17	17	To provide that a project for the collocation of a personal
18	18	wireless service facility is not subject to requirements
19	19	to prepare certain environmental or historical preserva-
20	20	tion reviews.
21	21	Be it enacted by the Senate and House of Representa-1
22	22	tives of the United States of America in Congress assembled, 2
23	23	SECTION 1. SHORT TITLE. 3
24	24	This Act may be cited as the ‘‘Wireless Broadband 4
25	25	Competition and Efficient Deployment Act’’. 5

33	33	XEMPTION.—A Federal authorization 4
34	34	with respect to a covered project may not be considered 5
35	35	a major Federal action under section 102(2)(C) of the Na-6
36	36	tional Environmental Policy Act of 1969 (42 U.S.C. 7
37	37	4332(2)(C)). 8

39	39	ATIONALHISTORICPRESERVATIONACTEX-9
40	40	EMPTION.—A covered project may not be considered an 10
41	41	undertaking under section 300320 of title 54, United 11
42	42	States Code. 12

44	44	EFINITIONS.—In this section: 13
45	45	(1) C
46	46	OMMISSION.—The term ‘‘Commission’’ 14
47	47	means the Federal Communications Commission. 15
48	48	(2) C
49	49	OVERED PROJECT .—The term ‘‘covered 16
50	50	project’’ means a project— 17
51	51	(A) for— 18
52	52	(i) the mounting or installation of an 19
53	53	eligible personal wireless service facility 20
54	54	with another eligible personal wireless serv-21
55	55	ice facility that exists at the time at which 22
56	56	a complete request for authorization of 23
57	57	such mounting or installation is filed with 24
58	58	a State or local government or instrumen-25
59	59	tality thereof or with an Indian Tribe; or 26

64	64	sonal wireless service facility; and 2
65	65	(B) for which a permit, license, or approval 3
66	66	from the Commission is required or that is oth-4
67	67	erwise subject to the jurisdiction of the Com-5
68	68	mission. 6

70	70	LIGIBLE PERSONAL WIRELESS SERVICE 7
71	71	FACILITY.—The term ‘‘eligible personal wireless 8
72	72	service facility’’ means any antenna, apparatus, or 9
73	73	transmitting device, and any equipment, switches, 10
74	74	wiring, cabling, power sources, shelters, or cabinets, 11
75	75	for the provision of a personal wireless service. 12

77	77	EDERAL AUTHORIZATION .—The term 13
78	78	‘‘Federal authorization’’— 14
79	79	(A) means any authorization required 15
80	80	under Federal law with respect to a covered 16
81	81	project; and 17
82	82	(B) includes any permits, special use au-18
83	83	thorizations, certifications, opinions, or other 19
84	84	approvals as may be required under Federal law 20
85	85	with respect to a covered project. 21

87	87	NDIAN TRIBE.—The term ‘‘Indian Tribe’’ 22
88	88	has the meaning given the term ‘‘Indian tribe’’ 23
89	89	under section 102 of the Federally Recognized In-24
90	90	dian Tribe List Act of 1994 (25 U.S.C. 5130). 25

94	94	(6) PERSONAL WIRELESS SERVICES .—The term 1
95	95	‘‘personal wireless services’’— 2
96	96	(A) has the meaning given such term in 3
97	97	section 332(c)(7)(C) of the Communications 4
98	98	Act of 1934 (47 U.S.C. 332(c)(7)(C)); and 5
99	99	(B) also includes commercial mobile data 6
100	100	service (as defined in section 6001 of the Mid-7
101	101	dle Class Tax Relief and Job Creation Act of 8
102	102	2012 (47 U.S.C. 1401)). 9

104	104	TATE.—The term ‘‘State’’ means each 10
105	105	State of the United States, the District of Columbia, 11
106	106	and each territory or possession of the United 12
107	107	States. 13
