70	70	Be it enacted by the Senate and House of Representa-1
71	71	tives of the United States of America in Congress assembled, 2
72	72	SECTION 1. SHORT TITLE. 3
73	73	This Act may be cited as the ‘‘Keep Americans Safe 4
74	74	Act’’. 5
75	75	SEC. 2. DEFINITIONS. 6
76	76	Section 921(a) of title 18, United States Code, is 7
77	77	amended— 8
78	78	(1) by inserting after paragraph (30) the fol-9
79	79	lowing: 10
80	80	‘‘(31) The term ‘large capacity ammunition feeding 11
81	81	device’— 12
82	82	‘‘(A) means a magazine, belt, drum, feed strip, 13
83	83	helical feeding device, or similar device, including 14
84	84	any such device joined or coupled with another in 15
85	85	any manner, that has an overall capacity of, or that 16
86	86	can be readily restored, changed, or converted to ac-17
87	87	cept, more than 15 rounds of ammunition; and 18
88	88	‘‘(B) does not include an attached tubular de-19
89	89	vice designed to accept, and capable of operating 20
90	90	only with, .22 caliber rimfire ammunition.’’; and 21
91	91	(2) by adding at the end the following: 22

95	95	‘‘(38) The term ‘qualified law enforcement officer’ 1
96	96	has the meaning given the term in section 926B.’’. 2
97	97	SEC. 3. RESTRICTIONS ON LARGE CAPACITY AMMUNITION 3
98	98	FEEDING DEVICES. 4
99	99	(a) I
100	100	NGENERAL.—Section 922 of title 18, United 5
101	101	States Code, is amended by inserting after subsection (u) 6
102	102	the following: 7
103	103	‘‘(v)(1) It shall be unlawful for a person to import, 8
104	104	sell, manufacture, transfer, or possess, in or affecting 9
105	105	interstate or foreign commerce, a large capacity ammuni-10
106	106	tion feeding device. 11
107	107	‘‘(2) Paragraph (1) shall not apply to the possession 12
108	108	of any large capacity ammunition feeding device otherwise 13
109	109	lawfully possessed on or before the date of enactment of 14
110	110	the Keep Americans Safe Act. 15
111	111	‘‘(3) Paragraph (1) shall not apply to— 16
112	112	‘‘(A) the importation for, manufacture for, sale 17
113	113	to, transfer to, or possession by the United States 18
114	114	or a department or agency of the United States or 19
115	115	a State or a department, agency, or political subdivi-20
116	116	sion of a State, or a sale or transfer to or possession 21
117	117	by a qualified law enforcement officer employed by 22
118	118	the United States or a department or agency of the 23
119	119	United States or a State or a department, agency, 24
120	120	or political subdivision of a State for purposes of law 25

124	124	enforcement (whether on or off-duty), or a sale or 1
125	125	transfer to or possession by a campus law enforce-2
126	126	ment officer for purposes of law enforcement (wheth-3
127	127	er on or off-duty); 4
128	128	‘‘(B) the importation for, or sale or transfer to 5
129	129	a licensee under title I of the Atomic Energy Act of 6
130	130	1954 (42 U.S.C. 2011 et seq.) for purposes of estab-7
131	131	lishing and maintaining an on-site physical protec-8
132	132	tion system and security organization required by 9
133	133	Federal law, or possession by an employee or con-10
134	134	tractor of such licensee on-site for such purposes or 11
135	135	off-site for purposes of licensee-authorized training 12
136	136	or transportation of nuclear materials; 13
137	137	‘‘(C) the possession, by an individual who is re-14
138	138	tired in good standing from service with a law en-15
139	139	forcement agency and is not otherwise prohibited 16
140	140	from receiving ammunition, of a large capacity am-17
141	141	munition feeding device— 18
142	142	‘‘(i) sold or transferred to the individual by 19
143	143	the agency upon such retirement; or 20
144	144	‘‘(ii) that the individual purchased, or oth-21
145	145	erwise obtained, for official use before such re-22
146	146	tirement; or 23
147	147	‘‘(D) the importation, sale, manufacture, trans-24
148	148	fer, or possession of any large capacity ammunition 25

152	152	feeding device by a licensed manufacturer or licensed 1
153	153	importer for the purposes of testing or experimen-2
154	154	tation authorized by the Attorney General. 3
155	155	‘‘(4) For purposes of paragraph (3)(A), the term 4
156	156	‘campus law enforcement officer’ means an individual who 5
157	157	is— 6
158	158	‘‘(A) employed by a private institution of higher 7
159	159	education that is eligible for funding under title IV 8
160	160	of the Higher Education Act of 1965 (20 U.S.C. 9
161	161	1070 et seq.); 10
162	162	‘‘(B) responsible for the prevention or investiga-11
163	163	tion of crime involving injury to persons or property, 12
164	164	including apprehension or detention of persons for 13
165	165	such crimes; 14
166	166	‘‘(C) authorized by Federal, State, or local law 15
167	167	to carry a firearm, execute search warrants, and 16
168	168	make arrests; and 17
169	169	‘‘(D) recognized, commissioned, or certified by 18
170	170	a government entity as a law enforcement officer.’’. 19

174	174	title 18, United States Code, is amended by adding at the 22
175	175	end the following: ‘‘A large capacity ammunition feeding 23

177	177	Keep Americans Safe Act shall be identified by a serial 25

183	183	on the device, and such other identification as the Attor-3
184	184	ney General shall by regulations prescribe.’’. 4

229	229	‘‘(J) Compensation for surrendered large 21
230	230	capacity ammunition feeding devices, as that 22
231	231	term is defined in section 921 of title 18, 23
232	232	United States Code, under buy-back programs 24
233	233	for large capacity ammunition feeding devices.’’. 25

238	238	If any provision of this Act, an amendment made by 2

242	242	by this Act, and the application of such provision or 6
243	243	amendment to any person or circumstance shall not be af-7
