4141 This Act may be cited as the ‘‘Energy Resilient Com-2
4242 munities Act’’. 3
4343 SEC. 2. CLEAN ENERGY MICROGRID GRANT PROGRAM. 4
4444 (a) I
4545 NGENERAL.—The Secretary of Energy shall es-5
4646 tablish and carry out a program to provide grants to eligi-6
4747 ble entities. 7
4848 (b) U
4949 SE OFFUNDS.—An eligible entity may use a 8
5050 grant provided under the program established pursuant to 9
5151 subsection (a) to— 10
5252 (1) obtain technical assistance to— 11
5353 (A) upgrade building codes and standards 12
5454 for resiliency to climate change hazards (includ-13
5555 ing wildfires, flooding, sea level rise, landslides, 14
5656 drought, storms, temperature extremes, and 15
5757 other extreme weather events); 16
5858 (B) develop a FEMA Hazard Mitigation 17
5959 Plan to identify and overcome known climate 18
6060 change hazards to critical community infra-19
6161 structure; or 20
6262 (C) conduct a needs assessment of prospec-21
6363 tive clean energy microgrid projects and, as ap-22
6464 plicable, design prospective clean energy 23
6565 microgrids, including assistance to address per-24
6666 mitting and siting challenges, understand and 25
6767 facilitate financing options, and understand the 26

8585 N GENERAL.—In providing grants under 13
8686 the program established pursuant to subsection (a), 14
8787 the Secretary of Energy shall give priority to an eli-15
8888 gible entity that proposes to use a grant to obtain 16
8989 technical assistance described in subsection (b)(1), 17
9090 provide outreach described in subsection (b)(2), or 18
9191 carry out a project described in subsection (b)(3), 19
9292 that will benefit an environmental justice commu-20

9696 OUTREACH GRANTS .—After priority given under 23
9797 paragraph (1), in providing grants to obtain tech-24
9898 nical assistance described in subsection (b)(1) or 25

105105 provide outreach that the Secretary of Energy deter-4
106106 mines will further the development of clean energy 5
107107 microgrids that are community-owned energy sys-6
108108 tems. 7

110110 LEAN ENERGY MICROGRID GRANTS .—After 8
111111 priority given under paragraph (1), in providing 9
112112 grants under the program established pursuant to 10
113113 subsection (a) for projects described in subsection 11
114114 (b)(3), the Secretary of Energy shall give priority to 12
115115 an eligible entity that— 13
116116 (A) proposes to develop and construct a 14
117117 clean energy microgrid that, in comparison to 15
118118 other clean energy microgrids for which grants 16
119119 are sought under such program, will result in 17
120120 the greatest reduction— 18
121121 (i) of greenhouse gas emissions; 19
122122 (ii) of emissions of criteria air pollut-20
123123 ants; 21
124124 (iii) in public health disparities in 22
125125 communities experiencing a dispropor-23
126126 tionate level of air pollution; or 24

136136 clean energy microgrid that, in comparison to 7
137137 other clean energy microgrids for which grants 8
138138 are sought under such program, will provide the 9
139139 greatest amount of resiliency benefits to a juris-10
140140 diction in which the microgrid is located; 11
141141 (D) proposes to develop and construct a 12
142142 clean energy microgrid that minimizes land use 13
143143 impacts by— 14
144144 (i) siting sources of clean energy with-15
145145 in the already-built environment, including 16
146146 over rooftops and parking lots; 17
147147 (ii) siting sources of clean energy on 18
148148 existing brownfield sites or contaminated 19
149149 sites; 20
150150 (iii) co-locating sources of clean en-21
151151 ergy on agricultural lands or over res-22
152152 ervoirs; or 23
153153 (iv) siting sources of clean energy on 24
154154 compatible lands; 25

159159 structing a clean energy microgrid, utilize or in-2
160160 volve small businesses or nonprofits that pri-3
161161 marily operate or are located within environ-4
162162 mental justice communities, particularly those 5
163163 that are women-owned and operated or minor-6
164164 ity-owned and operated; 7
165165 (F) has previously received a grant to ob-8
166166 tain technical assistance under such program; 9
167167 (G) imposes registered apprentice utiliza-10
168168 tion requirements on projects, provided that 11
169169 such requirements comply with the apprentice 12
170170 to journey worker ratios established by the De-13
171171 partment of Labor or the applicable State Ap-14
172172 prenticeship Agency; or 15
173173 (H) proposes to develop and construct a 16
174174 clean energy microgrid in an area designated 17
175175 nonattainment and classified as an Extreme 18
176176 Area or Severe Area for one or more criteria air 19
177177 pollutants. 20

179179 DUCATIONALOUTREACHPROGRAM.— 21

181181 N GENERAL.—Not later than 90 days after 22
182182 funds are made available to carry out this section, 23
183183 the Secretary of Energy shall develop and carry out 24
184184 an educational outreach program to inform eligible 25

191191 ONTRACTS.—The Secretary of Energy 3
192192 may enter into third-party contracts to implement 4
193193 the educational outreach program under paragraph 5
194194 (1). In entering into contracts pursuant to this para-6
195195 graph, the Secretary shall prioritize entering into 7
196196 contracts with women-owned and operated or minor-8
197197 ity-owned and operated entities. 9

199199 RIORITY.—The educational outreach pro-10
200200 gram under paragraph (1) shall prioritize— 11
201201 (A) providing information on the program 12
202202 established pursuant to subsection (a) to eligi-13
203203 ble entities that serve an environmental justice 14
204204 community and to environmental justice com-15
205205 munities; and 16
206206 (B) promoting public understanding of the 17
207207 community benefits of clean energy microgrids 18
208208 for critical community infrastructure. 19

212212 N GENERAL.—Except as provided in para-21
213213 graph (2), the Federal share of the cost of technical 22
214214 assistance, outreach, or a project for which a grant 23
215215 is provided pursuant to the program established pur-24

222222 NVIRONMENTAL JUSTICE COMMUNITY .— 3
223223 The Federal share of the cost of technical assistance 4
224224 that is obtained for, outreach that is provided to, or 5
225225 a project that is carried out in, an environmental 6
226226 justice community, and for which a grant is provided 7
227227 pursuant to the program established pursuant to 8
228228 subsection (a) shall not exceed 90 percent of such 9
229229 cost. 10

231231 IMITATION ON AMOUNT.—The amount of a 11
232232 grant provided to an eligible entity under this section to 12
233233 carry out a project described in subsection (b)(3) may not 13
234234 exceed $10,000,000. 14

236236 SE OFAMERICANIRON, STEEL, ANDMANUFAC-15
237237 TUREDGOODS.— 16
238238 (1) No funds authorized under this section shall 17
239239 be made available with respect to a project unless all 18
240240 of the iron, steel, and manufactured goods used in 19
241241 the project are produced in the United States. 20
242242 (2) Paragraph (1) shall not apply in any case 21
243243 or category of cases in which the Secretary of En-22
244244 ergy finds that— 23
245245 (A) applying paragraph (1) would be in-24
246246 consistent with the public interest; 25

251251 tured goods are not produced in the United 2
252252 States in sufficient and reasonably available 3
253253 quantities and of a satisfactory quality; or 4
254254 (C) inclusion of iron, steel, and manufac-5
255255 tured goods produced in the United States will 6
256256 increase the cost of the overall project by more 7
257257 than 25 percent. 8
258258 (3) If the Secretary of Energy receives a re-9
259259 quest for a waiver under this subsection, the Sec-10
260260 retary shall make available to the public on an infor-11
261261 mal basis a copy of the request and information 12
262262 available to the Secretary concerning the request, 13
263263 and shall allow for informal public input on the re-14
264264 quest for at least 15 days prior to making a finding 15
265265 based on the request. The Secretary shall make the 16
266266 request and accompanying information available by 17
267267 electronic means, including on the official public 18
268268 website of the Department of Energy. 19
269269 (4) This subsection shall be applied in a man-20
270270 ner consistent with the United States obligations 21
271271 under international agreements. 22

273273 REVAILINGWAGES.—All laborers and mechan-23
274274 ics employed by contractors or subcontractors in the per-24
275275 formance of construction, alteration, or repair work as-25

280280 shall be paid wages at rates not less than those prevailing 2
281281 on similar construction in the locality as determined by 3
282282 the Secretary of Labor in accordance with subchapter IV 4
283283 of chapter 31 of title 40, United States Code. With respect 5
284284 to the labor standards in this subsection, the Secretary 6
285285 of Labor shall have the authority and functions set forth 7
286286 in Reorganization Plan Numbered 14 of 1950 (64 Stat. 8
287287 1267; 5 U.S.C. App.) and section 3145 of title 40, United 9
288288 States Code. 10
289289 (i) P
290290 ROJECTLABOR.—An eligible entity that uses a 11
291291 grant provided under this section to construct a clean en-12
292292 ergy microgrid shall ensure, to the greatest extent prac-13
293293 ticable, that any subgrantee of such eligible entity, and 14
294294 any subgrantee thereof, that carries out such construction 15
295295 employs at least 40 percent of laborers or mechanics for 16
296296 such construction that are individuals who— 17
297297 (1) are domiciled, if the applicable construction 18
298298 area is— 19
299299 (A) a major urban area, not further than 20
300300 15 miles from such construction area; or 21
301301 (B) not a major urban area, not further 22
302302 than 50 miles from such construction area; 23
303303 (2) are displaced and unemployed energy work-24
304304 ers; 25

314314 in a diversion scheme; 7
315315 (5) have a disability; 8
316316 (6) are homeless; 9
317317 (7) are receiving public assistance; 10
318318 (8) lack a general education diploma or high 11
319319 school diploma; 12
320320 (9) are emancipated from the foster care sys-13
321321 tem; 14
322322 (10) reside or work in an environmental justice 15
323323 community; or 16
324324 (11) are registered apprentices with fewer than 17
325325 15 percent of the required graduating apprentice 18
326326 hours in a program. 19

328328 EPORTS.—The Secretary of Energy shall submit 20
329329 to Congress, and make available on the public website of 21
330330 the Department of Energy, an annual report on the pro-22
331331 gram established pursuant to subsection (a) that includes, 23
332332 with respect to the previous year— 24
333333 (1) the number of grants provided; 25

350350 (A) employment data for such project, in-14
351351 cluding the number of jobs created and what 15
352352 percent of laborers and mechanics hired for 16
353353 such project meet the criteria under subsection 17
354354 (i); 18
355355 (B) the greenhouse gas and criteria air 19
356356 pollutant reduction impacts for such project; 20
357357 (C) the public health benefits from such 21
358358 project; and 22
359359 (D) the reduced energy cost burden from 23
360360 such project. 24

406406 geothermal, existing hydropower, micro-hydropower, 7
407407 hydrokinetic, or hydrogen fuel cells. 8

409409 OMMUNITY OF COLOR .—The term ‘‘com-9
410410 munity of color’’ means a geographically distinct 10
411411 area in which the population of any of the following 11
412412 categories of individuals is higher than the average 12
413413 populations of that category for the State in which 13
414414 the community is located: 14
415415 (A) Black. 15
416416 (B) African American. 16
417417 (C) Asian. 17
418418 (D) Pacific Islander. 18
419419 (E) Other non-White race. 19
420420 (F) Non-White Hispanic. 20

425425 The term ‘‘community-owned energy system’’ means 24

445445 The term ‘‘critical community infrastructure’’ means 14
446446 infrastructure that is necessary to providing vital 15
447447 community and individual functions, including— 16

450450 (C) public safety facilities; 19
451451 (D) hospitals; 20
452452 (E) health clinics; 21
453453 (F) community centers; 22
454454 (G) community nonprofit facilities pro-23
455455 viding essential services; 24
456456 (H) libraries; 25

479479 (i) a private entity, or a nonprofit or-19
480480 ganization, that owns critical community 20
