3131 STABLISHMENT.—Section 113(b)(3) of the Pub-3
3232 lic Utility Regulatory Policies Act of 1978 (16 U.S.C. 4
3333 2623(b)) is amended to read as follows: 5

3535 NFORMATION TO CONSUMERS .—Each 6
3636 electric utility shall transmit to each of its electric 7
3737 consumers information regarding rate schedules and 8
3838 consumption of electric energy in accordance with 9
3939 the requirements of section 115(f).’’. 10

4242 tion 115(f) of the Public Utility Regulatory Policies Act 12
4343 of 1978 (16 U.S.C. 2625) is amended by adding at the 13

4848 ROGRAM.—For purposes of the 16
4949 standard for information to consumers estab-17
5050 lished by section 113(b)(3), each covered elec-18
5151 tric utility shall establish a program under 19
5252 which such covered electric utility shall transmit 20
5353 information in accordance with this paragraph. 21

5757 clude in each billing to an electric consumer of 24

7070 SAGE NOTICES.—A covered electric 8
7171 utility shall notify an electric consumer infor-9
7272 mation relating to the average daily consump-10
7373 tion of electric energy by such electric consumer 11
7474 in the following manner: 12
7575 ‘‘(i) If within the first 9 days of a bill-13
7676 ing period the average daily consumption 14
7777 of electric energy by an electric consumer 15
7878 exceeds the average daily consumption of 16
7979 electric energy for the previous billing pe-17
8080 riod, the relevant covered electric utility 18
8181 shall notify such electric consumer on the 19
8282 10th day of the billing period of the excess 20
8383 consumption. 21
8484 ‘‘(ii) If within the first 19 days of a 22
8585 billing period, or within another date an 23
8686 electric consumer chooses, the average 24
8787 daily consumption of electric energy by 25

9292 daily consumption of electric energy for the 2
9393 previous billing period, the relevant covered 3
9494 electric utility shall notify such electric 4
9595 consumer on the 20th day, or the day after 5
9696 the date on which the electric consumer 6
9797 chooses, of the excess consumption. 7
9898 ‘‘(D) O
9999 PTIONAL NOTICE.—Under the pro-8
100100 gram established pursuant to subparagraph 9
101101 (A), a covered electric utility shall provide an 10
102102 option to each electric consumer to be notified 11
103103 by the covered electric utility in the event the 12
104104 electric consumer, within an active billing pe-13
105105 riod, reaches a dollar amount— 14
106106 ‘‘(i) that is based on the rate charged 15
107107 by a covered electric utility for providing 16
108108 electric service; 17
109109 ‘‘(ii) that reflects the amount of elec-18
110110 tric energy consumed within the active bill-19
111111 ing period; and 20
112112 ‘‘(iii) chosen by such electric con-21
113113 sumer. 22

115115 OVERED ELECTRIC UTILITY DE -23
116116 FINED.—In this paragraph, the term ‘covered 24
117117 electric utility’ means an electric utility that re-25

127127 3203(b)) is amended by adding at the end the following: 6

129129 NFORMATION TO CONSUMERS .—Each gas 7
130130 utility shall transmit to each of its gas consumers in-8
131131 formation relating to the consumption of gas in ac-9
132132 cordance with section 304(c).’’. 10

134134 NFORMATION TO GASCONSUMERS.—Section 11
135135 304 of the Public Utility Regulatory Policies Act of 1978 12
136136 (15 U.S.C. 3204) is amended by adding at the end the 13

160160 tion of gas by such gas consumer in the fol-8
161161 lowing manner: 9
162162 ‘‘(i) If within the first 9 days of a bill-10
163163 ing period the average daily consumption 11
164164 of gas by a gas consumer exceeds the aver-12
165165 age daily consumption of gas for the pre-13
166166 vious billing period, the relevant covered 14
167167 gas utility shall notify such gas consumer 15
168168 on the 10th day of the billing period about 16
169169 such exceedance. 17
170170 ‘‘(ii) If within the first 19 days of a 18
171171 billing period, or within another date a gas 19
172172 consumer chooses, the average daily con-20
173173 sumption of gas by such gas consumer ex-21
174174 ceeds the average daily consumption of gas 22
175175 for the previous billing period, the relevant 23
176176 covered gas utility shall notify such gas 24
177177 consumer on the 20th day, or the day after 25

187187 to be notified by the covered electric utility in the 6
188188 event the gas consumer, within an active billing pe-7
189189 riod, reaches a dollar amount— 8
190190 ‘‘(A) that is based on the rate charged by 9
191191 a covered gas utility for providing gas service; 10
192192 ‘‘(B) that reflects the amount of gas con-11
193193 sumed within the active billing period; and 12
194194 ‘‘(C) chosen by such gas consumer. 13
195195 ‘‘(3) C
196196 OVERED GAS UTILITY DEFINED .—The 14
197197 term ‘covered gas utility’ means a gas utility that re-15
198198 ceives funding from Federal sources, as determined 16
199199 by the Commission.’’. 17
