6262 with Disabilities Act of 1990 (42 U.S.C. 5
6363 12101 et seq.) and section 504 of the Re-6
6464 habilitation Act of 1973 (29 U.S.C. 794). 7

7373 ticable, collect anthropometric data 15
7474 necessary to evaluate the nutritional 16
7575 risk of that individual within 30 days 17

7878 than 90 days after the appointment. 20

9797 UATION.—A nutritional risk evalua-8
9898 tion of such individual shall be com-9
9999 pleted not later than 90 days after the 10
100100 individual is certified for participation 11
101101 pursuant to subclause (I). 12

103103 ERMINATION.—If a State 13
104104 agency does not collect data in accord-14
105105 ance with clause (iii)(II) or the indi-15
106106 vidual is subsequently determined to 16
107107 not meet nutritional risk criteria, the 17
108108 certification of that individual shall 18
109109 terminate on the date described in 19
110110 such clause (iii)(II) or the date of 20
111111 such determination, as applicable.’’; 21

163163 EGULATIONS.—The Secretary shall revise sec-12
164164 tion 246.12(r) of title 7, Code of Federal Regulations, by 13
165165 striking paragraph (4). 14
166166 SEC. 4. REPORT TO CONGRESS. 15
167167 (a) I
168168 NGENERAL.—Not later than 1 year after the 16
169169 date of enactment of this Act, the Secretary shall submit 17
170170 to the Committee on Agriculture, Nutrition, and Forestry 18
171171 of the Senate and the Committee on Education and the 19
172172 Workforce of the House of Representatives a report on 20
173173 the use of remote technologies under the special supple-21
174174 mental nutrition program for women, infants, and children 22
175175 established by section 17 of the Child Nutrition Act of 23
176176 1966 (42 U.S.C. 1786) (referred to in this section as the 24
177177 ‘‘program’’). 25

182182 under subsection (a) shall include a description of— 2
183183 (1) the use of remote technologies and other 3
184184 digital tools, including video, telephone, and online 4
185185 platforms— 5
186186 (A) to certify eligible individuals for pro-6
187187 gram services; and 7
188188 (B) to provide nutrition education and 8
189189 breastfeeding support to program participants; 9
190190 (2) the impact of remote technologies, including 10
191191 video, telephone, and online platforms, on certifi-11
192192 cations, appointments, and participant satisfaction 12
193193 under the program; and 13
194194 (3) best practices to— 14
195195 (A) certify program participants for pro-15
196196 gram services using remote technologies; 16
197197 (B) incorporate the use of digital tools into 17
198198 the program certification process; 18
199199 (C) integrate nutrition education and 19
200200 breastfeeding support services for program par-20
201201 ticipants into remote technologies and plat-21
202202 forms; and 22
203203 (D) securely manage program participant 23
204204 data. 24
