17	17	electric and gas utilities to transmit to each of its con-
18	18	sumers information regarding the consumption of electric
19	19	energy or gas, and for other purposes.
20	20	Be it enacted by the Senate and House of Representa-1
21	21	tives of the United States of America in Congress assembled, 2
22	22	SECTION 1. SHORT TITLE. 3
23	23	This Act may be cited as the ‘‘Know Your Rates 4
24	24	Act’’. 5

31	31	STABLISHMENT.—Section 113(b)(3) of the Pub-3
32	32	lic Utility Regulatory Policies Act of 1978 (16 U.S.C. 4
33	33	2623(b)) is amended to read as follows: 5
34	34	‘‘(3) I
35	35	NFORMATION TO CONSUMERS .—Each 6
36	36	electric utility shall transmit to each of its electric 7
37	37	consumers information regarding rate schedules and 8
38	38	consumption of electric energy in accordance with 9
39	39	the requirements of section 115(f).’’. 10

41	41	NFORMATION TO ELECTRICCONSUMERS.—Sec-11
42	42	tion 115(f) of the Public Utility Regulatory Policies Act 12
43	43	of 1978 (16 U.S.C. 2625) is amended by adding at the 13
44	44	end the following: 14
45	45	‘‘(4) A
46	46	DDITIONAL INFORMATION .— 15
47	47	‘‘(A) P
48	48	ROGRAM.—For purposes of the 16
49	49	standard for information to consumers estab-17
50	50	lished by section 113(b)(3), each covered elec-18
51	51	tric utility shall establish a program under 19
52	52	which such covered electric utility shall transmit 20
53	53	information in accordance with this paragraph. 21

55	55	DDITIONAL BILLING INFORMA -22
56	56	TION.—Each covered electric utility shall in-23
57	57	clude in each billing to an electric consumer of 24
58	58	the covered electric utility— 25

63	63	amount charged in the billing and the dol-2
64	64	lar amount charged in the previous billing 3
65	65	period; and 4
66	66	‘‘(ii) in dollars and in kilowatt hours, 5
67	67	the average monthly consumption of elec-6
68	68	tric energy by such electric consumer. 7
69	69	‘‘(C) U
70	70	SAGE NOTICES.—A covered electric 8
71	71	utility shall notify an electric consumer infor-9
72	72	mation relating to the average daily consump-10
73	73	tion of electric energy by such electric consumer 11
74	74	in the following manner: 12
75	75	‘‘(i) If within the first 9 days of a bill-13
76	76	ing period the average daily consumption 14
77	77	of electric energy by an electric consumer 15
78	78	exceeds the average daily consumption of 16
79	79	electric energy for the previous billing pe-17
80	80	riod, the relevant covered electric utility 18
81	81	shall notify such electric consumer on the 19
82	82	10th day of the billing period of the excess 20
83	83	consumption. 21
84	84	‘‘(ii) If within the first 19 days of a 22
85	85	billing period, or within another date an 23
86	86	electric consumer chooses, the average 24
87	87	daily consumption of electric energy by 25

91	91	such electric consumer exceeds the average 1
92	92	daily consumption of electric energy for the 2
93	93	previous billing period, the relevant covered 3
94	94	electric utility shall notify such electric 4
95	95	consumer on the 20th day, or the day after 5
96	96	the date on which the electric consumer 6
97	97	chooses, of the excess consumption. 7
98	98	‘‘(D) O
99	99	PTIONAL NOTICE.—Under the pro-8
100	100	gram established pursuant to subparagraph 9
101	101	(A), a covered electric utility shall provide an 10
102	102	option to each electric consumer to be notified 11
103	103	by the covered electric utility in the event the 12
104	104	electric consumer, within an active billing pe-13
105	105	riod, reaches a dollar amount— 14
106	106	‘‘(i) that is based on the rate charged 15
107	107	by a covered electric utility for providing 16
108	108	electric service; 17
109	109	‘‘(ii) that reflects the amount of elec-18
110	110	tric energy consumed within the active bill-19
111	111	ing period; and 20
112	112	‘‘(iii) chosen by such electric con-21
113	113	sumer. 22
114	114	‘‘(E) C
115	115	OVERED ELECTRIC UTILITY DE -23
116	116	FINED.—In this paragraph, the term ‘covered 24
117	117	electric utility’ means an electric utility that re-25

125	125	STABLISHMENT.—Section 303(b) of the Public 4
126	126	Utility Regulatory Policies Act of 1978 (15 U.S.C. 5
127	127	3203(b)) is amended by adding at the end the following: 6
128	128	‘‘(7) I
129	129	NFORMATION TO CONSUMERS .—Each gas 7
130	130	utility shall transmit to each of its gas consumers in-8
131	131	formation relating to the consumption of gas in ac-9
132	132	cordance with section 304(c).’’. 10

134	134	NFORMATION TO GASCONSUMERS.—Section 11
135	135	304 of the Public Utility Regulatory Policies Act of 1978 12
136	136	(15 U.S.C. 3204) is amended by adding at the end the 13
137	137	following: 14
138	138	‘‘(c) I
139	139	NFORMATION TOCONSUMERS.— 15

141	141	ROGRAM.—For purposes of the standard 16
142	142	for information to consumers established by section 17
143	143	303(b)(c), each covered gas utility shall establish a 18
144	144	program under which such covered gas utility 19
145	145	shall— 20
146	146	‘‘(A) in each billing to a gas consumer of 21
147	147	the covered gas utility, include— 22
148	148	‘‘(i) the difference between the dollar 23
149	149	amount charged in the billing and the dol-24

156	156	age monthly consumption of gas by such 4
157	157	gas consumer; and 5
158	158	‘‘(B) notify each such gas consumer infor-6
159	159	mation relating to the average daily consump-7
160	160	tion of gas by such gas consumer in the fol-8
161	161	lowing manner: 9
162	162	‘‘(i) If within the first 9 days of a bill-10
163	163	ing period the average daily consumption 11
164	164	of gas by a gas consumer exceeds the aver-12
165	165	age daily consumption of gas for the pre-13
166	166	vious billing period, the relevant covered 14
167	167	gas utility shall notify such gas consumer 15
168	168	on the 10th day of the billing period about 16
169	169	such exceedance. 17
170	170	‘‘(ii) If within the first 19 days of a 18
171	171	billing period, or within another date a gas 19
172	172	consumer chooses, the average daily con-20
173	173	sumption of gas by such gas consumer ex-21
174	174	ceeds the average daily consumption of gas 22
175	175	for the previous billing period, the relevant 23
176	176	covered gas utility shall notify such gas 24
177	177	consumer on the 20th day, or the day after 25

184	184	PTIONAL NOTICE.—Under the program 3
185	185	established pursuant to paragraph (1), a covered gas 4
186	186	utility shall provide an option to each gas consumer 5
187	187	to be notified by the covered electric utility in the 6
188	188	event the gas consumer, within an active billing pe-7
189	189	riod, reaches a dollar amount— 8
190	190	‘‘(A) that is based on the rate charged by 9
191	191	a covered gas utility for providing gas service; 10
192	192	‘‘(B) that reflects the amount of gas con-11
193	193	sumed within the active billing period; and 12
194	194	‘‘(C) chosen by such gas consumer. 13

196	196	OVERED GAS UTILITY DEFINED .—The 14
197	197	term ‘covered gas utility’ means a gas utility that re-15
198	198	ceives funding from Federal sources, as determined 16
199	199	by the Commission.’’. 17
