Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Protecting American 4
Energy Production Act’’. 5
SEC. 2. PROTECTING AMERICAN ENERGY PRODUCTION. 6
(a) S
ENSE OFCONGRESS.—It is the sense of Con-7
gress that States should maintain primacy for the regula-8
tion of hydraulic fracturing for oil and natural gas produc-9
tion on State and private lands. 10

(b) PROHIBITION ONDECLARATION OF A MORATO-1
RIUM ON HYDRAULICFRACTURING.—Notwithstanding 2
any other provision of law, the President may not declare 3
a moratorium on the use of hydraulic fracturing unless 4
such moratorium is authorized by an Act of Congress. 5
