30	30	Be it enacted by the Senate and House of Representa-1
31	31	tives of the United States of America in Congress assembled, 2
32	32	SECTION 1. SHORT TITLE. 3
33	33	This Act may be cited as the ‘‘Nationwide Consumer 4
34	34	and Fuel Retailer Choice Act of 2025’’. 5

44	44	the Clean Air Act (42 U.S.C. 7545(f)(4)) is amend-5

46	46	(A) by striking ‘‘(4) The Administrator, 7
47	47	upon’’ and inserting the following: 8

71	71	‘‘(C) REID VAPOR PRESSURE .—A fuel or 1
72	72	fuel additive may be introduced into commerce 2
73	73	if— 3
74	74	‘‘(i)(I) the Administrator determines 4
75	75	that the fuel or fuel additive is substan-5
76	76	tially similar to a fuel or fuel additive uti-6
77	77	lized in the certification of any model year 7
78	78	vehicle pursuant to paragraph (1)(A); or 8
79	79	‘‘(II) the fuel or fuel additive has been 9
80	80	granted a waiver under subparagraph (A) 10
81	81	and meets all of the conditions of that 11
82	82	waiver other than any limitation of the 12
83	83	waiver with respect to the Reid Vapor 13
84	84	Pressure of the fuel or fuel additive; and 14
85	85	‘‘(ii) the fuel or fuel additive meets all 15
86	86	other applicable Reid Vapor Pressure re-16
87	87	quirements under subsection (h).’’. 17

90	90	tion 211(h) of the Clean Air Act (42 U.S.C. 19
91	91	7545(h)) is amended— 20
92	92	(A) by striking ‘‘vapor pressure’’ each 21
93	93	place it appears and inserting ‘‘Vapor Pres-22

115	115	of a State was submitted before the date 18
116	116	of enactment of the Nationwide Consumer 19
117	117	and Fuel Retailer Choice Act of 2025 and 20
118	118	to which the Administrator applied the 21
119	119	Reid Vapor Pressure limitation established 22
120	120	by paragraph (1) shall instead have the 23
121	121	Reid Vapor Pressure limitation established 24
122	122	by paragraph (4) apply to all fuel blends 25

135	135	tion 211(o)(9) of the Clean Air Act (42 U.S.C. 9
136	136	7545(o)(9)) is amended by adding at the end the fol-10
137	137	lowing: 11
138	138	‘‘(E) C
139	139	REDITS GENERATED FOR 2016 –2018 12
140	140	COMPLIANCE YEARS.— 13
141	141	‘‘(i) R
142	142	ULE.—For any small refinery 14
143	143	described in clause (ii) or (iii), the credits 15
144	144	described in the respective clause shall 16
145	145	be— 17
146	146	‘‘(I) returned to the small refin-18
147	147	ery and, notwithstanding paragraph 19
148	148	(5)(C), deemed eligible for future 20
149	149	compliance years; or 21
150	150	‘‘(II) applied as a credit in the 22
151	151	EPA Moderated Transaction System 23
152	152	(EMTS) account of the small refinery. 24

157	157	2017.—Clause (i) applies with respect to 2
158	158	any small refinery that— 3
159	159	‘‘(I) retired credits generated for 4
160	160	compliance years 2016 or 2017; and 5
161	161	‘‘(II) submitted a petition under 6
162	162	subparagraph (B)(i) for that compli-7
163	163	ance year that remained outstanding 8
164	164	as of December 1, 2022. 9
165	165	‘‘(iii) C
166	166	OMPLIANCE YEAR 2018 .—In 10
167	167	addition to small refineries described in 11
168	168	clause (ii), clause (i) applies with respect 12
169	169	to any small refinery— 13
170	170	‘‘(I) that submitted a petition 14
171	171	under subparagraph (B)(i) for compli-15
172	172	ance year 2018 by September 1, 16
173	173	2019; 17
174	174	‘‘(II) that retired credits gen-18
175	175	erated for compliance year 2018 as 19
176	176	part of the compliance demonstration 20
177	177	of the small refinery for compliance 21
178	178	year 2018 by March 31, 2019; and 22
179	179	‘‘(III) for which— 23
