16	16	To amend title XVIII of the Social Security Act to provide
17	17	coverage for acupuncturist services under the Medicare
18	18	program.
19	19	Be it enacted by the Senate and House of Representa-1
20	20	tives of the United States of America in Congress assembled, 2
21	21	SECTION 1. SHORT TITLE. 3
22	22	This Act may be cited as the ‘‘Acupuncture for Our 4
23	23	Seniors Act of 2025’’. 5

28	28	THE MEDICARE PROGRAM. 2
29	29	(a) I
30	30	NGENERAL.—Section 1861 of the Social Secu-3
31	31	rity Act (42 U.S.C. 1395x) is amended— 4
32	32	(1) in subsection (s)(2)— 5
33	33	(A) by adding ‘‘and’’ at the end of sub-6
34	34	paragraph (JJ); and 7
35	35	(B) by adding at the end the following new 8
36	36	subparagraph: 9
37	37	‘‘(KK) qualified acupuncturist services (as de-10
38	38	fined in subsection (nnn)(1));’’; and 11
39	39	(2) by adding at the end the following new sub-12
40	40	section: 13
41	41	‘‘(nnn) Q
42	42	UALIFIEDACUPUNCTURISTSERVICES.— 14
43	43	‘‘(1) I
44	44	N GENERAL .—The term ‘qualified 15
45	45	acupuncturist services’ means such services fur-16
46	46	nished by a qualified acupuncturist (as defined in 17
47	47	paragraph (2)), and such services and supplies fur-18
48	48	nished as an incident to services furnished by the 19
49	49	qualified acupuncturist, as the qualified 20
50	50	acupuncturist is legally authorized to perform under 21
51	51	State law. 22
52	52	‘‘(2) Q
53	53	UALIFIED ACUPUNCTURIST DEFINED .— 23
54	54	For purposes of this subsection, the term ‘qualified 24
55	55	acupuncturist’ means— 25

59	59	‘‘(A) an individual who is licensed as an 1
60	60	acupuncturist by a State or, in the case of an 2
61	61	individual in a State that does not provide for 3
62	62	such licensure, meets such criteria (such as cer-4
63	63	tification through an appropriate nationally rec-5
64	64	ognized certification authority for 6
65	65	acupuncturists) as the Secretary may specify; 7
66	66	or 8
67	67	‘‘(B) a physician who is legally authorized 9
68	68	to perform acupuncture as part of the practice 10
69	69	of medicine and surgery by the State in which 11
70	70	the physician performs such function or action. 12
71	71	In specifying requirements under subparagraph (A), 13
72	72	the Secretary may use the same requirements as 14
73	73	those established by a certification authority de-15
74	74	scribed in such subparagraph.’’. 16

101	101	AS A PRACTITIONER.—Section 1842(b)(18)(C) of the 11
102	102	Social Security Act (42 U.S.C. 1395u(b)(18)(C)) is 12
103	103	amended by adding at the end the following new 13
104	104	clause: 14
105	105	‘‘(ix) A qualified acupuncturist (as defined in 15
106	106	section 1861(nnn)(2)).’’. 16

109	109	SERVICES FURNISHED IN AN INPATIENT HOSPITAL 18
110	110	SETTING.—Section 1861(b)(4) of the Social Security 19
111	111	Act (42 U.S.C. 1395x(b)(4)) is amended by insert-20
112	112	ing ‘‘qualified acupuncturist services,’’ after ‘‘quali-21
113	113	fied psychologist services,’’. 22

116	116	this section apply with respect to services furnished on or 24
