38	38	to foreign investments in United States agriculture, and

40	40	Be it enacted by the Senate and House of Representa-1
41	41	tives of the United States of America in Congress assembled, 2

46	46	This Act may be cited as the ‘‘Protecting American 2
47	47	Agriculture from Foreign Adversaries Act of 2025’’. 3
48	48	SEC. 2. INCLUSION OF SECRETARY OF AGRICULTURE ON 4
49	49	COMMITTEE ON FOREIGN INVESTMENT IN 5
50	50	UNITED STATES AND CONSIDERATION OF 6
51	51	CERTAIN AGRICULTURAL LAND TRANS-7
52	52	ACTIONS. 8
53	53	(a) I
54	54	NCLUSION ON THE COMMITTEE.—Section 9
55	55	721(k) of the Defense Production Act of 1950 (50 U.S.C. 10
56	56	4565(k)) is amended by adding at the end the following: 11
57	57	‘‘(8) I
58	58	NCLUSION OF THE SECRETARY OF AGRI -12
59	59	CULTURE.—The Secretary of Agriculture shall be a 13
60	60	member of the Committee with respect to a covered 14
61	61	transaction that involves— 15
62	62	‘‘(A) agricultural land; 16
63	63	‘‘(B) agriculture biotechnology; or 17
64	64	‘‘(C) the agriculture industry, including ag-18
65	65	ricultural— 19
66	66	‘‘(i) transportation; 20
67	67	‘‘(ii) storage; and 21
68	68	‘‘(iii) processing.’’. 22

72	72	ANDTRANSACTIONS.—Section 721(b)(1) of the Defense 24
73	73	Production Act of 1950 (50 U.S.C. 4565(b)(1)) is amend-25

79	79	CULTURAL LAND TRANSACTIONS .— 2

81	81	N GENERAL.—After receiving no-3
82	82	tification from the Secretary of Agriculture 4
83	83	of a reportable agricultural land trans-5
84	84	action, the Committee shall determine— 6
85	85	‘‘(I) whether the transaction is a 7
86	86	covered transaction; and 8
87	87	‘‘(II) if the Committee deter-9
88	88	mines that the transaction is a cov-10
89	89	ered transaction, whether the Com-11
90	90	mittee should initiate a review pursu-12
91	91	ant to subparagraph (D), or take an-13
92	92	other action authorized under this sec-14
93	93	tion, with respect to the reportable ag-15
94	94	ricultural land transaction. 16
95	95	‘‘(ii) R
96	96	EPORTABLE AGRICULTURAL 17
97	97	LAND TRANSACTION .—In this subpara-18
98	98	graph, the term ‘reportable agricultural 19
99	99	land transaction’ means a transaction— 20
100	100	‘‘(I) that the Secretary of Agri-21
101	101	culture has reason to believe is a cov-22
102	102	ered transaction; 23
103	103	‘‘(II) that involves the acquisition 24
104	104	of an interest in agricultural land by 25

109	109	public of China, the Democratic Peo-2
110	110	ple’s Republic of Korea, the Russian 3
111	111	Federation, or the Islamic Republic of 4
112	112	Iran; and 5
113	113	‘‘(III) with respect to which a 6
114	114	person is required to submit a report 7
115	115	to the Secretary of Agriculture under 8
116	116	section 2(a) of the Agricultural For-9
117	117	eign Investment Disclosure Act of 10
118	118	1978. 11
119	119	‘‘(iii) S
120	120	UNSET.—The requirements 12
121	121	under this subparagraph shall terminate, 13
122	122	with respect to a foreign person of the re-14
123	123	spective foreign country, on the date that 15
124	124	the People’s Republic of China, the Demo-16
125	125	cratic People’s Republic of Korea, the Rus-17
126	126	sian Federation, or the Islamic Republic of 18
127	127	Iran, as the case may be, is removed from 19
128	128	the list of foreign adversaries in section 20
129	129	791.4 of title 15, Code of Federal Regula-21
130	130	tions.’’. 22
