2121 SECTION 1. SHORT TITLE. 3
2222 This Act may be cited as the ‘‘Stop Forced Organ 4
2323 Harvesting Act of 2025’’. 5
2424 SEC. 2. STATEMENT OF POLICY. 6
2525 It shall be the policy of the United States— 7

3333 mechanisms in bilateral diplomatic meetings and in 5

3535 (3) to promote the dignity and security of 7
3636 human life in accordance with the Universal Dec-8
3737 laration of Human Rights, adopted on December 10, 9

3939 (4) to hold accountable persons implicated, in-11
4040 cluding members of the Chinese Communist Party, 12
4141 in forced organ harvesting and trafficking in persons 13

4343 SEC. 3. DEFINITIONS. 15

5959 ‘‘forced organ harvesting’’ means the removal of one 2
6060 or more organs from a person by means of coercion, 3
6161 abduction, deception, fraud, or abuse of power or a 4
6262 position of vulnerability. 5

6969 RAFFICKING IN PERSONS FOR PURPOSES 10
7070 OF THE REMOVAL OF ORGANS .—The term ‘‘traf-11
7171 ficking in persons for purposes of the removal of or-12
7272 gans’’ means the recruitment, transportation, trans-13
7373 fer, harboring, or receipt of a person for the purpose 14
7474 of removing one or more of such person’s organs, by 15
7575 means of— 16
7676 (A) coercion; 17
7777 (B) abduction; 18
7878 (C) deception; 19
7979 (D) fraud; 20
8080 (E) abuse of power or a position of vulner-21
8181 ability; or 22
8282 (F) transfer of payments or benefits to 23
8383 achieve the consent of a person having control 24

8989 SEC. 4. AUTHORITY TO DENY OR REVOKE PASSPORTS. 3

9191 NGENERAL.—The Secretary of State may 4
9292 refuse to issue a passport to any individual who has been 5
9393 convicted of an offense under section 301 of the National 6
9494 Organ Transplant Act (42 U.S.C. 274e) and is subject 7
9595 to imprisonment or parole or other supervised release as 8
9696 the result of such conviction if such individual, in the com-9
9797 mission of such an offense, used a passport or crossed an 10
9898 international border. 11

100100 EVOCATION.—The Secretary of State may re-12
101101 voke a passport previously issued to any individual de-13
102102 scribed in subsection (a). 14
103103 SEC. 5. REPORTS ON FORCED ORGAN HARVESTING AND 15

186186 ISTREQUIRED.—Not later than 180 days after 5
187187 the date of the enactment of this Act, the President shall 6
188188 submit to the appropriate committees of Congress a list 7
189189 of each person that the President determines funds, spon-8
190190 sors, or otherwise facilitates forced organ harvesting or 9
191191 trafficking in persons for purposes of the removal of or-10
192192 gans. 11
193193 (b) I
194194 MPOSITION OFSANCTIONS.—The President shall 12
195195 impose the following sanctions with respect to a person 13
196196 on the list required by subsection (a): 14
197197 (1) P
198198 ROPERTY BLOCKING.—The President shall 15
199199 exercise all of the powers granted by the Inter-16
200200 national Emergency Economic Powers Act (50 17
201201 U.S.C. 1701 et seq.) (except that the requirements 18
202202 of section 202 of such Act (50 U.S.C. 1701) shall 19
203203 not apply) to the extent necessary to block and pro-20
204204 hibit all transactions in all property and interests in 21
205205 property of the person if such property and interests 22
206206 in property are in the United States, come within 23
207207 the United States, or are or come within the posses-24
208208 sion or control of a United States person. 25

215215 ISAS, ADMISSION, OR PAROLE.—In 3
216216 the case of an individual, that individual is— 4
217217 (i) inadmissible to the United States; 5
218218 (ii) ineligible to receive a visa or other 6
219219 documentation to enter the United States; 7
220220 and 8
221221 (iii) otherwise ineligible to be admitted 9
222222 or paroled into the United States or to re-10
223223 ceive any other benefit under the Immigra-11
224224 tion and Nationality Act (8 U.S.C. 1101 et 12
225225 seq.). 13

227227 URRENT VISAS REVOKED .— 14
228228 (i) I
229229 N GENERAL.—The visa or other 15
230230 entry documentation of the individual shall 16
231231 be revoked, regardless of when such visa or 17
232232 other entry documentation is or was 18
233233 issued. 19

235235 MMEDIATE EFFECT .—A revoca-20
236236 tion under clause (i) shall— 21
237237 (I) take effect immediately; and 22
238238 (II) automatically cancel any 23
239239 other valid visa or entry documenta-24

253253 section (b)(1) shall not include the authority or 8
254254 a requirement to impose sanctions on the im-9
255255 portation of goods. 10

258258 the term ‘‘good’’ means any article, natural or 12
259259 manmade substance, material, supply or manu-13
260260 factured product, including inspection and test 14
261261 equipment, and excluding technical data. 15

264264 NATIONAL OBLIGATIONS .—Subsection (b)(2) shall 17
265265 not apply to the admission of an individual if the ad-18
266266 mission of the individual is necessary to comply with 19
267267 United States obligations under the Agreement be-20
268268 tween the United Nations and the United States of 21
269269 America regarding the Headquarters of the United 22
270270 Nations, signed at Lake Success June 26, 1947, and 23
271271 entered into force November 21, 1947, under the 24
272272 Convention on Consular Relations, done at Vienna 25

281281 OF HUMANITARIAN ASSISTANCE .—Sanctions under 5
282282 this section may not be imposed with respect to 6
283283 transactions or the facilitation of transactions for— 7
284284 (A) the sale of agricultural commodities, 8
285285 food, or medicine; 9
286286 (B) the provision of vital humanitarian as-10
287287 sistance; 11
288288 (C) financial transactions relating to vital 12
289289 humanitarian assistance or for vital humani-13
290290 tarian purposes; or 14
291291 (D) transporting goods or services that are 15
292292 necessary to carry out operations relating to 16
293293 vital humanitarian assistance. 17
294294 (4) W
295295 AIVER.—The President may, on a case- 18
296296 by-case basis and for periods not to exceed 180 days 19
297297 each, waive the application of sanctions or restric-20
298298 tions imposed with respect to a person under this 21
299299 section if the President certifies to the appropriate 22
300300 committees of Congress not later than 15 days be-23
301301 fore such waiver is to take effect that the waiver is 24

313313 Powers Act (50 U.S.C. 1702 and 1704) to carry out 7
314314 this section. 8

316316 ENALTIES.—A person that violates, at-9
317317 tempts to violate, conspires to violate, or causes a 10
318318 violation of this section or any regulation, license, or 11
319319 order issued to carry out this section shall be subject 12
320320 to the penalties set forth in subsections (b) and (c) 13
321321 of section 206 of the International Emergency Eco-14
322322 nomic Powers Act (50 U.S.C. 1705) to the same ex-15
323323 tent as a person that commits an unlawful act de-16
324324 scribed in subsection (a) of that section. 17
