29	29	Be it enacted by the Senate and House of Representa-1
30	30	tives of the United States of America in Congress assembled, 2
31	31	SECTION 1. SHORT TITLE. 3
32	32	This Act may be cited as the ‘‘Make American Flags 4
33	33	in America Act of 2025’’. 5

43	43	of title 4, United States Code, is amended by adding at 5
44	44	the end the following: 6
45	45	‘‘§ 11. Display on Federal property; procurement by 7
46	46	Federal agencies 8
47	47	‘‘(a) D
48	48	ISPLAY ONFEDERALPROPERTY.—A Federal 9
49	49	agency may not display a flag of the United States on 10
50	50	Federal property unless such flag has been made in the 11
51	51	United States. 12
52	52	‘‘(b) P
53	53	ROCUREMENT BY FEDERALAGENCIES.— 13
54	54	Funds appropriated or otherwise made available to a Fed-14
55	55	eral agency may not be used for the procurement of a flag 15
56	56	of the United States unless such flag has been made in 16
57	57	the United States. 17
58	58	‘‘(c) I
59	59	NTERNATIONAL AGREEMENTS.—This section 18
60	60	shall be applied in a manner consistent with the obliga-19
61	61	tions of the United States under international agreements. 20

63	63	ULE OFCONSTRUCTION.—Nothing in this sec-21
64	64	tion may be construed to apply to the display or procure-22
65	65	ment of a flag of the United States by a private actor. 23

67	67	EFINITIONS.—In this section: 24
68	68	‘‘(1) F
69	69	EDERAL AGENCY .—The term ‘Federal 25
70	70	agency’ means— 26

75	75	‘‘(B) a military department; 2
76	76	‘‘(C) an office, agency, or other establish-3
77	77	ment in the legislative branch; 4
78	78	‘‘(D) an office, agency, or other establish-5
79	79	ment in the judicial branch; 6
80	80	‘‘(E) the Government of the District of Co-7
81	81	lumbia; and 8
82	82	‘‘(F) Government controlled corporations. 9

84	84	EDERAL PROPERTY .—The term ‘Federal 10
85	85	property’ means real property owned, leased, or oc-11
86	86	cupied by a Federal agency or an instrumentality 12
87	87	wholly owned by the United States. 13
88	88	‘‘(3) M
89	89	ADE IN THE UNITED STATES .—The term 14
90	90	‘made in the United States’ means 100 percent 15
91	91	manufactured in the United States from articles, 16
92	92	materials, or supplies that have been 100 percent 17
93	93	produced or manufactured in the United States. 18
94	94	‘‘(4) U
95	95	NITED STATES.—The term ‘United 19
96	96	States’, when used in a geographic sense, includes 20
97	97	each of the several States, the District of Columbia, 21
98	98	Tribal lands, and the territories or possessions of the 22
99	99	United States.’’. 23

103	103	(b) CLERICALAMENDMENT.—The table of sections 1
104	104	at the beginning of such chapter is amended by adding 2
105	105	at the end the following: 3
106	106	‘‘11. Display on Federal property; procurement by Federal agencies.’’.
107	107	(c) APPLICABILITY.—Section 11 of title 4, United 4
108	108	States Code, as added by subsection (a), shall apply— 5
109	109	(1) with respect to the display of a flag of the 6
110	110	United States by a Federal agency, on and after the 7
111	111	date that is 2 years after the date of the enactment 8
112	112	of this Act; and 9
113	113	(2) with respect to the procurement of a flag of 10
114	114	the United States by a Federal agency, on and after 11
115	115	the date that is 90 days after the date of the enact-12
116	116	ment of this Act. 13
117	117	SEC. 3. STUDY ON COUNTRY-OF-ORIGIN LABELING FOR 14
118	118	FLAGS OF THE UNITED STATES. 15
119	119	(a) S
120	120	TUDY.—The Chair of the Federal Trade Com-16
121	121	mission shall conduct a study that— 17
122	122	(1) assesses and describes the enforcement 18
123	123	scheme for country-of-origin labeling for flags of the 19
124	124	United States; 20
125	125	(2) determines how many fines or penalties, if 21
126	126	any, have been imposed for violations of such en-22
127	127	forcement scheme; and 23
128	128	(3) identifies the percentage of violations of 24
129	129	such enforcement scheme that are subsequent viola-25

134	134	been found to have violated such scheme. 2
135	135	(b) R
136	136	EPORT.—Not later than 1 year after the date 3
137	137	of the enactment of this Act, the Chair of the Federal 4
138	138	Trade Commission shall submit to the Committee on En-5
139	139	ergy and Commerce of the House of Representatives and 6
140	140	the Committee on Commerce, Science, and Transportation 7
141	141	of the Senate a report containing— 8
142	142	(1) the results of the study conducted under 9
143	143	subsection (a); and 10
144	144	(2) any recommendations to improve— 11
145	145	(A) the enforcement scheme for country-of- 12
146	146	origin labeling for flags of the United States; 13
147	147	and 14
148	148	(B) the deterrent effect of such scheme. 15
