15	15	To amend the Grand Ronde Reservation Act to address
16	16	the hunting, fishing, trapping, and animal gathering
17	17	rights of the Confederated Tribes of the Grand Ronde
18	18	Community, and for other purposes.
19	19	Be it enacted by the Senate and House of Representa-1
20	20	tives of the United States of America in Congress assembled, 2
21	21	SECTION 1. GRAND RONDE RESERVATION ACT AMEND-3
22	22	MENT. 4
23	23	Section 2 of Public Law 100–425 (commonly known 5
24	24	as the ‘‘Grand Ronde Reservation Act’’) (102 Stat. 1595) 6
25	25	is amended to read as follows: 7

32	32	EFINITIONS.—In this section: 3
33	33	‘‘(1) C
34	34	ONSENT DECREE .—The term ‘Consent 4
35	35	Decree’ means the final judgment and decree of the 5
36	36	United States District Court for the District of Or-6
37	37	egon, in the action entitled ‘Confederated Tribes of 7
38	38	the Grand Ronde Community of Oregon against the 8
39	39	State of Oregon’, entered on January 12, 1987. 9
40	40	‘‘(2) G
41	41	RAND RONDE HUNTING AND FISHING 10
42	42	AGREEMENT.—The term ‘Grand Ronde Hunting and 11
43	43	Fishing Agreement’ means the agreement entitled 12
44	44	‘Agreement Among the State of Oregon, the United 13
45	45	States of America and the Confederated Tribes of 14
46	46	the Grand Ronde Community of Oregon to Perma-15
47	47	nently Define Tribal Hunting, Fishing, Trapping, 16
48	48	and Animal Gathering Rights of the Tribe and its 17
49	49	Members’ and entered into by the United States on 18
50	50	December 2, 1986. 19
51	51	‘‘(3) I
52	52	NDIAN TRIBE.—The term ‘Indian Tribe’ 20
53	53	has the meaning given the term in section 4 of the 21
54	54	Indian Self-Determination and Education Assistance 22
55	55	Act (25 U.S.C. 5304). 23

63	63	‘‘(1) IN GENERAL.—The Grand Ronde Hunting 1
64	64	and Fishing Agreement shall remain in effect until 2
65	65	and unless replaced, amended, or otherwise modified 3
66	66	by 1 or more successor government-to-government 4
67	67	agreements between the Confederated Tribes of the 5
68	68	Grand Ronde Community and the State of Oregon 6
69	69	relating to the hunting, fishing, trapping, and ani-7
70	70	mal gathering rights of the Confederated Tribes of 8
71	71	the Grand Ronde Community. 9
72	72	‘‘(2) A
73	73	MENDMENTS.—The Grand Ronde Hunt-10
74	74	ing and Fishing Agreement or any successor agree-11
75	75	ment entered into under paragraph (1) may be 12
76	76	amended from time to time by mutual consent of the 13
77	77	Confederated Tribes of the Grand Ronde Commu-14
78	78	nity and the State of Oregon. 15
79	79	‘‘(3) C
80	80	ONTENTS OF NEW AGREEMENT OR FU -16
81	81	TURE AMENDMENTS .—No successor agreement or 17
82	82	amended agreement entered into under paragraph 18
83	83	(1) shall— 19
84	84	‘‘(A) purport to affirm, recognize, estab-20
85	85	lish, expand, adjudicate, waive, limit, abrogate 21
86	86	or otherwise affect the ancestral, aboriginal, 22
87	87	treaty, statutory, equitable, or other applicable 23
88	88	rights of the Confederated Tribes of the Grand 24
89	89	Ronde Community or any other Indian Tribe; 25

93	93	‘‘(B) limit the State of Oregon from enter-1
94	94	ing into separate agreements with other Indian 2
95	95	Tribes that address the authority to take spe-3
96	96	cies within the geographic scope of the agree-4
97	97	ment; or 5
98	98	‘‘(C) be used in a civil or criminal action 6
99	99	in a court of competent jurisdiction to enlarge, 7
100	100	confirm, adjudicate, affect, or modify any treaty 8
101	101	or other right of an Indian Tribe. 9
102	102	‘‘(4) S
103	103	OURCE OF AUTHORITY .—All hunting, 10
104	104	fishing, trapping, and animal gathering rights of the 11
105	105	Confederated Tribes of the Grand Ronde Commu-12
106	106	nity in any successor agreement or amended agree-13
107	107	ment entered into under paragraph (1) after the 14
108	108	date of enactment of this paragraph shall derive 15
109	109	solely from the authority of the State of Oregon. 16
110	110	‘‘(c) J
111	111	UDICIALREVIEW.—In any action brought in 17
112	112	the United States District Court for the District of Or-18
113	113	egon to rescind, overturn, modify, or provide relief under 19
114	114	Federal law from the Consent Decree, the United States 20
115	115	District Court for the District of Oregon shall review the 21
116	116	application of the parties on the merits without regard to 22
117	117	the defense of res judicata or collateral estoppel. 23
118	118	‘‘(d) E
119	119	FFECT.—Nothing in this section, or in any 24
120	120	successor agreement or amended agreement entered into 25

125	125	termining, defining, affirming, recognizing, abrogating, 2
126	126	limiting, or affecting the rights or claims of any Indian 3
127	127	Tribe, including any treaty and other sovereign rights.’’. 4
