14	14	To amend the Federal Water Pollution Control Act with
15	15	respect to San Francisco Bay restoration, and for other
16	16	purposes.
17	17	Be it enacted by the Senate and House of Representa-1
18	18	tives of the United States of America in Congress assembled, 2
19	19	SECTION 1. SAN FRANCISCO BAY RESTORATION PROGRAM. 3
20	20	Section 125 of the Federal Water Pollution Control 4
21	21	Act (33 U.S.C. 1276a) is amended— 5
22	22	(1) in the section heading, by striking 6
23	23	‘‘
24	24	GRANT’’; and 7
25	25	(2) by amending subsection (e) to read as fol-8
26	26	lows: 9

30	30	‘‘(e) PROGRAMIMPLEMENTATION.— 1
31	31	‘‘(1) I
32	32	N GENERAL.—The Director may provide 2
33	33	funding through cooperative agreements, grants, 3
34	34	interagency agreements, contracts, or other funding 4
35	35	mechanisms to Federal, State, and local agencies, 5
36	36	special districts, public or nonprofit agencies, and 6
37	37	other public or private entities, institutions, and or-7
38	38	ganizations, including the Estuary Partnership, for 8
39	39	projects, activities, and studies identified on the an-9
40	40	nual priority list compiled under subsection (c). 10
41	41	‘‘(2) A
42	42	GREEMENTS WITH NON -FEDERAL ENTI-11
43	43	TIES.— 12
44	44	‘‘(A) M
45	45	AXIMUM AMOUNT .—Amounts pro-13
46	46	vided in the form of a grant, under a coopera-14
47	47	tive agreement, or through other funding mech-15
48	48	anisms to any non-Federal entity under this 16
49	49	section for a fiscal year shall not exceed an 17
50	50	amount equal to 75 percent of the total cost of 18
51	51	any projects, activities, and studies that are to 19
52	52	be carried out using those amounts. 20
53	53	‘‘(B) N
54	54	ON-FEDERAL SHARE .—Not less 21
55	55	than 25 percent of the cost of any project, ac-22
56	56	tivity, or study carried out using amounts pro-23
57	57	vided in the form of a grant, under a coopera-24
58	58	tive agreement, or through other funding mech-25

64	64	‘‘(C) L
65	65	IMITATIONS ON NON-FEDERAL RE-3
66	66	CIPIENTS.—No non-Federal entity may receive 4
67	67	Federal funding under this section if that enti-5
68	68	ty— 6
69	69	‘‘(i) is domiciled in, headquartered in, 7
70	70	organized under the laws of, or whose prin-8
71	71	cipal place of business is located in a for-9
72	72	eign country of concern (as defined in 42 10
73	73	U.S.C. 19237); or 11
74	74	‘‘(ii) has in place any agreement, part-12
75	75	nership, or relationship with a foreign 13
76	76	country of concern. 14

78	78	EDERAL INTERAGENCY AGREEMENTS .— 15
79	79	Amounts provided to Federal agencies entities under 16
80	80	interagency agreements under this section may be 17
81	81	used to carry out activities described in subsection 18
82	82	(c).’’. 19
