19	19	To amend title XVIII of the Social Security Act to authorize
20	20	the coverage of additional lung cancer screening tests
21	21	under the Medicare program.
22	22	Be it enacted by the Senate and House of Representa-1
23	23	tives of the United States of America in Congress assembled, 2
24	24	SECTION 1. SHORT TITLE. 3
25	25	This Act may be cited as the ‘‘Lung Cancer Screen-4
26	26	ing and Prevention Act of 2025’’. 5

30	30	SEC. 2. AUTHORITY TO EXPAND COVERAGE OF TESTS FOR 1
31	31	LUNG CANCER SCREENING UNDER THE 2
32	32	MEDICARE PROGRAM. 3
33	33	(a) I
34	34	NGENERAL.—Section 1834(n) of the Social Se-4
35	35	curity Act (42 U.S.C. 1395m(n)) is amended— 5
36	36	(1) by redesignating subparagraphs (A) and 6
37	37	(B) of paragraph (1) as clauses (i) and (ii), respec-7
38	38	tively, with appropriate indentation; 8
39	39	(2) by redesignating paragraphs (1) and (2) as 9
40	40	subparagraphs (A) and (B), respectively, with appro-10
41	41	priate indentation; 11
42	42	(3) by striking ‘‘Notwithstanding any other pro-12
43	43	vision of this title’’ and inserting: 13
44	44	‘‘(1) I
45	45	N GENERAL.—Notwithstanding any other 14
46	46	provision of this title and subject to paragraph (2)’’; 15
47	47	and 16
48	48	(4) by adding at the end the following new 17
49	49	paragraph: 18

51	51	UTHORITY TO COVER NEW LUNG CANCER 19
52	52	SCREENING TESTS AS PREVENTIVE SERVICES .— 20
53	53	‘‘(A) I
54	54	N GENERAL.—Notwithstanding para-21
55	55	graph (1), in addition to preventive services 22
56	56	consisting of screening tests for the early detec-23
57	57	tion of lung cancer covered under this part pur-24
58	58	suant to national coverage determination 25
59	59	210.14, the Secretary may provide for coverage 26

64	64	tests that are cleared or approved by the Food 2
65	65	and Drug Administration as preventive services 3
66	66	when furnished to appropriate individuals (as 4
67	67	determined by the Secretary), with such fre-5
68	68	quency and payment limits as the Secretary de-6
69	69	termines appropriate in consultation with ap-7
70	70	propriate organizations. 8
71	71	‘‘(B) U
72	72	SE OF NATIONAL COVERAGE DE -9
73	73	TERMINATION PROCESS .— 10
74	74	‘‘(i) I
75	75	N GENERAL.—Coverage of other 11
76	76	lung cancer screening tests under subpara-12
77	77	graph (A) shall be determined using the 13
78	78	process for making national coverage de-14
79	79	terminations (as defined in section 15
80	80	1869(f)(1)(B)), except that there shall be 16
81	81	no requirement for a determination under 17
82	82	section 1861(ddd)(3)(B) with respect to 18
83	83	such test under such process. 19
84	84	‘‘(ii) R
85	85	ULE OF CONSTRUCTION .— 20
86	86	Nothing in clause (i) shall be construed as 21
87	87	preventing the Secretary from considering 22
88	88	recommendations made by entities with ex-23
89	89	pertise in preventive services, including en-24
90	90	tities convened by the Secretary or the Di-25

96	96	lung cancer screening tests described in 3
97	97	subparagraph (A).’’. 4

99	99	FFECTIVEDATE.—The amendments made by 5
100	100	subsection (a) shall take effect on the date of the enact-6
101	101	ment of this Act, and apply with respect to coverage of 7
102	102	preventive services under Part B of title XVIII of the So-8
103	103	cial Security Act (42 U.S.C. 1395j et seq.) on or after 9
104	104	such date. 10
