7171 tives of the United States of America in Congress assembled, 2
7272 SECTION 1. SHORT TITLE. 3
7373 This Act may be cited as the ‘‘Keep Americans Safe 4
7474 Act’’. 5
7575 SEC. 2. DEFINITIONS. 6
7676 Section 921(a) of title 18, United States Code, is 7
7777 amended— 8
7878 (1) by inserting after paragraph (30) the fol-9
7979 lowing: 10
8080 ‘‘(31) The term ‘large capacity ammunition feeding 11
8181 device’— 12
8282 ‘‘(A) means a magazine, belt, drum, feed strip, 13
8383 helical feeding device, or similar device, including 14
8484 any such device joined or coupled with another in 15
8585 any manner, that has an overall capacity of, or that 16
8686 can be readily restored, changed, or converted to ac-17
8787 cept, more than 15 rounds of ammunition; and 18
8888 ‘‘(B) does not include an attached tubular de-19
8989 vice designed to accept, and capable of operating 20
9090 only with, .22 caliber rimfire ammunition.’’; and 21
9191 (2) by adding at the end the following: 22

9595 ‘‘(38) The term ‘qualified law enforcement officer’ 1
9696 has the meaning given the term in section 926B.’’. 2
9797 SEC. 3. RESTRICTIONS ON LARGE CAPACITY AMMUNITION 3
9898 FEEDING DEVICES. 4
9999 (a) I
100100 NGENERAL.—Section 922 of title 18, United 5
101101 States Code, is amended by inserting after subsection (u) 6
102102 the following: 7
103103 ‘‘(v)(1) It shall be unlawful for a person to import, 8
104104 sell, manufacture, transfer, or possess, in or affecting 9
105105 interstate or foreign commerce, a large capacity ammuni-10
106106 tion feeding device. 11
107107 ‘‘(2) Paragraph (1) shall not apply to the possession 12
108108 of any large capacity ammunition feeding device otherwise 13
109109 lawfully possessed on or before the date of enactment of 14
110110 the Keep Americans Safe Act. 15
111111 ‘‘(3) Paragraph (1) shall not apply to— 16
112112 ‘‘(A) the importation for, manufacture for, sale 17
113113 to, transfer to, or possession by the United States 18
114114 or a department or agency of the United States or 19
115115 a State or a department, agency, or political subdivi-20
116116 sion of a State, or a sale or transfer to or possession 21
117117 by a qualified law enforcement officer employed by 22
118118 the United States or a department or agency of the 23
119119 United States or a State or a department, agency, 24
120120 or political subdivision of a State for purposes of law 25

124124 enforcement (whether on or off-duty), or a sale or 1
125125 transfer to or possession by a campus law enforce-2
126126 ment officer for purposes of law enforcement (wheth-3
127127 er on or off-duty); 4
128128 ‘‘(B) the importation for, or sale or transfer to 5
129129 a licensee under title I of the Atomic Energy Act of 6
130130 1954 (42 U.S.C. 2011 et seq.) for purposes of estab-7
131131 lishing and maintaining an on-site physical protec-8
132132 tion system and security organization required by 9
133133 Federal law, or possession by an employee or con-10
134134 tractor of such licensee on-site for such purposes or 11
135135 off-site for purposes of licensee-authorized training 12
136136 or transportation of nuclear materials; 13
137137 ‘‘(C) the possession, by an individual who is re-14
138138 tired in good standing from service with a law en-15
139139 forcement agency and is not otherwise prohibited 16
140140 from receiving ammunition, of a large capacity am-17
141141 munition feeding device— 18
142142 ‘‘(i) sold or transferred to the individual by 19
143143 the agency upon such retirement; or 20
144144 ‘‘(ii) that the individual purchased, or oth-21
145145 erwise obtained, for official use before such re-22
146146 tirement; or 23
147147 ‘‘(D) the importation, sale, manufacture, trans-24
148148 fer, or possession of any large capacity ammunition 25

153153 importer for the purposes of testing or experimen-2
154154 tation authorized by the Attorney General. 3
155155 ‘‘(4) For purposes of paragraph (3)(A), the term 4
156156 ‘campus law enforcement officer’ means an individual who 5
157157 is— 6
158158 ‘‘(A) employed by a private institution of higher 7
159159 education that is eligible for funding under title IV 8
160160 of the Higher Education Act of 1965 (20 U.S.C. 9
161161 1070 et seq.); 10
162162 ‘‘(B) responsible for the prevention or investiga-11
163163 tion of crime involving injury to persons or property, 12
164164 including apprehension or detention of persons for 13
165165 such crimes; 14
166166 ‘‘(C) authorized by Federal, State, or local law 15
167167 to carry a firearm, execute search warrants, and 16
168168 make arrests; and 17
169169 ‘‘(D) recognized, commissioned, or certified by 18
170170 a government entity as a law enforcement officer.’’. 19

174174 title 18, United States Code, is amended by adding at the 22
175175 end the following: ‘‘A large capacity ammunition feeding 23
176176 device manufactured after the date of enactment of the 24
177177 Keep Americans Safe Act shall be identified by a serial 25

230230 capacity ammunition feeding devices, as that 22
231231 term is defined in section 921 of title 18, 23
232232 United States Code, under buy-back programs 24
233233 for large capacity ammunition feeding devices.’’. 25

238238 If any provision of this Act, an amendment made by 2

241241 tutional, the remainder of this Act, the amendments made 5
242242 by this Act, and the application of such provision or 6
243243 amendment to any person or circumstance shall not be af-7
244244 fected thereby. 8
