2525 SECTION 1. SHORT TITLE. 3
2626 This Act may be cited as the ‘‘Strategic Ports Re-4
2727 porting Act’’. 5

3131 SEC. 2. MAPPING AND STRATEGY REQUIRED. 1

3333 APPING OFGLOBALPORTS.—The Secretary of 2
3434 State, in coordination with the Secretary of Defense, 3
3535 shall— 4
3636 (1) develop an updated, global mapping of for-5
3737 eign and domestic ports identified to be of impor-6
3838 tance to the United States, because of a capability 7
3939 to provide military, diplomatic, economic, or resource 8
4040 exploration superiority; and 9
4141 (2) identify any efforts by the Government of 10
4242 the People’s Republic of China (PRC) or other PRC 11
4343 entities to build, buy, or otherwise control, directly 12
4444 or indirectly, such ports. 13

4646 UBMISSION OFMAP.—The Secretary of State, 14
4747 in coordination with the Secretary of Defense, shall submit 15
4848 the mapping developed pursuant to subsection (a) to the 16
4949 appropriate congressional committees. Such submission 17
5050 shall be in unclassified form, but may include a classified 18
5151 annex. 19
5252 SEC. 3. DEPARTMENT OF STATE AND DEPARTMENT OF DE-20
5353 FENSE STUDY AND REPORT ON STRATEGIC 21

5656 TUDYREQUIRED.—The Secretary of State, in 23
5757 coordination with the Secretary of Defense, shall conduct 24
5858 a study of— 25
5959 (1) strategic ports; 26

6565 (3) the activities and plans of the Government 3
6666 of the People’s Republic of China (PRC) to expand 4
6767 its control over strategic ports outside of the Peo-5
6868 ple’s Republic of China; 6
6969 (4) the public and private actors, such as China 7
7070 Ocean Shipping Company, that are executing and 8
7171 supporting the activities and plans of the Govern-9
7272 ment of the PRC to expand its control over strategic 10
7373 ports outside of the PRC; 11
7474 (5) the activities and plans of the Government 12
7575 of the PRC to expand its control over maritime lo-13
7676 gistics by promoting products, such as LOGINK, 14
7777 and setting industry standards outside the PRC; 15
7878 (6) how the control by the Government of the 16
7979 PRC over strategic ports outside of the PRC could 17
8080 harm the national security or economic interests of 18
8181 the United States and allies and partners of the 19
8282 United States; and 20
8383 (7) measures the United States Government 21
8484 could take to ensure open access and security for 22
8585 strategic ports and offer alternatives to PRC invest-23
8686 ments or stakes in strategic ports. 24

9090 (b) CONDUCT OFSTUDY.—The Secretary of State 1
9191 and the Secretary of Defense may enter into an arrange-2
9292 ment with a federally funded research and development 3
9393 center under which the center shall conduct the study re-4
9494 quired under subsection (a). 5

9696 EPORT.— 6

9898 N GENERAL.—Not later than one year 7
9999 after the date of the enactment of this Act, the Sec-8
100100 retary of State, in coordination with the Secretary of 9
101101 Defense, shall submit to the appropriate congres-10
102102 sional committees a report on the findings of the 11
103103 study conducted under subsection (a). 12
104104 (2) E
105105 LEMENTS.—The report required by para-13
106106 graph (1) shall include— 14
107107 (A) a detailed list of all known strategic 15
108108 ports operated, controlled, or owned, directly or 16
109109 indirectly, by the PRC or by a foreign person 17
110110 of the PRC, and an assessment of the national 18
111111 security and economic interests relevant to each 19
112112 such port; 20
113113 (B) a detailed list of all known strategic 21
114114 ports operated, controlled, or owned, directly or 22
115115 indirectly, by the United States or United 23
116116 States persons and an assessment of the na-24

122122 (C) an assessment of vulnerabilities of— 3
123123 (i) ports operated, controlled, or 4
124124 owned, directly or indirectly, by the United 5
125125 States; and 6
126126 (ii) strategic ports; 7
127127 (D) an analysis of the activities and ac-8
128128 tions of the Government of the PRC to gain 9
129129 control or ownership over strategic ports, in-10
130130 cluding promoting products, such as LOGINK, 11
131131 and setting industry standards; 12
132132 (E) an assessment of how the Government 13
133133 of the PRC plans to expand its control over 14
134134 strategic ports outside of the PRC; 15
135135 (F) a suggested strategy, developed in con-16
136136 sultation with the heads of the relevant United 17
137137 States Government offices, that suggests 18
138138 courses of action to secure trusted investment 19
139139 and ownership of strategic ports and maritime 20
140140 infrastructure, protect such ports and infra-21
141141 structure from PRC control, and ensure open 22
142142 access and security for such ports, that in-23
143143 cludes— 24

150150 (ii) a list of any additional authorities 4
151151 necessary to carry out the strategy; 5
152152 (iii) an assessment of products owned 6
153153 by the Government of the PRC or by an 7
154154 entity headquartered in the PRC that are 8
155155 used in connection with strategic ports or 9
156156 maritime infrastructure; 10
157157 (iv) an assessment of the costs to— 11
158158 (I) secure such trusted invest-12
159159 ment and ownership; 13
160160 (II) replace products owned by 14
161161 the Government of the PRC or an en-15
162162 tity headquartered in the PRC that 16
163163 are used in connection with such 17
164164 ports; and 18
165165 (III) enhance transparency 19
166166 around the negative impacts of PRC 20
167167 control over strategic ports; and 21
168168 (v) a list of funding sources to secure 22
169169 trusted investment and ownership of stra-23
170170 tegic ports, which shall include— 24

180180 cies to maintain an up-to-date list of strategic 7
181181 ports. 8
182182 (H) an assessment of any national security 9
183183 threat posed by such investments or activities to 10
184184 United States diplomatic and defense personnel 11
185185 and facilities in the vicinity of such ports, in-12
186186 cluding through cyber threats, electronically en-13
187187 abled espionage, or other means. 14

189189 ORM OF REPORT.—The report required by 15
190190 paragraph (1) shall be submitted in unclassified 16
191191 form, but may include a classified annex. 17

216216 opment Finance Corporation; 14
217217 (E) the Office of the Director of National 15
218218 Intelligence; and 16
219219 (F) the Maritime Administration of the 17

221221 (3) The term ‘‘strategic port’’ means an inter-19
222222 national port or waterway that the heads of the rel-20
223223 evant United States Government offices determine is 21
224224 critical to the national security or economic pros-22
225225 perity of the United States. 23
