72 | 72 | | SECTION 1. SHORT TITLE. 3 |
---|
73 | 73 | | This Act may be cited as the ‘‘Keep Americans Safe 4 |
---|
74 | 74 | | Act’’. 5 |

75 | 75 | | SEC. 2. DEFINITIONS. 6 |

76 | 76 | | Section 921(a) of title 18, United States Code, is 7 |

85 | 85 | | any manner, that has an overall capacity of, or that 16 |

86 | 86 | | can be readily restored, changed, or converted to ac-17 |

87 | 87 | | cept, more than 15 rounds of ammunition; and 18 |

88 | 88 | | ‘‘(B) does not include an attached tubular de-19 |
---|
89 | 89 | | vice designed to accept, and capable of operating 20 |
---|
90 | 90 | | only with, .22 caliber rimfire ammunition.’’; and 21 |

101 | 101 | | States Code, is amended by inserting after subsection (u) 6 |

103 | 103 | | ‘‘(v)(1) It shall be unlawful for a person to import, 8 |
---|
104 | 104 | | sell, manufacture, transfer, or possess, in or affecting 9 |
---|
105 | 105 | | interstate or foreign commerce, a large capacity ammuni-10 |
---|
106 | 106 | | tion feeding device. 11 |
---|
107 | 107 | | ‘‘(2) Paragraph (1) shall not apply to the possession 12 |
---|
108 | 108 | | of any large capacity ammunition feeding device otherwise 13 |
---|
109 | 109 | | lawfully possessed on or before the date of enactment of 14 |
---|
110 | 110 | | the Keep Americans Safe Act. 15 |
---|
111 | 111 | | ‘‘(3) Paragraph (1) shall not apply to— 16 |
---|
112 | 112 | | ‘‘(A) the importation for, manufacture for, sale 17 |
---|
113 | 113 | | to, transfer to, or possession by the United States 18 |
---|
114 | 114 | | or a department or agency of the United States or 19 |
---|
115 | 115 | | a State or a department, agency, or political subdivi-20 |
---|
116 | 116 | | sion of a State, or a sale or transfer to or possession 21 |
---|
117 | 117 | | by a qualified law enforcement officer employed by 22 |

133 | 133 | | Federal law, or possession by an employee or con-10 |
---|
134 | 134 | | tractor of such licensee on-site for such purposes or 11 |
---|
135 | 135 | | off-site for purposes of licensee-authorized training 12 |
---|
136 | 136 | | or transportation of nuclear materials; 13 |
---|
137 | 137 | | ‘‘(C) the possession, by an individual who is re-14 |
---|
138 | 138 | | tired in good standing from service with a law en-15 |
---|
139 | 139 | | forcement agency and is not otherwise prohibited 16 |
---|
140 | 140 | | from receiving ammunition, of a large capacity am-17 |
---|
141 | 141 | | munition feeding device— 18 |
---|
142 | 142 | | ‘‘(i) sold or transferred to the individual by 19 |
---|
143 | 143 | | the agency upon such retirement; or 20 |
---|
144 | 144 | | ‘‘(ii) that the individual purchased, or oth-21 |
---|
145 | 145 | | erwise obtained, for official use before such re-22 |
---|
