1414 tives of the United States of America in Congress assembled, 2
1515 SECTION 1. SHORT TITLE. 3
1616 This Act may be cited as the ‘‘Guidance Out Of 4
1717 Darkness Act’’ or the ‘‘GOOD Act’’. 5
1818 SEC. 2. DEFINITIONS. 6

2121 GENCY.—The term ‘‘agency’’ has the 8
2222 meaning given the term in section 551 of title 5, 9

3232 (A) I
3333 N GENERAL.—The term ‘‘guidance 5
3434 document’’— 6
3535 (i) means an agency statement of gen-7
3636 eral applicability (other than a rule that 8
3737 has the force and effect of law promul-9
3838 gated in accordance with the notice and 10
3939 comment procedures under section 553 of 11
4040 title 5, United States Code) that— 12
4141 (I) does not have the force and 13
4242 effect of law; and 14
4343 (II) is designated by an agency 15
4444 official as setting forth— 16
4545 (aa) a policy on a statutory, 17
4646 regulatory, or technical issue; or 18
4747 (bb) an interpretation of a 19
4848 statutory or regulatory issue; and 20
4949 (ii) may include— 21
5050 (I) a memorandum; 22
5151 (II) a notice; 23
5252 (III) a bulletin; 24
5353 (IV) a directive; 25

6767 ULE OF CONSTRUCTION .—The term 10
6868 ‘‘guidance document’’— 11
6969 (i) shall be construed broadly to effec-12
7070 tuate the purpose and intent of this Act; 13

7272 (ii) shall not be limited to the items 15
7373 described in subparagraph (A)(ii). 16
7474 SEC. 3. PUBLICATION OF GUIDANCE DOCUMENTS ON THE 17
7575 INTERNET. 18
7676 (a) I
7777 NGENERAL.—Subject to section 5, on the date 19
7878 on which an agency issues a guidance document, the agen-20
7979 cy shall publish the guidance document in accordance with 21
8080 the requirements under section 4. 22

8282 REVIOUSLYISSUEDGUIDANCEDOCUMENTS.— 23
8383 Subject to section 5, not later than 180 days after the 24
8484 date of enactment of this Act, each agency shall publish, 25

8888 in accordance with the requirements under section 4, any 1
8989 guidance document issued by that agency that is in effect 2
9090 on that date. 3
9191 SEC. 4. SINGLE LOCATION. 4
9292 (a) I
9393 NGENERAL.—All guidance documents published 5
9494 under section 3 by an agency shall be published in a single 6
9595 location on an internet website designated by the Director 7
9696 under subsection (d). 8
9797 (b) A
9898 GENCYINTERNETWEBSITES.—Each agency 9
9999 shall, for guidance documents published by the agency 10
100100 under section 3, publish a hyperlink on the internet 11
101101 website of the agency that provides access to the guidance 12
102102 documents at the location described in subsection (a). 13

104104 RGANIZATION.— 14
105105 (1) I
106106 N GENERAL.—The guidance documents de-15
107107 scribed in subsection (a) shall be— 16
108108 (A) categorized as guidance documents; 17
109109 and 18
110110 (B) further divided into subcategories as 19
111111 appropriate. 20

113113 GENCY INTERNET WEBSITES .—The 21
114114 hyperlinks described in subsection (b) shall be 22
115115 prominently displayed on the internet website of the 23
116116 agency. 24

120120 (d) DESIGNATION.—Not later than 90 days after the 1
121121 date of enactment of this Act, the Director shall designate 2
122122 an internet website on which guidance documents shall be 3
123123 published under section 3. 4
124124 SEC. 5. DOCUMENTS AND INFORMATION EXEMPT FROM 5
125125 DISCLOSURE UNDER FOIA. 6
126126 If a guidance document issued by an agency is a doc-7
127127 ument that is exempt from disclosure under section 552(b) 8
128128 of title 5, United States Code (commonly known as the 9
129129 ‘‘Freedom of Information Act’’), or contains information 10
130130 that is exempt from disclosure under that section, that 11
131131 document or information, as the case may be, shall not 12
132132 be subject to the requirements under this Act. 13
133133 SEC. 6. RESCINDED GUIDANCE DOCUMENTS. 14
134134 On the date on which a guidance document issued 15
135135 by an agency is rescinded, or, in the case of a guidance 16
136136 document that is rescinded pursuant to a court order, not 17
137137 later than the date on which the order is entered, the 18
138138 agency shall, at the location described in section 4(a)— 19
139139 (1) maintain the rescinded guidance document; 20
140140 and 21
141141 (2) indicate— 22
142142 (A) that the guidance document is re-23
143143 scinded; 24

152152 ment was rescinded. 6
153153 SEC. 7. RULES OF CONSTRUCTION. 7

155155 ALIDITY OFGUIDANCEDOCUMENTS.—Nothing 8
156156 in this Act shall be construed to mean that noncompliance 9
157157 with any provision of this Act affects or otherwise impacts 10
158158 the validity of any guidance document. 11

160160 ONGRESSIONALREVIEW OFGUIDANCEDOCU-12
161161 MENTS.—Nothing in this Act shall be construed to affect 13
162162 or otherwise impact whether a guidance document is sub-14
163163 ject to congressional review under chapter 8 of title 5, 15
164164 United States Code. 16
165165 SEC. 8. REPORT ON AGENCY COMPLIANCE. 17
166166 Not later than 5 years after the date of enactment 18
167167 of this Act, the Comptroller General shall submit to the 19
168168 Committee on Oversight and Government Reform of the 20
169169 House of Representatives and the Committee on Home-21
170170 land Security and Governmental Affairs of the Senate a 22
171171 report on agency compliance with this Act. 23
