3232 This Act may be cited as the ‘‘Finish the Wall Act’’. 4

3939 TEMCONSTRUCTION.—Not later than 24 hours after the 3
4040 date of the enactment of this Act, the Secretary of Home-4
4141 land Security shall resume all activities related to the con-5
4242 struction of the border barrier system (also known as, and 6
4343 referred to in this Act as, the ‘‘border wall system’’) along 7
4444 the international border between the United States and 8
4545 Mexico that were underway or being planned for prior to 9
4646 January 20, 2021. 10

4848 OCANCELLATIONS.—The Secretary of Home-11
4949 land Security may not cancel any contract for activities 12
5050 related to border wall system construction referred to in 13
5151 paragraph (1) that was entered into on or before January 14
5252 20, 2021. 15

5454 SE OFFUNDS.—The Secretary of Homeland 16
5555 Security shall expend all funds appropriated or explicitly 17
5656 obligated for border wall system construction referred to 18
5757 in paragraph (1) that were appropriated or obligated, as 19
5858 the case may be, beginning on October 1, 2016, to carry 20
5959 out this Act. 21

6363 YSTEM.—Not later than 30 days after the date of the 23
6464 enactment of this Act, the Secretary of Homeland Security 24

7777 YSTEM.—Not later than 90 days after the date of the 6
7878 enactment of this Act, the Secretary of Homeland Security 7
7979 shall submit to the appropriate congressional committees 8
8080 an implementation plan, including quarterly benchmarks 9
8181 and cost estimates, for satisfying all requirements of bor-10
8282 der wall system construction referred to in subsection 11
8383 (a)(1), including tactical infrastructure, technology, and 12
8484 other elements as identified by the Department of Home-13
8585 land Security prior to January 20, 2021, through the ex-14
8686 penditure of funds appropriated or explicitly obligated, as 15
8787 the case may be, for use beginning on October 1, 2016, 16
8888 as well as any future funds appropriated by Congress. 17

9090 PHOLDNEGOTIATEDAGREEMENTS.—The Sec-18
9191 retary of Homeland Security shall ensure that all agree-19
9292 ments executed in writing between the Department of 20
9393 Homeland Security and private citizens, State, local, and 21
9494 Tribal governments, and other stakeholders are honored 22
9595 by the Department relating to current and future border 23
9696 wall system construction as required by such agreements. 24

104104 ensure and certify to the Committee on Homeland Secu-5
105105 rity of the House of Representatives and the Committee 6
106106 on Homeland Security and Governmental Affairs of the 7
107107 Senate that U.S. Customs and Border Protection is fully 8
108108 compliant with the DNA Fingerprint Act of 2005 at all 9
109109 border facilities that process adults, including as part of 10
110110 a family unit, in the custody of U.S. Customs and Border 11
111111 Protection at the border. 12

120120 Homeland Security and Governmental Affairs and 20
121121 the Committee on Appropriations of the Senate. 21

123123 ACTICAL INFRASTRUCTURE .—The term 22
124124 ‘‘tactical infrastructure’’ includes boat ramps, access 23
125125 gates, checkpoints, lighting, and roads associated 24
126126 with a border wall system. 25
