4949 Federal activities that affect human health and the 13

5151 ‘‘(A) are fully protected from dispropor-15

5353 mental effects (including risks) and hazards, in-17
5454 cluding those related to climate change, the cu-18
5555 mulative impacts of environmental and other 19

6666 term ‘environmental justice matter’ includes any 2
6767 civil or criminal matter in which the conduct or ac-3
6868 tion at issue may involve a disproportionate and ad-4
6969 verse environmental or human health effect on— 5
7070 ‘‘(A) an identifiable low-income, Tribal, or 6
7171 Indigenous population or community in the 7
7272 United States; or 8
7373 ‘‘(B) a community in the United States 9
7474 with environmental justice concerns. 10

7676 NDIGENOUS POPULATION OR COMMU -11
7777 NITY.—The term ‘Indigenous population or commu-12
7878 nity’ includes populations or communities of Amer-13
7979 ican Indians, Alaska Natives, and Native Hawaiians. 14

8181 OW-INCOME COMMUNITY .—The term 15
8282 ‘low-income community’ means any census block 16
8383 group in which 30 percent or more of the population 17

107107 STABLISHMENT.—There is established 10
108108 the Office of Environmental Justice within the Envi-11
109109 ronment and Natural Resources Division of the De-12
110110 partment. 13

112112 ERSONNEL AND FUNDING .—The Attor-14
113113 ney General shall provide to the Office such per-15
114114 sonnel and funds as are necessary to establish the 16
115115 Office under paragraph (1) and to carry out the du-17
116116 ties of the Office under paragraph (4). 18
117117 ‘‘(3) L
118118 EADERSHIP.—The Office shall be headed 19
119119 by a Director, who shall be appointed by the Attor-20
120120 ney General. 21

291291 resentative in implementing the environmental 19
292292 justice strategy of the Department and any pro-20
293293 posed revisions to the environmental justice 21
294294 strategy of that component. 22

296296 THER REPORTS AND BRIEFINGS .— 23
297297 In addition to the reports required under sub-24
298298 paragraph (A), the Director may also request a 25

309309 DMINISTRATION.—The Director shall co-7
310310 ordinate and support the work of the Council. The 8
311311 Director shall convene the Council not later than 90 9
312312 days after the date of enactment of the Empowering 10
313313 and Enforcing Environmental Justice Act of 2025 11
314314 and shall convene the Council not less than 4 times 12
315315 annually thereafter. 13

317317 UIDANCE FOR DEPARTMENT .— 14

323323 with respect to environmental justice and pro-19
324324 vide such guidance to Department personnel, 20
325325 including provisions for identifying, tracking, 21
326326 and addressing environmental justice matters. 22

329329 than 3 years after the development of the guid-24

414414 date of enactment of this Act, the Attorney General shall 15
415415 establish a grant program (in this section referred to as 16
416416 the ‘‘Program’’) within the Office of Environmental Jus-17
417417 tice to improve the capacity of State, local, and Tribal gov-18
418418 ernments to enforce environmental laws involving environ-19
419419 mental justice matters. 20

421421 RANTAUTHORITY.—In carrying out the Pro-21
422422 gram, the Assistant Attorney General may award grants 22
423423 on a competitive basis to eligible recipients, except that 23
424424 no eligible recipient may be awarded more than 1 grant. 24

428428 (d) ELIGIBLERECIPIENTS.—The Assistant Attorney 1
429429 General may award a grant under the Program to a State, 2
430430 local, or Tribal government determined by the Assistant 3
431431 Attorney General to be capable of carrying out a project 4
432432 pursuant to subsection (e). 5
433433 (e) G
434434 RANTFUNDS.—Grant funds awarded under the 6
435435 Program, shall only be used to— 7
436436 (1) train State, local, and Tribal agencies re-8
437437 sponsible for prosecuting and enforcing laws involv-9
438438 ing environmental justice matters; 10
439439 (2) hire staff to assist in the investigation, 11
440440 prosecution, and enforcement of laws involving envi-12
441441 ronmental justice matters; or 13
442442 (3) establish collaborative programs to provide 14
443443 technical and legal assistance, outreach, and engage-15
444444 ment to help communities with environmental justice 16
445445 concerns participate in decisions impacting the envi-17
446446 ronment, health, and safety of those communities 18
447447 with environmental justice concerns. 19
448448 (f) A
449449 PPLICATIONS.—To be eligible for a grant under 20
450450 the Program, an eligible recipient shall submit to the As-21
451451 sistant Attorney General an application in such form, at 22
452452 such time, and containing such information as the Assist-23
453453 ant Attorney General determines to be appropriate. 24

457457 (g) LIMITATIONS ONGRANTAMOUNTS.—Subject to 1
458458 the availability of appropriations under subsection (j), 2
459459 each grant made under this section shall be for an amount 3
460460 not less than $50,000 and not greater than $1,000,000. 4

462462 EDERALSHARE.—The Federal share of a 5
463463 project under the Program shall not exceed 80 percent, 6
464464 unless the Attorney General waives, wholly or in part, this 7
465465 requirement. 8

467467 EPORT.—Not later than 18 months after the 9
468468 date of enactment of this Act, and every 2 years there-10
469469 after, the Attorney General shall submit a report to cer-11
470470 tain congressional committees on the grant program es-12
471471 tablished under this section, including a description of the 13
