1919 SECTION 1. SHORT TITLE. 3
2020 This Act may be cited as the ‘‘Protect and Serve Act 4
2121 of 2025’’. 5

2727 (a) I
2828 NGENERAL.—Chapter 7 of title 18, United 3
2929 States Code, is amended by adding at the end the fol-4
3030 lowing: 5
3131 ‘‘§ 120. Crimes targeting law enforcement officers 6
3232 ‘‘(a) I
3333 NGENERAL.—Whoever, in any circumstance 7
3434 described in subsection (b), willfully causes serious bodily 8
3535 injury to a person because of that person’s status as a 9
3636 law enforcement officer, or attempts to do so— 10
3737 ‘‘(1) shall be imprisoned not more than 10 11
3838 years, fined in accordance with this title, or both; 12
3939 and 13
4040 ‘‘(2) shall be imprisoned for any term of years 14
4141 or for life, fined in accordance with this title, or 15
4242 both, if— 16
4343 ‘‘(A) death results from the offense; or 17
4444 ‘‘(B) the offense includes kidnapping or an 18
4545 attempt to kidnap, or an attempt to kill. 19
4646 ‘‘(b) C
4747 IRCUMSTANCESDESCRIBED.—For purposes of 20
4848 subsection (a), the circumstances described in this sub-21
4949 section are that— 22
5050 ‘‘(1) the conduct described in subsection (a) oc-23
5151 curs during the course of, or as the result of, the 24
5252 travel of the defendant or the victim— 25

5656 ‘‘(A) across a State line or national border; 1
5757 or 2
5858 ‘‘(B) using a channel, facility, or instru-3
5959 mentality of interstate or foreign commerce; 4
6060 ‘‘(2) in connection with the conduct described in 5
6161 subsection (a), the defendant employs a firearm, 6
6262 dangerous weapon, explosive or incendiary device, or 7
6363 other weapon that has traveled in interstate or for-8
6464 eign commerce; 9
6565 ‘‘(3) the conduct described in subsection (a) oc-10
6666 curs on Federal property or in interference of Fed-11
6767 eral actors; and 12
6868 ‘‘(4) the victim is a Federal law enforcement of-13
6969 ficer. 14

7171 ERTIFICATIONREQUIREMENT.— 15
7272 ‘‘(1) I
7373 N GENERAL.—No prosecution of any of-16
7474 fense described in this section may be undertaken by 17
7575 the United States, except under the certification in 18
7676 writing of the Attorney General, or a designee, 19
7777 that— 20
7878 ‘‘(A) the State has requested that the Fed-21
7979 eral Government assume jurisdiction; or 22
8080 ‘‘(B) a prosecution by the United States is 23
8181 in the public interest and necessary to secure 24
8282 substantial justice. To determine whether a 25

8686 prosecution meets this standard, the Attorney 1
8787 General shall consider: 2
8888 ‘‘(i) the verdict or sentence obtained 3
8989 pursuant to State charges; 4
9090 ‘‘(ii) the extent of planning and 5
9191 premeditation; 6
9292 ‘‘(iii) the intended outcome of the con-7
9393 duct; 8
9494 ‘‘(iv) disregard for human life, includ-9
9595 ing collateral damage to unintended vic-10
9696 tims; and 11
9797 ‘‘(v) benefit to public safety from Fed-12
9898 eral prosecution. 13
9999 ‘‘(2) R
100100 ULE OF CONSTRUCTION .—Nothing in 14
101101 this subsection shall be construed to limit the au-15
102102 thority of Federal officers, or a Federal grand jury, 16
103103 to investigate possible violations of this section. 17
104104 ‘‘(d) D
105105 EFINITIONS.—In this section: 18
106106 ‘‘(1) L
107107 AW ENFORCEMENT OFFICER .—The term 19
108108 ‘law enforcement officer’ means an employee of a 20
109109 governmental or public agency who is authorized by 21
110110 law— 22
111111 ‘‘(A) to engage in or supervise the preven-23
112112 tion, detection, or the investigation of any 24
113113 criminal violation of law; or 25

118118 tion or the incarceration of any person for any 2
119119 criminal violation of law. 3

121121 TATE.—The term ‘State’ means a State 4
122122 of the United States, the District of Columbia, or 5
123123 any commonwealth, territory, or possession of the 6
124124 United States.’’. 7

126126 LERICALAMENDMENT.—The table of sections 8
127127 at the beginning of such chapter is amended by adding 9
128128 at the end the following new item: 10
129129 ‘‘120. Crimes targeting law enforcement officers.’’.
