8484 a designee of a motor vehicle owner), without 21
8585 restriction or limitation, in or at the same man-22
8686 ner, time, method, cost (less discounts and re-23

125125 ROHIBITION ON CERTAIN MANDATES RE -5
126126 LATED TO REPAIRS.—Except for recall and warranty 6
127127 repairs, repair or maintenance service procedures, 7
128128 recommendations, service bulletins, repair manuals, 8
129129 position statements, or other similar repair or main-9
130130 tenance guides that are distributed to consumers or 10
131131 to professional repairers, a motor vehicle manufac-11
132132 turer may not— 12
133133 (A) mandate or imply a mandate to use 13
134134 any particular brand or manufacturer of parts, 14
135135 tools, or motor vehicle equipment; or 15
136136 (B) recommend the use of any particular 16
137137 brand or manufacturer of parts, tools, or motor 17
138138 vehicle equipment without a prominent notice 18
139139 immediately following the recommendation, in 19
140140 the same font as the recommendation and in a 20
141141 font size no smaller than the font size used in 21
142142 the recommendation, stating that: ‘‘Vehicle 22
143143 owners can choose which repair parts, tools, 23
144144 and motor vehicle equipment to purchase and 24
145145 should carefully consider their options.’’. 25

150150 Motor vehicle manufacturers may not limit the num-2
151151 ber or types of persons who a motor vehicle owner 3
152152 may designate as simultaneous designees under this 4

155155 IMITATION.—A motor vehicle manufac-6
156156 turer, including any affiliate of such manufacturer 7
157157 and any person working on behalf of such manufac-8
158158 turer, may not be considered or treated in the same 9
159159 way as the motor vehicle owner (or a designee of the 10
160160 motor vehicle owner) for any purpose, except for in-11
161161 clusion in notifications of persistent access to vehi-12
162162 cle-generated data. 13

164164 ULES OF CONSTRUCTION .—Nothing in 14
165165 this Act may be construed to— 15
166166 (A) limit or expand any law or right relat-16
167167 ing to intellectual property; 17
168168 (B) require a motor vehicle manufacturer 18
169169 to divulge any trade secret (as defined in sec-19
170170 tion 1839 of title 18, United States Code) that 20
171171 is not made available to motor vehicle owners 21
172172 (or designees of motor vehicle owners), 22
173173 aftermarket parts manufacturers, aftermarket 23
174174 parts remanufacturers, diagnostic tool manufac-24
175175 turers, and motor vehicle repair facilities (and 25

187187 EQUIREMENTS FOR PERSONS RECEIVING 8
188188 VEHICLE-GENERATED DATA.— 9

190190 EVOCATION OF DESIGNATION .—A 10
191191 motor vehicle owner may revoke the designation 11
192192 of a designee of such owner in the same manner 12
193193 that such designee is designated and without 13
194194 any unreasonable or deceptive burden or barrier 14

198198 as provided in subparagraph (D), a person who 17
199199 accesses vehicle-generated data shall delete such 18
200200 data not later than 72 hours after the relevant 19

202202 writing) the person to do so, with the exception 21
203203 of such data that is necessary to retain for 22
204204 motor vehicle maintenance record-keeping, ac-23
205205 counting, and safety purposes. 24

211211 stores vehicle-generated data— 3
212212 (i) may not use such data for any 4
213213 purpose unrelated to the diagnostics, re-5
214214 pair, service, wear, and calibration or re-6
215215 calibration of parts and systems of the 7
216216 motor vehicle as such services are re-8
217217 quested by the motor vehicle owner; and 9
218218 (ii) may not sell, license, or transfer 10
219219 such data to any other person, except as 11
220220 requested or consented to by the motor ve-12
221221 hicle owner for the purpose of diagnostics, 13
222222 repair, service, wear, and calibration or re-14
223223 calibration of parts and systems of the 15
224224 motor vehicle. 16

242242 DEFINED.—In this paragraph, the term 4
243243 ‘‘data in a de-identified form’’ means infor-5
244244 mation that does not identify and is not 6
245245 linked or reasonably linkable to a distinct 7
246246 individual or motor vehicle, regardless of 8
247247 whether the information is aggregated, and 9
248248 with respect to which the manufacturer of 10
249249 the motor vehicle, parts, or tools— 11
250250 (I) takes reasonable technical 12
251251 measures to ensure that the informa-13
252252 tion cannot, at any point, be used to 14
253253 re-identify an individual or device that 15
254254 identifies or is linked or reasonably 16
255255 linkable to an individual; 17
256256 (II) publicly commits in a clear 18
257257 and conspicuous manner— 19
258258 (aa) to process and transfer 20
259259 the information solely in a de- 21
260260 identified form without any rea-22
261261 sonable means for re-identifica-23
262262 tion; and 24

286286 OMPETITION AND CONSUMERRIGHTS.—Any provision 19
287287 in a contract executed on or after the date of the enact-20
288288 ment of this Act by or on behalf of a motor vehicle manu-21
289289 facturer that purports to violate subsection (a) shall be 22
290290 null and void to the extent that such provision would allow 23
291291 the motor vehicle manufacturer to avoid the prohibitions 24
292292 and requirements described in subsection (a). 25

299299 STABLISHMENT.—Not later than 90 days after 3
300300 the date of the enactment of this Act, the Commission 4
301301 shall establish an advisory committee to be known as the 5
302302 ‘‘Fair Competition After Vehicles Are Sold Advisory Com-6
303303 mittee’’ (in this section referred to as the ‘‘Advisory Com-7
304304 mittee’’). 8

306306 HAIR.—The Chair of the Commission (or a des-9
307307 ignee of the Chair) shall serve as the head of the Advisory 10
308308 Committee. 11

310310 EMBERSHIP.—The Advisory Committee shall be 12
311311 composed of the following members: 13
312312 (1) The Director of the Bureau of Competition 14
313313 (or a designee of the Director). 15
314314 (2) The Administrator of the National Highway 16
315315 Traffic Safety Administration (or a designee of the 17
316316 Administrator). 18
317317 (3) 11 individuals, appointed by the Chair of 19
318318 the Commission, to be comprised of 1 individual 20
319319 from each of the following: 21
320320 (A) Independent motor vehicle repair facili-22

350350 in subsection (c), the Advisory Committee shall— 22
351351 (1) foster industry collaboration in a clear and 23
352352 transparent manner; 24

363363 manufacturers; 8
364364 (E) aftermarket parts manufacturers; 9
365365 (F) aftermarket tools manufacturers; 10
366366 (G) motor vehicle manufacturers; 11
367367 (H) motor vehicle dealership service cen-12
368368 ters; 13
369369 (I) consumer rights organizations; 14
370370 (J) automobile insurers; 15

377377 EETINGS.—The Advisory Committee shall meet 21
378378 not fewer than 3 times per year at the call of the head. 22

385385 the Advisory Committee shall issue a report to the 2
386386 Commission that includes— 3
387387 (A) a description of efforts by the indus-4
388388 tries represented within the Advisory Com-5
389389 mittee to comply with this Act; and 6
390390 (B) an assessment of existing and emerg-7
391391 ing barriers to motor vehicle repair and control 8
392392 of motor vehicle owners over the vehicle-gen-9
393393 erated data of the motor vehicles of such own-10
394394 ers, including whether additional types of data 11
395395 should be included in the definition of vehicle- 12
396396 generated data. 13

398398 UBMISSION.—Not later than 30 days after 14
399399 the date on which the Commission receives a report 15
400400 issued pursuant to paragraph (1), the Commission 16
401401 shall submit a copy of the report to the Committee 17
402402 on Energy and Commerce of the House of Rep-18
403403 resentatives and the Committee on Commerce, 19
404404 Science, and Transportation of the Senate. 20

408408 ROCESS.—The Advisory Committee shall 22
409409 terminate upon an agreement of a majority of the 23

415415 the date on which the Advisory Committee termi-2
416416 nates, the Advisory Committee shall provide notice 3
417417 of and a basis for the termination to the Committee 4
418418 on Energy and Commerce of the House of Rep-5
419419 resentatives and the Committee on Commerce, 6
420420 Science, and Transportation of the Senate. 7
421421 SEC. 4. RULEMAKING. 8
422422 Not later than 180 days after the date of the enact-9
423423 ment of this Act, the National Highway Traffic Safety Ad-10
424424 ministration, in consultation with the Commission, shall 11
425425 promulgate, under section 553 of title 5, United States 12
426426 Code, regulations to require motor vehicle manufacturers 13
427427 and motor vehicle dealers to inform motor vehicle owners 14
428428 about the rights of such owners under this Act at the point 15
429429 of purchase of a motor vehicle. 16
430430 SEC. 5. ENFORCEMENT BY FEDERAL TRADE COMMISSION. 17
431431 (a) U
432432 NFAIR ORDECEPTIVEACTS ORPRACTICES.— 18
433433 A violation of this Act or a regulation promulgated under 19
434434 this Act shall be treated as a violation of a regulation 20
435435 under section 18(a)(1)(B) of the Federal Trade Commis-21
436436 sion Act (15 U.S.C. 57a(a)(1)(B)) regarding unfair or de-22
437437 ceptive acts or practices. 23

439439 OWERS OF COMMISSION.—The Commission 24
440440 shall enforce this Act and any regulation promulgated 25

445445 and with the same jurisdiction, powers, and duties as 2
446446 though all applicable terms and provisions of the Federal 3
447447 Trade Commission Act (15 U.S.C. 41 et seq.) were incor-4
448448 porated into and made a part of this Act, and any person 5
449449 who violates this Act or a regulation promulgated under 6
450450 this Act shall be subject to the penalties and entitled to 7
451451 the privileges and immunities provided in the Federal 8
452452 Trade Commission Act. 9

454454 OMPLAINTPROCESS.— 10

456456 ILING BY COMPLAINANT .—Any person al-11
457457 leging any action taken or refused to be taken by 12
458458 any party subject to this Act in violation of this Act 13
459459 may file a complaint with the Commission briefly 14
460460 stating the facts of such allegation. 15

462462 OTIFICATION AND RESPONSE .—Upon re-16
463463 ceiving a complaint filed pursuant to paragraph (1), 17
464464 the Commission shall forward the complaint to the 18
465465 party named in the complaint and request that such 19
