18	18	To amend the Indian Health Care Improvement Act to ad-
19	19	dress liability for payment of charges or costs associated
20	20	with provision of purchased/referred care services, and
21	21	for other purposes.
22	22	Be it enacted by the Senate and House of Representa-1
23	23	tives of the United States of America in Congress assembled, 2
24	24	SECTION 1. SHORT TITLE. 3
25	25	This Act may be cited as the ‘‘Purchased and Re-4
26	26	ferred Care Improvement Act of 2025’’. 5

30	30	SEC. 2. CHANGES TO LIABILITY FOR PAYMENT. 1
31	31	(a) I
32	32	NGENERAL.—Section 222 of the Indian Health 2
33	33	Care Improvement Act (25 U.S.C. 1621u) is amended— 3
34	34	(1) in subsection (a)— 4
35	35	(A) by striking ‘‘A patient’’ and inserting 5
36	36	‘‘Notwithstanding any other provision of law or 6
37	37	any agreement, form, or other written or elec-7
38	38	tronic document signed by a patient, a patient’’; 8
39	39	and 9
40	40	(B) by striking ‘‘contract health care’’ and 10
41	41	inserting ‘‘purchased/referred care’’; 11
42	42	(2) in subsection (b)— 12
43	43	(A) by striking ‘‘contract care’’ each place 13
44	44	it appears and inserting ‘‘purchased/referred 14
45	45	care’’; 15
46	46	(B) by striking ‘‘contract health care’’ and 16
47	47	inserting ‘‘purchased/referred care’’; 17
48	48	(C) by inserting ‘‘, notwithstanding any 18
49	49	other provision of law or any agreement, form, 19
50	50	or other written or electronic document signed 20
51	51	by a patient,’’ after ‘‘by the Service that’’; and 21
52	52	(D) by inserting ‘‘to any provider, debt col-22
53	53	lector, or any other person’’ after ‘‘is not lia-23
54	54	ble’’; 24

58	58	(3) in subsection (c), by inserting ‘‘, the debt 1
59	59	collector, or any other person, as applicable’’ after 2
60	60	‘‘the provider’’; and 3
61	61	(4) by adding at the end the following: 4
62	62	‘‘(d) R
63	63	EIMBURSEMENT.— 5
64	64	‘‘(1) I
65	65	N GENERAL.—Not later than 120 days 6
66	66	after the date of the enactment of this subsection 7
67	67	and in consultation with Indian Tribes, the Sec-8
68	68	retary shall establish and implement procedures to 9
69	69	allow a patient that paid out-of-pocket for pur-10
70	70	chased/referred care services authorized by the Serv-11
71	71	ice under this Act to be reimbursed by the Service 12
72	72	for that payment not later than 30 days after the 13
73	73	patient submits documentation to the Service pursu-14
74	74	ant to paragraph (2). 15
75	75	‘‘(2) S
76	76	UBMITTING DOCUMENTATION .—The Sec-16
77	77	retary shall accept documentation from a patient 17
78	78	seeking reimbursement under paragraph (1) that 18
79	79	was submitted— 19
80	80	‘‘(A) electronically; or 20
81	81	‘‘(B) in-person at a Service facility. 21
82	82	‘‘(3) E
83	83	FFECT.—The preceding provisions of this 22
84	84	subsection shall not apply to purchased/referred care 23
85	85	service furnished under a purchased/referred care 24
86	86	services program operated by an Indian Tribe under 25

90	90	an Indian Self-Determination and Education Assist-1
91	91	ance Act (25 U.S.C. 5301 et seq.) compact or con-2
92	92	tract unless expressly agreed to by the Indian Tribe. 3
93	93	‘‘(e) U
94	94	PDATINGAUTHORITIES.—Not later than 180 4
95	95	days of the enactment of this subsection and in consulta-5
96	96	tion with Indian Tribes, the Secretary shall update appli-6
97	97	cable provisions of and exhibits to the Indian Health Man-7
98	98	ual, contracts with providers, and other relevant docu-8
99	99	ments and administrative authorities to incorporate the 9
100	100	provisions of this section.’’. 10

102	102	PPLICATION.—The amendments made by this 11
103	103	section shall apply to purchased/referred care services au-12
104	104	thorized by the Indian Health Service furnished on, be-13
105	105	fore, or after the date of the enactment of this Act. 14
106	106	SEC. 3. TECHNICAL AMENDMENTS. 15
107	107	(a) D
108	108	EFINITIONS.—Section 4(5) of the Indian Health 16
109	109	Care Improvement Act (25 U.S.C. 1603) is amended by 17
110	110	striking the paragraph designation and heading and all 18
111	111	that follows through ‘‘means’’ and inserting the following: 19
112	112	‘‘(5) P
113	113	URCHASED/REFERRED CARE.—The term 20
114	114	‘purchased/referred care’ means’’. 21

116	116	ECHNICALAMENDMENTS.—The Indian Health 22
117	117	Care Improvement Act (25 U.S.C. 1601 et seq.) is amend-23
118	118	ed by striking ‘‘contract health service’’ each place it ap-24
119	119	pears (regardless of casing and typeface and including in 25

127	127	Health and Human Services is directed to ensure that the 4
128	128	Indian Health Manual and all other relevant rules, guid-5
129	129	ance, manuals, and other materials are revised such that 6
130	130	‘‘contract health service’’, each place it appears (regard-7
131	131	less of casing and typeface and including in the headings) 8
132	132	is revised to read ‘‘purchased/referred care’’ (with appro-9
133	133	priate casing and typeface). 10
