1717 Be it enacted by the Senate and House of Representa-1
1818 tives of the United States of America in Congress assembled, 2
1919 SECTION 1. SAN FRANCISCO BAY RESTORATION PROGRAM. 3
2020 Section 125 of the Federal Water Pollution Control 4
2121 Act (33 U.S.C. 1276a) is amended— 5
2222 (1) in the section heading, by striking 6
2323 ‘‘
2424 GRANT’’; and 7
2525 (2) by amending subsection (e) to read as fol-8

3232 N GENERAL.—The Director may provide 2
3333 funding through cooperative agreements, grants, 3
3434 interagency agreements, contracts, or other funding 4
3535 mechanisms to Federal, State, and local agencies, 5
3636 special districts, public or nonprofit agencies, and 6
3737 other public or private entities, institutions, and or-7
3838 ganizations, including the Estuary Partnership, for 8
3939 projects, activities, and studies identified on the an-9
4040 nual priority list compiled under subsection (c). 10

4545 AXIMUM AMOUNT .—Amounts pro-13
4646 vided in the form of a grant, under a coopera-14
4747 tive agreement, or through other funding mech-15
4848 anisms to any non-Federal entity under this 16
4949 section for a fiscal year shall not exceed an 17
5050 amount equal to 75 percent of the total cost of 18
5151 any projects, activities, and studies that are to 19
5252 be carried out using those amounts. 20

5454 ON-FEDERAL SHARE .—Not less 21
5555 than 25 percent of the cost of any project, ac-22
5656 tivity, or study carried out using amounts pro-23
5757 vided in the form of a grant, under a coopera-24
5858 tive agreement, or through other funding mech-25

6565 IMITATIONS ON NON-FEDERAL RE-3
6666 CIPIENTS.—No non-Federal entity may receive 4
6767 Federal funding under this section if that enti-5

6969 ‘‘(i) is domiciled in, headquartered in, 7
7070 organized under the laws of, or whose prin-8
7171 cipal place of business is located in a for-9
7272 eign country of concern (as defined in 42 10
7373 U.S.C. 19237); or 11
7474 ‘‘(ii) has in place any agreement, part-12
7575 nership, or relationship with a foreign 13
7676 country of concern. 14

7878 EDERAL INTERAGENCY AGREEMENTS .— 15
7979 Amounts provided to Federal agencies entities under 16
8080 interagency agreements under this section may be 17
8181 used to carry out activities described in subsection 18
