2525 UTHORITY.—Notwithstanding section 46502 of 5
2626 title 49, United States Code, sections 32, 1030, 1367, and 6
2727 chapters 119 and 206 of title 18, United States Code, or 7
2828 section 705 of the Communications Act of 1934, the Sec-8

3636 assets, to take, such actions described in subsection (b)(1) 5
3737 that are necessary to mitigate a credible threat (as defined 6
3838 by the Secretary of State, in consultation with the Federal 7
3939 Aviation Administration) that an unmanned aircraft sys-8
4040 tem or unmanned aircraft poses to the safety or security 9
4141 of a covered facility or asset. 10

4343 CTIONSDESCRIBED.— 11
4444 (1) I
4545 N GENERAL.—The actions described in this 12
4646 paragraph are the following: 13
4747 (A) During the operation of the unmanned 14
4848 aircraft system, detect, identify, monitor, and 15
4949 track the unmanned aircraft system or un-16
5050 manned aircraft, without prior consent, includ-17
5151 ing by means of intercept or other access of a 18
5252 wire communication, an oral communication, or 19
5353 an electronic communication used to control the 20
5454 unmanned aircraft system or unmanned air-21
5555 craft. 22
5656 (B) Warn the operator of the unmanned 23
5757 aircraft system or unmanned aircraft, including 24
5858 by passive or active, and direct or indirect phys-25

9494 termine its capability and utility prior to the 3
9595 use of any such technology for any action de-4
9696 scribed in paragraph (1). Personnel, including 5
9797 contractors, who do not have duties that include 6
9898 the safety, security, or protection of people, fa-7
9999 cilities, or assets may engage in research, test-8
100100 ing, training, and evaluation activities pursuant 9
101101 to this section. 10

103103 OORDINATION.—The Secretary shall 11
104104 coordinate procedures governing research, test-12
105105 ing, training, and evaluation for carrying out 13
106106 any provision in this section with the Adminis-14
107107 trator of the Federal Aviation Administration 15
108108 before initiating such activities so the Adminis-16
109109 trator may ensure the activities do not ad-17
110110 versely impact or interfere with safe airport op-18
111111 erations, navigation, air traffic services, or the 19
112112 safe and efficient operation of the national air-20
113113 space system. 21

115115 ORFEITURE.—Any unmanned aircraft system or 22
116116 unmanned aircraft described in subsection (a) that is 23
117117 seized by the Secretary of State is subject to forfeiture 24

124124 EGULATIONS AND GUIDANCE.—The Secretary 3
125125 of State and the Secretary of Transportation, in consulta-4
126126 tion with the Assistant Secretary of Commerce for Com-5
127127 munications and Information of the National Tele-6
128128 communications and Information Administration, may 7
129129 prescribe regulations and shall issue guidance in the re-8
130130 spective areas of each Secretary to carry out this section. 9

132132 OORDINATION.— 10

134134 N GENERAL.—The Secretary of State shall 11
135135 develop the actions described in subsection (b)(1) in 12
136136 coordination with the Secretary of Transportation 13
137137 (through the Administrator of the Federal Aviation 14
138138 Administration), and the Assistant Secretary of 15
139139 Commerce for Communications and Information of 16
140140 the National Telecommunications and Information 17
141141 Administration. 18

143143 URTHER COORDINATION .—The Secretary 19
144144 of State shall coordinate with the Administrator of 20
145145 the Federal Aviation Administration prior to any ac-21
146146 tion authorized by this section so the Administrator 22
147147 may ensure the action does not adversely impact or 23
148148 interfere with safe airport operations, navigation, air 24

155155 URTHER COORDINATION .—The Secretary 3
156156 of State shall coordinate the development of guid-4
157157 ance and regulations under subsection (d) with the 5
158158 Federal Aviation Administration, the Federal Com-6
159159 munications Commission, and the National Tele-7
160160 communications and Information Administration. 8
161161 (4) F
162162 URTHER COORDINATION .—Before issuing 9
163163 any guidance under subsection (d), or otherwise im-10
164164 plementing this section, the Secretary of State shall 11
165165 coordinate with the Administrator of the Federal 12
166166 Aviation Administration to ensure such guidance or 13
167167 implementation is designed to preserve safe airport 14
168168 operations, navigation, air traffic services, and the 15
169169 safe and efficient operation of the national airspace 16
170170 system. 17

172172 RIVACYPROTECTION.—The regulations pre-18
173173 scribed or guidance issued under subsection (d) shall en-19
174174 sure that— 20
175175 (1) the interception or acquisition of, access to, 21
176176 or maintenance or use of communications to or from 22
177177 an unmanned aircraft system under this section is 23
178178 conducted in a manner consistent with the First and 24

183183 cable provisions of Federal law; 2
184184 (2) communications to or from an unmanned 3
185185 aircraft system are intercepted, acquired, or accessed 4
186186 only to the extent necessary to support the actions 5
187187 described in subsection (b); 6
188188 (3) records of such communications are main-7
189189 tained only for as long as necessary, and in no event 8
190190 more than 180 days, unless the Secretary of State 9
191191 determines that maintenance of such records— 10
192192 (A) is necessary to investigate or assist in 11
193193 the prosecution of a violation of law; 12
194194 (B) is necessary to directly support an on-13
195195 going security, law enforcement, or national de-14
196196 fense operations; or 15
197197 (C) is required under Federal statue, regu-16
198198 lation, or for the purpose of litigation; and 17
199199 (4) such communications are not disclosed out-18
200200 side the Department of State unless the disclosure— 19
201201 (A) is necessary to investigate or assist in 20
202202 the prosecution of a violation of law; 21
203203 (B) would support the Department of De-22
204204 fense, a Federal law enforcement, intelligence, 23
205205 or security agency, or a State, local, tribal, or 24
206206 territorial law enforcement agency; 25

211211 ties of a regulatory agency of the Federal Gov-2
212212 ernment in connection with a criminal or civil 3
213213 investigation of, or any regulatory, statutory, or 4
214214 other enforcement action relating to, an action 5
215215 described in subsection (b); 6
216216 (D) is between the Department of State 7
217217 and a Federal, State, local, tribal, or territorial 8
218218 law enforcement agency in the course of a secu-9
219219 rity or protection operation of either agency or 10
220220 a joint operations of such agencies; or 11
221221 (E) is otherwise required by law. 12
222222 (g) B
223223 UDGET.—The Secretary of State shall submit 13
224224 to Congress, as a part of the budget presentation docu-14
225225 ments for each fiscal year following the enactment of this 15
226226 provision, a consolidated funding display that identifies 16
227227 the funding source for the actions described in subsection 17
228228 (b)(1) within the Department of State. The funding dis-18
229229 play shall be in unclassified form but may contain a classi-19
230230 fied annex. 20

232232 SSISTANCE ANDSUPPORT.— 21
233233 (1) F
234234 ACILITIES AND SERVICES OF OTHER 22
235235 AGENCIES AND NON -FEDERAL ENTITIES.—The Sec-23
236236 retary is authorized to use, solicit, or accept from 24
237237 any other Federal agency, or any other public or pri-25

241241 vate entity, supplies, services, or funds to facilitate 1
242242 or take the actions provided for in subsection (b). 2
243243 The Secretary may use, solicit, or accept such sup-3
244244 plies, services, or funds with or without reimburse-4
245245 ment and notwithstanding any provision of law that 5
246246 would prevent such use or acceptance. The Secretary 6
247247 in implementing subsection (l)(3)(C) may enter into 7
248248 agreements with other executive agencies and with 8
249249 appropriate officials of other non-Federal public or 9
250250 private agencies or entities, as may be necessary and 10
251251 proper to carry out their responsibilities under this 11
252252 section. 12
253253 (2) M
254254 UTUAL SUPPORT.—The Secretary is au-13
255255 thorized to provide support or assistance, upon the 14
256256 request of an agency or department conducting a 15
257257 mission specified in section 210G of the Homeland 16
258258 Security Act of 2002 (6 U.S.C. 124n), section 130i 17
259259 of title 10, United States Code, or section 4510 of 18
260260 the Atomic Energy Defense Act (50 U.S.C. 2661), 19
261261 in fulfilling the requesting agency’s or department’s 20
262262 roles and responsibilities for that mission, when exi-21
263263 gent circumstances exist, limited to a specified time-22
264264 frame and location, within available resources, on a 23
265265 reimbursable or non-reimbursable basis, in coordina-24
266266 tion with the Federal Aviation Administration. 25

270270 (i) SEMIANNUALBRIEFINGS.— 1

272272 N GENERAL.—On a semiannual basis be-2
273273 ginning six months following the enactment of this 3
274274 provision during the seven-year period beginning 4
275275 upon enactment of this provision, the Secretary of 5
276276 State and the Secretary of Transportation shall 6
277277 jointly provide a briefing to the appropriate congres-7
278278 sional committees on the activities carried out pursu-8
279279 ant to this section. Such briefings shall include a de-9
280280 scription of— 10
281281 (A) policies, programs, and procedures to 11
282282 mitigate or eliminate impacts of such activities 12
283283 to the National Airspace System; 13
284284 (B) instances where actions described in 14
285285 subsection (b)(1) have been taken; 15
286286 (C) the guidance, policies, or procedures 16
287287 established to address privacy, civil rights, and 17
288288 civil liberties issues implicated by the actions 18
289289 authorized under this section and any changes 19
290290 or subsequent efforts that would significantly 20
291291 affect privacy, civil rights, or civil liberties; 21
292292 (D) how the Secretaries have informed the 22
293293 public as to the possible use of authorities 23
294294 under this section; 24

300300 cies to implement and use such authorities; and 3
301301 (F) a description of the impact of the au-4
302302 thorities granted under this section on lawful 5
303303 operator access to national airspace and UAS 6
304304 integration into the national airspace system. 7

306306 ORM.—Each briefing under paragraph (1) 8
307307 shall be in unclassified form but may be accom-9
308308 panied by an additional classified briefing. 10
309309 (j) R
310310 ULE OFCONSTRUCTION.—Nothing in this sec-11
311311 tion may be construed to— 12
312312 (1) vest in the Secretary of State any authority 13
313313 of the Secretary of Transportation or the Adminis-14
314314 trator of the Federal Aviation Administration under 15
315315 title 49, United States Code; and 16
316316 (2) vest in the Secretary of Transportation or 17
317317 the Administrator of the Federal Aviation Adminis-18
318318 tration any authority of the Secretary of State. 19
319319 (k) T
320320 ERMINATION.—The authority provided by sub-20
321321 section (a) shall terminate on the date that is 7 years after 21
322322 the enactment of this Act. 22

324324 EFINITIONS.—In this section— 23
325325 (1) the term ‘‘appropriate congressional com-24
326326 mittees’’ means— 25

344344 tion 1105(a) of title 31, United States Code; 15
345345 (3) the term ‘‘covered facility or asset’’ means 16
346346 any facility or asset that— 17
347347 (A) is identified as high-risk and a poten-18
348348 tial target for unlawful unmanned aircraft ac-19
349349 tivity by the Secretary of State, in coordination 20
350350 with the Federal Aviation Administration, with 21
351351 respect to potentially impacted airspace, 22
352352 through a risk-based assessment for purposes of 23
353353 this section; 24

360360 (C) directly relates to the security and pro-4
361361 tective missions of the Department of State, in-5
362362 cluding those consistent with— 6
363363 (i) the Omnibus Diplomatic Security 7
364364 and Antiterrorism Act of 1986 (22 U.S.C. 8
365365 4801, et seq.); and 9
366366 (ii) section 37 of the State Depart-10
367367 ment Basic Authorities Act of 1956 (22 11
368368 U.S.C. 2709); and 12
369369 (D) when fulfilling personal protection re-13
370370 sponsibilities consistent with 22 U.S.C. 14
371371 4802(a)(1)(D), 4802(a)(2)(B)(vii), 4802 15
372372 (a)(2)(B)(viii), and 2709(a)(3), is limited to a 16
373373 specified timeframe at a static location; 17
374374 (4) the terms ‘‘electronic communication’’, 18
375375 ‘‘intercept’’, ‘‘oral communication’’, and ‘‘wire com-19
376376 munication’’ have the meanings given those terms in 20
377377 section 2510 of title 18, United States Code; 21
378378 (5) the term ‘‘personnel’’— 22
379379 (A) means officers, employees, and con-23
380380 tractors of the Department of State with as-24
381381 signed duties that include safety, security, or 25

388388 unmanned aircraft threats and mitigating risks 4
389389 in the national airspace; and 5
390390 (B) includes contractors conducting oper-6
391391 ations under subsections (a) and (b) if the con-7
392392 tractors are— 8
393393 (i) directly contracted by the Depart-9
394394 ment of State; 10
395395 (ii) operating at a government owned 11
396396 or government leased facility; 12
397397 (iii) not conducting inherently govern-13
398398 mental functions; and 14
399399 (iv) trained and certified by the De-15
400400 partment of State as meeting established 16
401401 Department guidance and regulations; 17
402402 (6) the term ‘‘risk-based assessment’’ includes 18
403403 an evaluation of threat information specific to a cov-19
404404 ered facility or asset and, with respect to potential 20
405405 impacts on the safety and efficiency of the national 21
406406 airspace system and the needs of law enforcement 22
407407 and national security at each covered facility or 23
408408 asset identified by the Secretary, of each of the fol-24
409409 lowing factors: 25

414414 and use of the national airspace system, includ-2
415415 ing potential effects on manned aircraft and un-3
416416 manned aircraft 30 systems, aviation safety, 4
417417 airport operations, infrastructure, and air navi-5
418418 gation services related to the use of any system 6
419419 or technology for carrying out the actions de-7
420420 scribed in subsection (b)(1). 8
421421 (B) Options for mitigating any identified 9
422422 impacts to the national airspace system related 10
423423 to the use of any system or technology, includ-11
424424 ing minimizing when possible the use of any 12
425425 technology which disrupts the transmission of 13
426426 radio or electronic signals, for carrying out the 14
427427 actions described in subsection (b)(1). 15
428428 (C) Potential consequences of the impacts 16
429429 of any actions taken under subsection (b)(l) to 17
430430 the national airspace system and infrastructure 18
431431 if not mitigated. 19
432432 (D) The ability to provide reasonable ad-20
433433 vance notice to aircraft operators consistent 21
434434 with the safety of the national airspace system 22
435435 and the needs of law enforcement and national 23
436436 security. 24

441441 ered facility or asset, including whether it is lo-2
442442 cated in a populated area or near other struc-3
443443 tures, whether the facility is open to the public, 4
444444 whether the facility is also used for nongovern-5
445445 mental functions, and any potential for inter-6
446446 ference with wireless communications or for in-7
447447 jury or damage to persons or property. 8
448448 (F) Potential consequences to national se-9
449449 curity, public safety, or law enforcement if 10
450450 threats posed by unmanned aircraft systems are 11
451451 not mitigated or resolved; and 12
452452 (7) the terms ‘‘unmanned aircraft’’ and ‘‘un-13
453453 manned aircraft system’’ have the meanings given 14
454454 those terms in section 44801 of title 49, United 15
455455 States Code. 16
