To amend the Research and Development, Competition, and
Innovation Act to place certain restrictions on members
and activities of the Foundation for Energy Security
and Innovation of the Department of Energy, and for
other purposes.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘America First Energy 4
Act’’. 5

SEC. 2. FOUNDATION FOR ENERGY SECURITY AND INNOVA-1
TION OF THE DEPARTMENT OF ENERGY. 2
Section 10691 of the Research and Development, 3
Competition, and Innovation Act (42 U.S.C. 19281; en-4
acted as part of division B of Public Law 117–167) is 5
amended— 6
(1) in subsection (b)— 7
(A) in paragraph (2), by amending sub-8
paragraph (I) to read as follows: 9
‘‘(I) R
ESTRICTIONS ON MEMBERSHIP .— 10
‘‘(i) E
MPLOYEES.—No employee of 11
the Department may be appointed as a 12
voting member of the Board. 13
‘‘(ii) S
TATUS.—Each voting member 14
of the Board shall be— 15
‘‘(I) a citizen of the United 16
States; 17
‘‘(II) a national of the United 18
States (as such term is defined in sec-19
tion 101(a) of the Immigration and 20
Nationality Act (8 U.S.C. 1101(a)); 21
‘‘(III) an alien admitted as a ref-22
ugee under section 207 of such Act (8 23
U.S.C. 1157); or 24

‘‘(IV) an alien lawfully admitted 1
to the United States for permanent 2
residence.’’; and 3
(B) in paragraph (5), by adding at the end 4
the following new subparagraph: 5

ESTRICTIONS.— 6
‘‘(i) E
XECUTIVE DIRECTOR.—The Ex-7
ecutive Director shall be— 8
‘‘(I) a citizen of the United 9
States; 10
‘‘(II) a national of the United 11
States (as such term is defined in sec-12
tion 101(a) of the Immigration and 13
Nationality Act (8 U.S.C. 1101(a)); 14
‘‘(III) an alien admitted as a ref-15
ugee under section 207 of such Act (8 16
U.S.C. 1157); or 17
‘‘(IV) an alien lawfully admitted 18
to the United States for permanent 19
residence. 20
‘‘(ii) O
FFICERS AND EMPLOYEES .— 21
Each officer or employee of the Founda-22
tion shall be— 23
‘‘(I) a citizen of the United 24

(2) by adding at the end the following new sub-11
section: 12
‘‘(d) S
ECURITY.—This section shall be carried out in 13
accordance with the provisions of subtitle D of this title 14
and section 223 of the William M. (Mac) Thornberry Na-15
tional Defense Authorization Act for Fiscal Year 2021 (42 16
U.S.C. 6605).’’. 17
