To amend the Individuals with Disabilities Education Act
to require notification with respect to individualized edu-
cation program teams, and for other purposes.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Empowering Families 4
in Special Education Act’’. 5
SEC. 2. NOTIFICATION REQUIREMENT FOR IEP TEAMS. 6
Section 614(d)(1)(B) of the Individuals with Disabil-7
ities Education Act (20 U.S.C. 1414(d)(1)(B)) is amend-8
ed— 9

(1) in clause (iv), by redesignating subclauses 1
(I) through (III) as items (aa) through (cc), respec-2
tively (and by conforming the margins accordingly); 3
(2) by redesignating clauses (i) through (vii) as 4
subclauses (I) through (VII), respectively (and by 5
conforming the margins accordingly); 6
(3) in the matter preceding subclause (I), as so 7
redesignated, by striking ‘‘The term’’ and inserting 8
the following: 9

OTIFICATION REQUIRED .— 12
Within a reasonable timeframe prior to the 13
first convening of the individualized edu-14
cation program team for a child with a dis-15
ability for a school year, the local edu-16
cational agency that serves such child shall 17
notify the parent of such child that such 18
parent may, under clause (i)(VI), include 19
other individuals who have knowledge or 20
special expertise regarding the child, in-21
cluding related services personnel as appro-22
priate, as part of the individualized edu-23
cation program team.’’. 24
