16	16	nutrition program for women, infants, and children, and
17	17	for other purposes.
18	18	Be it enacted by the Senate and House of Representa-1
19	19	tives of the United States of America in Congress assembled, 2
20	20	SECTION 1. SHORT TITLE. 3
21	21	This Act may be cited as the ‘‘More Options to De-4
22	22	velop and Enhance Remote Nutrition in WIC Act of 5
23	23	2025’’ or the ‘‘MODERN WIC Act of 2025’’. 6

27	27	SEC. 2. REDEFINING PRESENCE AT CERTIFICATION. 1
28	28	(a) I
29	29	NGENERAL.—Section 17(d)(3) of the Child Nu-2
30	30	trition Act of 1966 (42 U.S.C. 1786(d)(3)) is amended— 3
31	31	(1) by striking subparagraphs (B) and (C); 4
32	32	(2) by inserting the following after subpara-5
33	33	graph (A): 6
34	34	‘‘(B) P
35	35	RESENCE FOR CERTAIN DETER -7
36	36	MINATIONS AND EVALUATIONS .— 8
37	37	‘‘(i) I
38	38	N GENERAL.—A State agency 9
39	39	shall ensure that appointments for individ-10
40	40	uals seeking certification, recertification, or 11
41	41	a nutritional risk evaluation for participa-12
42	42	tion in the program authorized under this 13
43	43	section are offered— 14
44	44	‘‘(I) in-person; and 15
45	45	‘‘(II) either— 16
46	46	‘‘(aa) by telephone; 17
47	47	‘‘(bb) through video tech-18
48	48	nology that permits 2-way, real 19
49	49	time interactive communications; 20
50	50	or 21
51	51	‘‘(cc) through other formats 22
52	52	that permit 2-way, real time 23
53	53	interactive communications, as 24
54	54	determined by the Secretary. 25

58	58	‘‘(ii) ADA COMPLIANCE.—Any format 1
59	59	made available for an appointment under 2
60	60	clause (i) shall be accessible to an indi-3
61	61	vidual in accordance with the Americans 4
62	62	with Disabilities Act of 1990 (42 U.S.C. 5
63	63	12101 et seq.) and section 504 of the Re-6
64	64	habilitation Act of 1973 (29 U.S.C. 794). 7
65	65	‘‘(iii) N
66	66	UTRITIONAL RISK EVALUA -8
67	67	TIONS FOR VIRTUAL CERTIFICATION .—If 9
68	68	an individual is certified for participation 10
69	69	in the program under clause (i) through a 11
70	70	format other than in-person, a State agen-12
71	71	cy shall— 13
72	72	‘‘(I) to the maximum extent prac-14
73	73	ticable, collect anthropometric data 15
74	74	necessary to evaluate the nutritional 16
75	75	risk of that individual within 30 days 17
76	76	of the appointment; and 18
77	77	‘‘(II) collect such data not later 19
78	78	than 90 days after the appointment. 20
79	79	‘‘(iv) I
80	80	NTERIM ELIGIBILITY FOR NU -21
81	81	TRITIONAL RISK.— 22
82	82	‘‘(I) I
83	83	N GENERAL .—A State 23
84	84	agency may consider an applicant who 24
85	85	meets the income eligibility standards 25

90	90	terim basis to participate in the pro-2
91	91	gram and may certify any such indi-3
92	92	vidual for participation immediately, 4
93	93	without delaying certification until a 5
94	94	nutritional risk evaluation is made. 6

96	96	UTRITIONAL RISK EVAL -7
97	97	UATION.—A nutritional risk evalua-8
98	98	tion of such individual shall be com-9
99	99	pleted not later than 90 days after the 10
100	100	individual is certified for participation 11
101	101	pursuant to subclause (I). 12
102	102	‘‘(III) T
103	103	ERMINATION.—If a State 13
104	104	agency does not collect data in accord-14
105	105	ance with clause (iii)(II) or the indi-15
106	106	vidual is subsequently determined to 16
107	107	not meet nutritional risk criteria, the 17
108	108	certification of that individual shall 18
109	109	terminate on the date described in 19
110	110	such clause (iii)(II) or the date of 20
111	111	such determination, as applicable.’’; 21
112	112	and 22
113	113	(3) by redesignating subparagraphs (D) 23
114	114	through (F) as subparagraphs (C) through (E), re-24
115	115	spectively. 25

156	156	provide for the delivery of food instruments, in-6
157	157	cluding electronic benefit transfer cards, to any 7
158	158	participant through means that do not require 8
159	159	the participant to travel to the local agency to 9
160	160	obtain food instruments, such as through mail-10
161	161	ing or remote issuance.’’. 11

163	163	EGULATIONS.—The Secretary shall revise sec-12
164	164	tion 246.12(r) of title 7, Code of Federal Regulations, by 13
165	165	striking paragraph (4). 14
166	166	SEC. 4. REPORT TO CONGRESS. 15
167	167	(a) I
168	168	NGENERAL.—Not later than 1 year after the 16
169	169	date of enactment of this Act, the Secretary shall submit 17
170	170	to the Committee on Agriculture, Nutrition, and Forestry 18
171	171	of the Senate and the Committee on Education and the 19
172	172	Workforce of the House of Representatives a report on 20
173	173	the use of remote technologies under the special supple-21
174	174	mental nutrition program for women, infants, and children 22
175	175	established by section 17 of the Child Nutrition Act of 23
176	176	1966 (42 U.S.C. 1786) (referred to in this section as the 24
177	177	‘‘program’’). 25

181	181	(b) CONTENT OF REPORT.—The report submitted 1
182	182	under subsection (a) shall include a description of— 2
183	183	(1) the use of remote technologies and other 3
184	184	digital tools, including video, telephone, and online 4
185	185	platforms— 5
186	186	(A) to certify eligible individuals for pro-6
187	187	gram services; and 7
188	188	(B) to provide nutrition education and 8
189	189	breastfeeding support to program participants; 9
190	190	(2) the impact of remote technologies, including 10
191	191	video, telephone, and online platforms, on certifi-11
192	192	cations, appointments, and participant satisfaction 12
193	193	under the program; and 13
194	194	(3) best practices to— 14
195	195	(A) certify program participants for pro-15
196	196	gram services using remote technologies; 16
197	197	(B) incorporate the use of digital tools into 17
198	198	the program certification process; 18
199	199	(C) integrate nutrition education and 19
200	200	breastfeeding support services for program par-20
201	201	ticipants into remote technologies and plat-21
202	202	forms; and 22
203	203	(D) securely manage program participant 23
204	204	data. 24
