT .—The term ‘‘Pueblo 22
122122 Grant’’ means the land recognized and confirmed by 23
123123 the Federal patent issued to Ohkay Owingeh (then 24

130130 UEBLO LAND.—The term ‘‘Pueblo Land’’ 3

132132 (A) held by the United States in trust for 5
133133 Ohkay Owingeh within the Rio Chama Stream 6
134134 System; 7
135135 (B) owned by the Pueblo within the Rio 8
136136 Chama Stream System before the Enforce-9
137137 ability Date; or 10
138138 (C) acquired by the Pueblo within the Rio 11
139139 Chama Stream System on or after the Enforce-12
140140 ability Date if the real property is located— 13
141141 (i) within the exterior boundaries of 14
142142 the Pueblo Grant; or 15
143143 (ii) within the exterior boundaries of 16
144144 any territory set aside for the Pueblo by 17
145145 law, Executive order, or court decree. 18

185185 Agreement, or to any exhibit to the Agreement re-22

196196 N GENERAL.—To the extent the Agreement 4
197197 does not conflict with this Act, the Secretary shall 5
198198 execute the Agreement, including all exhibits thereto 6
199199 or parts of the Agreement requiring the signature of 7
200200 the Secretary. 8

202202 ODIFICATIONS.—Nothing in this Act pro-9
203203 hibits the Secretary, after execution of the Agree-10
204204 ment, from approving any modification to the Agree-11
205205 ment, including an exhibit to the Agreement, that is 12
206206 consistent with this Act, to the extent that the modi-13
207207 fication does not otherwise require congressional ap-14
208208 proval under section 2116 of the Revised Statutes 15
209209 (25 U.S.C. 177) or any other applicable provision of 16
210210 Federal law. 17
211211 (c) E
212212 NVIRONMENTAL COMPLIANCE.— 18
213213 (1) I
214214 N GENERAL.—In implementing the Agree-19
215215 ment and this Act, the Secretary shall comply 20
216216 with— 21
217217 (A) the Endangered Species Act of 1973 22
218218 (16 U.S.C. 1531 et seq.); 23

224224 implementing regulations of that Act; and 3
225225 (C) all other applicable Federal environ-4
226226 mental laws and regulations. 5

228228 OMPLIANCE AND COORDINATION .— 6
229229 (A) I
230230 N GENERAL.—In implementing the 7
231231 Agreement and this Act, the Pueblo shall pre-8
232232 pare any necessary environmental documents 9
233233 consistent with— 10
234234 (i) the Endangered Species Act of 11
235235 1973 (16 U.S.C. 1531 et seq.); 12
236236 (ii) the National Environmental Policy 13
237237 Act of 1969 (42 U.S.C. 4321 et seq.), in-14
238238 cluding the implementing regulations of 15
239239 that Act; and 16
240240 (iii) all other applicable Federal envi-17
241241 ronmental laws and regulations. 18
242242 (B) A
243243 UTHORIZATIONS.—The Secretary 19
244244 shall— 20
245245 (i) independently evaluate the docu-21
246246 mentation required under subparagraph 22
247247 (A); and 23
248248 (ii) be responsible for the accuracy, 24
249249 scope, and contents of that documentation. 25

253253 (C) COORDINATION WITH ARMY CORPS OF 1
254254 ENGINEERS.—For any bosque restoration or 2
255255 improvement project carried out by the Pueblo 3
256256 with funds appropriated under this Act, the 4
257257 Pueblo shall coordinate with the Corps of Engi-5
258258 neers to ensure that work on the project shall 6
259259 not interfere with or adversely affect any au-7
260260 thorized Federal project that is under the juris-8
261261 diction and authority of the Corps of Engineers. 9
262262 (3) E
263263 FFECT OF EXECUTION .—The execution of 10
264264 the Agreement by the Secretary under this section 11
265265 shall not constitute a major Federal action under 12
266266 the National Environmental Policy Act of 1969 (42 13
267267 U.S.C. 4321 et seq.). 14
268268 (4) C
269269 OSTS.—Any costs associated with the per-15
270270 formance of the compliance and coordination activi-16
271271 ties under this subsection shall be paid from funds 17
272272 deposited in the Trust Fund, subject to the condi-18
273273 tion that any costs associated with the performance 19
274274 of Federal approval or other review of that compli-20
275275 ance work or costs associated with inherently Fed-21
276276 eral functions shall remain the responsibility of the 22
277277 Secretary, with the exception that costs for review of 23
278278 bosque restoration or improvement projects by the 24
279279 Corps of Engineers described in paragraph (2)(C) 25

289289 IGHTS.—The Pueblo Water Rights shall be held in trust 5
290290 by the United States on behalf of Ohkay Owingeh in ac-6
291291 cordance with the Agreement and this Act. 7

293293 ORFEITURE ANDABANDONMENT.— 8

295295 N GENERAL.—The Pueblo Water Rights 9
296296 shall not be subject to loss through non-use, for-10
297297 feiture, abandonment, or other operation of law. 11

299299 TATE LAW-BASED WATER RIGHTS .—State- 12
300300 law based water rights acquired by Ohkay Owingeh, 13
301301 or by the United States on behalf of Ohkay 14
302302 Owingeh, after the date for inclusion in the Partial 15
303303 Final Judgment and Decree, shall not be subject to 16
304304 forfeiture, abandonment, or permanent alienation 17
305305 from the time they are acquired. 18

307307 SE.—Any use of the Pueblo Water Rights shall 19
308308 be subject to the terms and conditions of the Agreement 20
309309 and this Act. 21

311311 UTHORITY OF THEPUEBLO.— 22

313313 N GENERAL.—Ohkay Owingeh may allo-23
314314 cate, distribute, and lease the Pueblo Water Rights 24
315315 for use on Pueblo Land in accordance with the 25

327327 allocate, distribute, and lease the Pueblo Water 7
328328 Rights for use off Pueblo Land in accordance 8
329329 with the Agreement, this Act, and applicable 9
330330 Federal law, subject to the approval of the Sec-10
331331 retary. 11

333333 AXIMUM TERM OF LEASES .—The 12
334334 maximum term of any lease, including all re-13
335335 newals, under this paragraph shall not exceed 14
336336 99 years. 15

340340 O ALIENATION.—The Pueblo shall not 17
341341 permanently alienate any portion of the Pueblo 18
342342 Water Rights. 19

344344 URCHASES OR GRANTS OF LAND FROM IN -20
345345 DIANS.—An authorization provided by this Act for 21
346346 the allocation, distribution, leasing, or other ar-22
347347 rangement entered into pursuant to this Act shall be 23
348348 considered to satisfy any requirement for authoriza-24
349349 tion of the action required by Federal law. 25

353353 (3) PROHIBITION ON FORFEITURE .—The non- 1
354354 use of all or any portion of the Pueblo Water Rights 2
355355 by any water user shall not result in the forfeiture, 3
356356 abandonment, relinquishment, or other loss of all or 4
357357 any portion of the Pueblo Water Rights. 5
358358 SEC. 6. SETTLEMENT TRUST FUND. 6
359359 (a) E
360360 STABLISHMENT.—The Secretary shall establish 7
361361 a trust fund, to be known as the ‘‘Ohkay Owingeh Water 8
362362 Rights Settlement Trust Fund’’, to be managed, invested, 9
363363 and distributed by the Secretary and to remain available 10
364364 until expended, withdrawn, or reverted to the general fund 11
365365 of the Treasury, consisting of the amounts deposited in 12
366366 the Trust Fund under subsection (b), together with any 13
367367 investment earnings, including interest, earned on those 14
368368 amounts for the purpose of carrying out this Act. 15

370370 EPOSITS.—The Secretary shall deposit in the 16
371371 Trust Fund the amounts made available pursuant to sec-17
372372 tion 7(a). 18

374374 ANAGEMENT AND INTEREST.— 19

376376 ANAGEMENT.—On receipt and deposit of 20
377377 funds into the Trust Fund under subsection (b), the 21
378378 Secretary shall manage, invest, and distribute all 22
379379 amounts in the Trust Fund in a manner that is con-23
380380 sistent with the investment authority of the Sec-24
381381 retary under— 25

392392 NVESTMENT EARNINGS .—In addition to 7
393393 the amounts deposited into the Trust Fund under 8
394394 subsection (b), any investment earnings, including 9
395395 interest, earned on those amounts held in the Trust 10
396396 Fund are authorized to be used in accordance with 11
397397 subsections (e) and (g). 12

399399 VAILABILITY OFAMOUNTS.— 13

401401 N GENERAL.—Amounts appropriated to, 14
402402 and deposited in, the Trust Fund, including any in-15
403403 vestment earnings (including interest) earned on 16
404404 those amounts, shall be made available to Ohkay 17
405405 Owingeh by the Secretary beginning on the Enforce-18
406406 ability Date, subject to the requirements of this sec-19
407407 tion, except for funds to be made available to Ohkay 20
408408 Owingeh pursuant to paragraph (2). 21

410410 SE OF FUNDS.—Notwithstanding para-22
411411 graph (1), not more than $100,000,000 of the 23
412412 amounts deposited in the Trust Fund, including any 24
413413 investment earnings, including interest, earned on 25

419419 amounts are deposited in the Trust Fund: 3
420420 (A) Diversions of surface water and 4
421421 groundwater to the Rio Chama bosque for im-5
422422 mediate and essential restoration and mainte-6
423423 nance of the bosque. 7
424424 (B) Fulfillment of the contribution of the 8
425425 Pueblo under the Agreement for improvements 9
426426 to senior acequias on Pueblo Land supplying 10
427427 water to the Pueblo and non-Indians. 11
428428 (C) Establishment and operation of the 12
429429 water rights management administrative de-13
430430 partment of the Pueblo. 14
431431 (D) Acquisition of water rights. 15
432432 (E) Development of water infrastructure 16
433433 plans, preparing environmental compliance doc-17
434434 uments, and water project engineering and con-18
435435 struction. 19
436436 (e) W
437437 ITHDRAWALS.— 20

439439 ITHDRAWALS UNDER THE AMERICAN IN -21
440440 DIAN TRUST FUND MANAGEMENT REFORM ACT OF 22

443443 N GENERAL.—The Pueblo may with-24
444444 draw any portion of the amounts in the Trust 25

454454 EQUIREMENTS.—In addition to the 6
455455 requirements under the American Indian Trust 7
456456 Fund Management Reform Act of 1994 (25 8
457457 U.S.C. 4001 et seq.), the Tribal management 9
458458 plan under subparagraph (A) shall require that 10
459459 the Pueblo shall spend all amounts withdrawn 11
460460 from the Trust Fund, and any investment earn-12
461461 ings (including interest) earned on those 13
462462 amounts through the investments under the 14
463463 Tribal management plan, in accordance with 15
464464 this Act. 16

466466 NFORCEMENT.—The Secretary may 17
467467 carry out such judicial and administrative ac-18
468468 tions as the Secretary determines to be nec-19
469469 essary to enforce the Tribal management plan 20

583583 over, and operation of any project constructed using funds 13
584584 from the Trust Fund shall remain in Ohkay Owingeh, ex-14
585585 cept that title to projects that are improved with funds 15
586586 from the Trust Fund for the mutual benefit of the Pueblo 16
587587 and non-Indians, on property owned by non-Indians, shall 17
588588 remain with the underlying non-Indian owner. 18

590590 PERATION, MAINTENANCE, ANDREPLACE-19
591591 MENT.—All operation, maintenance, and replacement 20
592592 costs of any project constructed using funds from the 21
593593 Trust Fund shall be the responsibility of Ohkay Owingeh. 22

620620 cost indices, as determined by the Secretary, includ-17
621621 ing repricing applicable to the types of construction 18

647647 (3) $500,000, to be deposited in an interest- 13
648648 bearing account, to mitigate impairment to non- 14
649649 Pueblo domestic and livestock groundwater rights as 15
650650 a result of new Pueblo water use. 16
651651 SEC. 8. ENFORCEABILITY DATE. 17
652652 The Enforceability Date shall be the date on which 18
653653 the Secretary publishes in the Federal Register a state-19

825825 (2) activities affecting the quality of water, in-18
826826 cluding claims under— 19
827827 (A) the Comprehensive Environmental Re-20
828828 sponse, Compensation, and Liability Act of 21

903903 subsection revives any claim or tolls any period of 11
904904 limitation or time-based equitable defense that ex-12
905905 pired before the date of enactment of this Act. 13

907907 IMITATION.—Nothing in this section pre-14
908908 cludes the tolling of any period of limitation or any 15
909909 time-based equitable defense under any other appli-16

924924 (2) CONSEQUENCES.—If this Act expires under 1

926926 (A) the waivers and releases under sub-3

930930 (B) the authorization, ratification, con-7
931931 firmation, and execution of the Agreement 8
932932 under section 4 shall no longer be effective; 9
933933 (C) any action carried out by the Sec-10
934934 retary, and any contract or agreement entered 11
935935 into, pursuant to this Act shall be void; 12
936936 (D) any unexpended Federal funds appro-13
937937 priated or made available to carry out the ac-14
938938 tivities authorized by this Act, together with 15
939939 any interest earned on those funds, and any 16
940940 water rights or contracts to use water and title 17
941941 to other property acquired or constructed with 18
942942 Federal funds appropriated or made available 19
943943 to carry out the activities authorized by this Act 20
944944 shall be returned to the Federal Government, 21
945945 unless otherwise agreed to by Ohkay Owingeh 22
946946 and the United States and approved by Con-23
947947 gress; and 24

959959 with any interest accrued on those funds, 9
960960 against any claims against the United States— 10

965965 (bb) any user of the Pueblo 15
966966 Water Rights; or 16
967967 (II) any other matter covered by 17
968968 subsection (b); or 18
969969 (ii) in any future settlement of water 19
970970 rights of Ohkay Owingeh. 20
971971 SEC. 10. SATISFACTION OF CLAIMS. 21
972972 The benefits provided under this Act shall be in com-22
973973 plete replacement of, complete substitution for, and full 23
974974 satisfaction of any claim of Ohkay Owingeh against the 24

989989 water right, or any claim or entitlement to land or water, 9

993993 FFECT ONCURRENTLAW.—Nothing in this Act 12
994994 affects any provision of law (including regulations) in ef-13
995995 fect on the day before the date of enactment of this Act 14
996996 with respect to pre-enforcement review of any Federal en-15
997997 vironmental enforcement action. 16

999999 ONFLICT.—In the event of a conflict between 17
10001000 the Agreement and this Act, this Act shall control. 18

10021002 OLDHARMLESS.—For any bosque restoration 19
10031003 or improvement project carried out by the Pueblo with 20
10041004 funds appropriated under this Act, the Pueblo shall hold 21
10051005 and save the United States free from damages due to the 22
10061006 construction or operation and maintenance of the project. 23
