122122 (B) the United States, acting as trustee 17

124124 (2) to authorize, ratify, and confirm the Agree-19
125125 ment entered into by the Tribe, the State, and var-20
126126 ious other parties to the extent that the Agreement 21

143143 tled ‘‘United States v. A&R Production, et al.’’, Civil 10
144144 No. 01–CV–00072, including the subproceeding Civil 11
145145 No. 07–CV–00681, pending as of the date of enact-12
146146 ment of this Act in the United States District Court 13
147147 for the District of New Mexico. 14

149149 GREEMENT.—The term ‘‘Agreement’’ 15

151151 (A) the document entitled ‘‘Settlement 17
152152 Agreement to Quantify and Protect the Water 18

213213 the land withdrawn from sale and set apart as a res-18
214214 ervation or in trust for the use and occupancy of the 19

240240 SEC. 103. RATIFICATION OF AGREEMENT. 17

244244 N GENERAL.—Except as modified by this 19
245245 title, and to the extent that the Agreement does not 20
246246 conflict with this title, the Agreement is authorized, 21
247247 ratified, and confirmed. 22

249249 MENDMENTS.—If an amendment to the 23
250250 Agreement, or to any attachment to the Agreement 24
251251 requiring the signature of the Secretary, is executed 25

261261 N GENERAL.—To the extent the Agreement 5
262262 does not conflict with this title, the Secretary shall 6
263263 execute the Agreement, including all attachments to 7
264264 or parts of the Agreement, requiring the signature 8
265265 of the Secretary. 9
266266 (2) M
267267 ODIFICATIONS.—Nothing in this title pro-10
268268 hibits the Secretary, after execution of the Agree-11
269269 ment, from approving any modification to the Agree-12
270270 ment, including an attachment to the Agreement, 13
271271 that is consistent with this title, to the extent that 14
272272 the modification does not otherwise require congres-15
273273 sional approval under section 2116 of the Revised 16
274274 Statutes (25 U.S.C. 177) or any other applicable 17
275275 Federal law. 18
276276 (c) E
277277 NVIRONMENTAL COMPLIANCE.— 19

279279 N GENERAL.—In implementing the Agree-20
280280 ment and this title, the Secretary shall comply 21
281281 with— 22
282282 (A) the Endangered Species Act of 1973 23
283283 (16 U.S.C. 1531 et seq.); 24

293293 OMPLIANCE.— 6

295295 N GENERAL.—In implementing the 7
296296 Agreement and this title, the Tribe shall pre-8
297297 pare any necessary environmental documents, 9
298298 consistent with— 10
299299 (i) the Endangered Species Act of 11
300300 1973 (16 U.S.C. 1531 et seq.); 12
301301 (ii) the National Environmental Policy 13
302302 Act of 1969 (42 U.S.C. 4321 et seq.), in-14
303303 cluding the implementing regulations of 15
304304 that Act; and 16
305305 (iii) all other applicable Federal envi-17
306306 ronmental laws and regulations. 18
307307 (B) A
308308 UTHORIZATIONS.—The Secretary 19
309309 shall— 20
310310 (i) independently evaluate the docu-21
311311 mentation required under subparagraph 22
312312 (A); and 23
313313 (ii) be responsible for the accuracy, 24
314314 scope, and contents of that documentation. 25

319319 the Agreement by the Secretary under this section 2
320320 shall not constitute a major Federal action under 3
321321 the National Environmental Policy Act of 1969 (42 4
322322 U.S.C. 4321 et seq.). 5

324324 OSTS.—Any costs associated with the per-6
325325 formance of the compliance activities under this sub-7
326326 section shall be paid from funds deposited in the 8
327327 Trust Fund, subject to the condition that any costs 9
328328 associated with the performance of Federal approval 10
329329 or other review of such compliance work or costs as-11
330330 sociated with inherently Federal functions shall re-12
331331 main the responsibility of the Secretary. 13
332332 SEC. 104. TRIBAL WATER RIGHTS. 14

334334 RUSTSTATUS OF THE TRIBALWATER 15

336336 IGHTS.—The Tribal Water Rights shall be held in trust 16
337337 by the United States on behalf of the Tribe, in accordance 17
338338 with the Agreement and this title. 18

340340 ORFEITURE ANDABANDONMENT.— 19

342342 N GENERAL.—The Tribal Water Rights 20
343343 shall not be subject to loss through non-use, for-21
344344 feiture, abandonment, or other operation of law. 22

346346 TATE-LAW BASED WATER RIGHTS .—State- 23
347347 law based water rights acquired by the Tribe, or by 24
348348 the United States on behalf of the Tribe, after the 25

357357 SE.—Any use of the Tribal Water Rights shall 5
358358 be subject to the terms and conditions of the Agreement 6
359359 and this title. 7

361361 LLOTMENT RIGHTSNOTINCLUDED.—The 8
362362 Tribal Water Rights do not include any water rights for 9
363363 an Allotment. 10
364364 (e) A
365365 LLOTTEESNOTADVERSELYAFFECTED.— 11
366366 Nothing in this title quantifies or diminishes any water 12
367367 right, or any claim or entitlement to water, of an Allottee. 13
368368 (f) A
369369 CCOUNTING FOR ALLOTMENTUSES.—Any use 14
370370 of water on an Allotment shall be accounted for out of 15
371371 the Tribal Water Rights recognized in the Agreement, in-16
372372 cluding recognition of— 17
373373 (1) any water use existing on an Allotment as 18
374374 of the date of enactment of this Act; 19
375375 (2) reasonable domestic, stock, and irrigation 20
376376 water uses put into use on an Allotment; and 21
377377 (3) any water right decreed to the United 22
378378 States in trust for an Allottee in the Adjudication 23
379379 for use on an Allotment. 24

384384 object in the Adjudication to the quantification of reason-2
385385 able domestic, stock, and irrigation water uses on an Allot-3
386386 ment, and shall administer any water use on Zuni Lands 4
387387 in accordance with applicable Federal law, including rec-5
388388 ognition of— 6
389389 (1) any water use existing on an Allotment as 7
390390 of the date of enactment of this Act; 8
391391 (2) reasonable domestic, stock, and irrigation 9
392392 water uses on an Allotment; and 10
393393 (3) any water right decreed to the United 11
394394 States in trust for an Allottee in the Adjudication. 12

396396 UTHORITY OF THETRIBE.— 13

398398 N GENERAL.—The Tribe shall have the au-14
399399 thority to allocate, distribute, and lease the Tribal 15
400400 Water Rights for use on Zuni Lands in accordance 16
401401 with the Agreement, this title, and applicable Fed-17
402402 eral law, including the first section of the Act of Au-18
403403 gust 9, 1955 (69 Stat. 539, chapter 615; 25 U.S.C. 19
404404 415) (commonly known as the ‘‘Long-Term Leasing 20
405405 Act’’). 21

407407 SE OFF ZUNI LANDS.— 22

409409 N GENERAL.—The Tribe may allo-23
410410 cate, distribute, and lease the Tribal Water 24
411411 Rights for use off Zuni Lands in accordance 25

419419 AXIMUM TERM .—The maximum 4
420420 term of any lease, including all renewals, under 5
421421 this paragraph shall not exceed 99 years. 6

423423 DMINISTRATION.— 7

425425 O ALIENATION.—The Tribe shall not per-8
426426 manently alienate any portion of the Tribal Water 9
427427 Rights. 10

429429 URCHASES OR GRANTS OF LAND FROM IN -11
430430 DIANS.—An authorization provided by this title for 12
431431 the allocation, distribution, leasing, or other ar-13
432432 rangement entered into pursuant to this title shall 14
433433 be considered to satisfy any requirement for author-15
434434 ization of the action required by Federal law. 16

436436 ROHIBITION ON FORFEITURE .—The non- 17
437437 use of all or any portion of the Tribal Water Rights 18
438438 by any water user shall not result in the forfeiture, 19
439439 abandonment, relinquishment, or other loss of all or 20
440440 any portion of the Tribal Water Rights. 21
441441 SEC. 105. SETTLEMENT TRUST FUND. 22
442442 (a) E
443443 STABLISHMENT.—The Secretary shall establish 23
444444 a trust fund, to be known as the ‘‘Zuni Tribe Settlement 24
445445 Trust Fund’’, to be managed, invested, and distributed by 25

453453 ings, including interest, earned on those amounts, for the 5
454454 purpose of carrying out this title. 6

456456 RUSTFUNDACCOUNTS.—The Secretary shall 7
457457 establish in the Trust Fund the following accounts: 8
458458 (1) The Zuni Tribe Water Rights Settlement 9
459459 Trust Account. 10
460460 (2) The Zuni Tribe Operation, Maintenance, & 11
461461 Replacement Trust Account. 12

463463 EPOSITS.—The Secretary shall deposit in the 13
464464 Trust Fund the amounts made available under section 14
465465 106(a). 15

467467 ANAGEMENT AND INTEREST.— 16
