25	25	Be it enacted by the Senate and House of Representa-1
26	26	tives of the United States of America in Congress assembled, 2
27	27	SECTION 1. SHORT TITLE. 3
28	28	This Act may be cited as the ‘‘Gun Trafficker Detec-4
29	29	tion Act’’. 5

33	33	SEC. 2. REPORTING OF LOST OR STOLEN FIREARMS TO 1
34	34	LAW ENFORCEMENT AUTHORITIES. 2

36	36	EPORTINGREQUIREMENT.— 3
37	37	(1) I
38	38	N GENERAL.—Section 922 of title 18, 4
39	39	United States Code, is amended by adding at the 5
40	40	end the following: 6
41	41	‘‘(aa)(1) Within 48 hours after a person not licensed 7
42	42	under this chapter who owns a firearm that has been 8
43	43	shipped or transported in, or has been possessed in or af-9
44	44	fecting, interstate or foreign commerce, discovers or rea-10
45	45	sonably should have discovered the theft or loss of the fire-11
46	46	arm, the person shall report the theft or loss to the Attor-12
47	47	ney General. If the report to the Attorney General is not 13
48	48	submitted through a web portal created by the Attorney 14
49	49	General for such purpose, the person shall report the theft 15
50	50	or loss to local law enforcement authorities. 16
51	51	‘‘(2) Within 72 hours after the Attorney General re-17
52	52	ceives a report through the web portal pursuant to para-18
53	53	graph (1), the Attorney General shall notify the chief law 19
54	54	enforcement officer of the jurisdiction in which the theft 20
55	55	or loss occurred of the name and address of the reporting 21
56	56	person.’’. 22

60	60	REATION OF WEB-BASED PORTAL.— 24
61	61	Within 180 days after the date of the enact-25
62	62	ment of this Act, the Attorney General shall 26

67	67	members of the public may use to report the 2
68	68	theft or loss of a firearm to the Attorney Gen-3
69	69	eral pursuant to section 922(aa) of title 18, 4
70	70	United States Code, that includes a notice to 5
71	71	users of the penalties under section 924(a)(1) 6
72	72	of such title for knowingly making a false state-7
73	73	ment or representation in such a report. 8

75	75	SE OF FUNDS REQUIREMENTS .—Sec-9
76	76	tion 502(a) of title I of the Omnibus Crime 10
77	77	Control and Safe Streets Act of 1968 (34 11
78	78	U.S.C. 10153(a)) is amended by adding at the 12
79	79	end the following: 13
80	80	‘‘(7) An assurance that, for each fiscal year 14
81	81	covered by an application, the applicant will use not 15
82	82	less than 5 percent of the total amount of the grant 16
83	83	award for the fiscal year to study and implement ef-17
84	84	fective management and collection of data relating to 18
85	85	lost or stolen firearms reported to a law enforcement 19
86	86	agency of the applicant under section 922(aa) of 20
87	87	title 18, United States Code, unless the applicant 21
88	88	has ensured, and the Attorney General has certified, 22
89	89	that the applicant has in effect such laws and proce-23
90	90	dures as are necessary to ensure that each such re-24

97	97	ENALTIES.—Section 924 of title 18, 3
98	98	United States Code, is amended by adding at the 4
99	99	end the following: 5
100	100	‘‘(q) With respect to a violation of section 922(aa), 6
101	101	the Attorney General shall, after notice and opportunity 7
102	102	for a hearing— 8
103	103	‘‘(1)(A) in the case of a first violation, subject 9
104	104	the person to a civil money penalty of not more than 10
105	105	$1,000; or 11
106	106	‘‘(B) in the case of a second or subsequent vio-12
107	107	lation, subject the person to a civil money penalty of 13
108	108	not more than $5,000; and 14
109	109	‘‘(2) in the case of any violation, notify the per-15
110	110	son of the prohibitions set forth in section 16
111	111	922(bb).’’. 17

122	122	been twice assessed a civil money penalty under section 25

128	128	‘‘(2) It shall be unlawful for a person who has been 3
129	129	thrice assessed a civil money penalty under section 924(q) 4
130	130	to receive a firearm during the 5-year period that begins 5
131	131	with the date of the most recent such assessment.’’. 6

134	134	United States Code, is amended by striking ‘‘or (t)’’ 8
135	135	and inserting ‘‘(t), or (bb)’’. 9

149	149	eral shall promulgate such rules as are necessary to 19
150	150	ensure that— 20
151	151	(A) the national instant criminal back-21
152	152	ground check system takes account of section 22
153	153	922(bb) of title 18, United States Code, in per-23
154	154	forming the functions of the system; and 24

168	168	ing ‘‘(g) or (n)’’ and inserting ‘‘(g), (n), or 10
