17	17	To amend the Defense Production Act of 1950 to include
18	18	the Secretary of Agriculture as a member of the Com-
19	19	mittee on Foreign Investment in the United States, and
20	20	for other purposes.
21	21	Be it enacted by the Senate and House of Representa-1
22	22	tives of the United States of America in Congress assembled, 2
23	23	SECTION 1. SHORT TITLE. 3
24	24	This Act may be cited as the ‘‘Agricultural Risk Re-4
25	25	view Act of 2025’’. 5

29	29	SEC. 2. INCLUSION OF THE SECRETARY OF AGRICULTURE 1

31	31	Section 721(k) of the Defense Production Act of 3
32	32	1950 (50 U.S.C. 4565(k)) is amended by adding at the 4
33	33	end the following: 5
34	34	‘‘(8) I
35	35	NCLUSION OF THE SECRETARY OF AGRI -6
36	36	CULTURE.—The Secretary of Agriculture shall be a 7
37	37	member of the Committee with respect to a covered 8
38	38	transaction that involves— 9
39	39	‘‘(A) agricultural land; 10
40	40	‘‘(B) agriculture biotechnology; or 11
41	41	‘‘(C) the agriculture industry, including ag-12
42	42	ricultural transportation, storage, and proc-13
43	43	essing.’’. 14
44	44	SEC. 3. CONSIDERATION OF CERTAIN AGRICULTURAL 15
45	45	LAND TRANSACTIONS. 16
46	46	Section 721(b)(1) of the Defense Production Act of 17
47	47	1950 (50 U.S.C. 4565(b)(1)) is amended by adding at the 18
48	48	end the following: 19
49	49	‘‘(I) C
50	50	ONSIDERATION OF CERTAIN AGRI -20
51	51	CULTURAL LAND TRANSACTIONS .— 21
52	52	‘‘(i) I
53	53	N GENERAL.—After receiving no-22
54	54	tification from the Secretary of Agriculture 23
55	55	of a reportable agricultural land trans-24
56	56	action, the Committee shall determine— 25

61	61	covered transaction; and 2
62	62	‘‘(II) if the Committee deter-3
63	63	mines that the transaction is a cov-4
64	64	ered transaction, whether the Com-5
65	65	mittee should initiate a review pursu-6
66	66	ant to subparagraph (D), or take an-7
67	67	other action authorized under this sec-8
68	68	tion, with respect to the reportable ag-9
69	69	ricultural land transaction. 10
70	70	‘‘(ii) R
71	71	EPORTABLE AGRICULTURAL 11
72	72	LAND TRANSACTION .—In this subpara-12
73	73	graph, the term ‘reportable agricultural 13
74	74	land transaction’ means a transaction— 14
75	75	‘‘(I) that the Secretary of Agri-15
76	76	culture has reason to believe is a cov-16
77	77	ered transaction, based on information 17
78	78	from or in cooperation with the intel-18
79	79	ligence community; 19
80	80	‘‘(II) that involves the acquisition 20
81	81	of an interest in agricultural land by 21
82	82	a foreign person of the People’s Re-22
83	83	public of China, the Democratic Peo-23
84	84	ple’s Republic of Korea, the Russian 24

89	89	Iran; and 2
90	90	‘‘(III) with respect to which a 3
91	91	person is required to submit a report 4
92	92	to the Secretary of Agriculture under 5
93	93	section 2(a) of the Agricultural For-6
94	94	eign Investment Disclosure Act of 7
95	95	1978. 8
96	96	‘‘(iii) S
97	97	UNSET.—The requirements 9
98	98	under this subparagraph shall terminate, 10
99	99	with respect to a foreign person of the re-11
100	100	spective foreign country, on the date that 12
101	101	the People’s Republic of China, the Demo-13
102	102	cratic People’s Republic of Korea, the Rus-14
103	103	sian Federation, or the Islamic Republic of 15
104	104	Iran, as the case may be, is removed from 16
105	105	the list of foreign adversaries in section 17
106	106	791.4 of title 15, Code of Federal Regula-18
107	107	tions.’’. 19
